A. 
Permit required. No licensed disposer shall dispose of septage at any location in the City's sewerage system without a permit from the Utility Manager.
B. 
Permit term. Each permit for the disposal of septage shall expire on August 31 of each year.[1]

C. 
Permit process.
(1) 
Initial review. During August of each year, the Utility Manager shall evaluate and establish the total allowable amount of and the general conditions for septage disposal in the City's sewerage system for the upcoming permit term.[2]

(2) 
Application required.
(a) 
Each licensed disposer which desires to dispose of septage in the City sewerage system shall submit to the Utility Manager a written application for a permit. A nonrefundable annual filing fee as set by the Common Council shall accompany the application.[3]

(b) 
Application forms for the disposal of septage shall be available at the wastewater treatment plant.
(3) 
Submittal and review of application. A licensed disposer may file an application for a permit any time during the year. Within 30 days after an application is filed, the Utility Manager shall approve or reject it. For each application approved, the Utility Manager shall deliver to the corresponding licensed disposer, within 15 days of approval, a permit effective on the date of issuance. The Utility Manager shall notify each affected licensed disposer of a rejection within 15 days of the action.
(4) 
Rejection of application. The Utility Manager shall reject an application for disposal of septage by a licensed disposer if:
(a) 
Treatment of the licensed disposer's proposed septage would cause the City's sewerage system to exceed its operating design capacity or to violate any applicable effluent limitations or standards, water quality standards, or any other applicable requirements, including court orders or state or federal statutes, rules, regulations or orders.
(b) 
The licensed disposer's proposed septage is not compatible with the City's sewerage system.
(c) 
In previous years, the licensed disposer has repeatedly failed to comply with material provisions of the City's septage disposal rules or of the disposal plan prepared for the licensed disposer.
A. 
Disposal plan. The Utility Manager shall prepare a disposal plan for each licensed disposer whose application for septage disposal is approved. The disposal plan shall consist of the approved application and all terms and conditions imposed on the licensed disposer, including but not limited to:
(1) 
Specific quantities, locations, times, and methods for discharge of septage into the City's sewerage system;
(2) 
Requirements to report the source and amount of septage placed in the City's sewerage system;
(3) 
Requirements to analyze septage characteristics under Subsection D; and
(4) 
Payment of all sewer service charges specified by § 259-22.
B. 
General conditions. All permit approvals for disposal of septage shall be conditioned on the proper functioning of the City's sewerage system. If at any time the City's sewerage system experiences operational problems, maintenance problems, or the threat of WPDES permit violations, whether related to septage disposal or not, the City may immediately restrict the disposal of septage into its system until such time as corrective action or mitigative measures have been taken.
C. 
Nontransferable. A permit for disposal of septage shall be nontransferable. However, if the licensed disposer acquires a replacement disposal vehicle during the term of the permit, the Utility Manager shall approve, if requested, a transfer for this limited purpose.
D. 
Analysis of septage. The Utility Manager may analyze or require a licensed disposer to analyze representative samples of septage placed into the City's sewerage system to determine the characteristics of the septage and the compatibility of the septage with the City's system.
A. 
Generally. A City-approved licensed disposer shall only discharge septage to the City's sewerage system in accordance with all the terms, conditions and requirements specified by this chapter and by the Utility Manager in its disposal plan.
B. 
Wastewater treatment plant disposal. A City-approved licensed disposer shall discharge its septage into the City's system at the septage receiving station located at the wastewater treatment plant during posted normal working hours of the facility or at such times and locations as approved by the Utility Manager. The licensed disposer shall submit written documentation of the discharge to the Utility Manager within one working day of the disposal in the septage holding facility.
C. 
Discharge documentation. A licensed disposer shall use the form available at the wastewater treatment plant to document each of its discharges to the City's system.
A. 
Generally. For whatever reason, the City may refuse to accept and treat septage from City-approved licensed disposers. The City shall provide written notice to the City-approved licensed disposers at least five days prior to the initial date of any time period that the City shall refuse to accept septage. This notice requirement shall not apply in case of an emergency.
B. 
Conditions. At any time during the term of a permit, the City may refuse to accept the septage from a licensed disposer if:
(1) 
Treatment of the septage would cause the City's sewerage system to exceed its operating design capacity or to violate any applicable effluent limitations or standards, water quality standards, or any other legally applicable requirements, including court orders or state or federal statutes, rules, regulations, or orders;
(2) 
The licensed disposer's septage is not compatible with the City's sewerage system;
(3) 
The licensed disposer fails to comply with the disposal plan prepared by the Utility Manager; or
(4) 
The licensed disposer fails to comply with the septage disposal rules promulgated by the City.
