The Mayor with the advice and consent of the Council may appoint a Board of Park and Recreation Commissioners at the Council's first regular meeting in January of each year. The Board shall consist of not less than three members, but the total number shall be evenly divisible by three, who shall be resident freeholders in the municipality. A tie vote shall be broken by the Mayor.

Before entering upon his duties, each member of the Board shall take an oath, to be filed with the City Clerk, that he will faithfully perform the duties of his office and will not in any manner be actuated or influenced therein by personal or political motives.

The members of the Board shall serve a three-year term of office unless reappointed. The Board shall serve without compensation.
A. 
At the time of the Board's first meeting in January of each year, the Board shall organize by selecting from their number a Chairperson and Secretary.
B. 
It shall be the duty of the Secretary to keep full and correct minutes and records of all meetings and to file the same with the City Clerk where they shall be available for public inspection at any reasonable time.
C. 
All accounts against the park fund shall be audited by the Parks and Recreation Standing Committee of the Council and vouchers shall be drawn by the Chairperson of the Committee and presented to the City Clerk who shall draw warrants on the appropriate fund.
D. 
A majority of the Board members shall constitute a quorum for the transaction of business. The Board shall meet at such times as the Council may designate. Special meetings may be held upon the call of the chairperson, or any two of the Board members.
E. 
It shall be the duty of the Board to take the immediate charge of all parks and recreational facilities belonging to the municipality.
F. 
All actions of the Board shall be subject to the review and control of the Council. The Board shall be responsible for making such reports and performing such other duties as the Council may from time to time designate.[1]

G. 
No member of the Council shall serve as a member of the Park Commission while serving a term of office as a member of the Council. No member of the park Commission shall serve in the capacity of both the Chairperson and Secretary of the Board. Should the Mayor not appoint a Board of Park Commissioners as provided herein, then the Board may be constituted by the Mayor and Council as an ex officio Recreation Board.
