A certain document entitled "International Fire Code 2006," three copies of which are on file with the Office of the Clerk of the City of Grand Ledge, which code is published by the International Code Council, shall be and is hereby adopted as the Fire Code of the City of Grand Ledge, said adoption being for the purpose of regulation of conditions and conduct hazardous to life and property related to fire or explosion within the City of Grand Ledge, which Code, including all appendixes (B - Fire-Flow Requirements; C - Fire Hydrant Location Distribution; D - Fire Apparatus Access Roads; E - Hazard Categories; F - Hazard Ranking; G - Cryogenic Fluids, Weight and Volume Equivalents), except Appendix A. shall be and is hereby adopted as the Fire Code of the City of Grand Ledge, Eaton County, Michigan.
Section 101.1 of the International Fire Code shall read:
101.1 Title. These regulations shall be known as the Fire Code of the City of Grand Ledge, Eaton County, Michigan, hereinafter referred to as "this code."
Section 109.3 of the International Fire Code, "Violation penalties" shall read:
109.3 Violations; penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or a certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than $500 or by imprisonment not exceeding 93 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
Civil infraction. Except as provided in Section 111.4 of this code, for violations designated as civil infractions, a fine shall be levied as set forth in Chapter 1 of the Grand Ledge City Code, § 1-22, which fines for violation of this Code may be amended from time to time by resolution of the City Council. In addition, said violator (responsible party) shall be liable for court costs, including all expenses, direct or indirect, which the City has incurred in connection with the infraction. The court or magistrate may also impose any and all other remedies applicable to municipal civil infractions as provided by state law. Each day of such violation, whether designated as a civil infraction or a misdemeanor, shall constitute a separate offense.
Section 108.3 of the International Fire Code relating to qualifications for members of the Board of Appeals shall be and is hereby deleted.
Section 111.4 of the International Fire Code is hereby amended to read:
111.4 Failure to comply. Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or an unsafe condition, shall be liable for a fine of not less than $250 nor more than $500.
Section 307.1 of the International Fire Code shall be amended to read: A person shall not kindle or maintain or authorize to be kindled or maintained any open burning unless conducted and approved in accordance with this section and Chapter 74 of the Grand Ledge City Code.
Section 307.4, "Location," Section 307.4.1, "Bonfires," and Section 307.4.2, "Recreational fires," of the International Fire Code shall be and are hereby deleted.
