A. 
Town Board. The elected officials of the Town shall be a Town Chairperson and two Supervisors, Town Clerk/Treasurer and Town Constable, who shall serve two-year terms.

Municipal Judge. The Municipal Judge shall be elected for a term of two years.

Elected and appointed officials shall take and file the official oath within five days after notice of their election or appointment and shall execute and file the official bond as required by state statutes and this Code.
A. 
Elected officials. Elected officials may be removed by the Town Board as provided in § 17.13(2), Wis. Stats., by the judge of the Circuit Court for cause pursuant to § 17.13(3), Wis. Stats., or as provided by § 17.16, Wis. Stats.
B. 
Appointed officials. Appointed officials may be removed as provided in §§ 17.13(1) and (3) and 17.16, Wis. Stats.
A. 
How occurring. Vacancies in elective and appointive positions are caused as provided in §§ 17.03 and 17.035, Wis. Stats.
B. 
How filled. Vacancies in elective and appointive offices shall be filled as provided in § 17.23, Wis. Stats.
The salaries of all elected and appointed officials, including members of boards and commissions, shall be as determined by the Town Board from time to time, provided that the salary of the Chairperson and members of the Board shall not be increased during their terms of office. (See § 66.0505, Wis. Stats.)
A. 
Election and term. The Town Board shall consist of a Chairperson and two Supervisors. See § 83-1A of this chapter.
B. 
Authority. The Town Board shall have all powers of the Town not specifically given to some other body or officer. Except as otherwise provided by law, the Town Board has power over property, finances, highways, streets, utilities and the public service; may act for the government and good order of the Town, for its commercial benefit and for the health, safety, welfare and convenience of the public; and may carry its powers into effect by license, regulations, suppression, borrowing, taxation, special assessment, appropriation, imposition of forfeitures and other necessary or convenient means. The Town Board may appoint such officials from time to time as may be deemed necessary for the benefit of the community. In addition, the Town Board adopted Village Board powers pursuant to Resolution No. 1-61 dated July 12, 1961, and therefore shall have the powers enumerated in § 60.22, Wis. Stats., and may exercise the powers enumerated in § 60.23, Wis. Stats. The powers hereby conferred shall be in addition to all other grants and shall be limited only by express language.

B. 
Powers and duties.
(1) 
Applicable statute. See § 60.33, Wis. Stats.
(2) 
Other duties prescribed by law. The Town Clerk/Treasurer shall have such powers and perform such duties as prescribed by state law and directed by the Town Board.
A. 
Title. This section shall be known as the "Town Constable Ordinance."
B. 
Statutory authority. This section is enacted pursuant to the provisions of §§ 60.22(4) and 60.35, Wis. Stats.
C. 
Jurisdiction and duties. The Town Constable of the Town of Manitowish Waters, Vilas County, Wisconsin, shall have the following jurisdiction and perform the following duties. The Town Constable shall:
(1) 
Keep and preserve the peace within the Town of Manitowish Waters and shall have the full peace powers to arrest and apprehend any person for felony or breach of peace pursuant to § 59.28, Wis. Stats, and for purposes of carrying out such duties shall be considered a peace officer as defined in § 939.22(22), Wis. Stats.
(2) 
Suppress unlawful assemblies within the Town of Manitowish Waters pursuant to § 947.06, Wis. Stats.
(3) 
Direct and regulate traffic and make arrests for violations of traffic crimes and regulations of Chs. 194 and 341 to 349, Wis. Stats., and for purposes of carrying out such duties shall be considered a traffic officer as defined in § 340.01(70), Wis. Stats.
(4) 
Serve within his county any writ, process, order or notice and execute any order, warrant or execution lawfully directed to or required to be executed by him by any court or officer.
(5) 
Attend upon sessions of the Circuit Court of Vilas County when required by the Sheriff.
(6) 
Impound cattle, horses, sheep, swine, dogs and other animals at large on the highways or otherwise in violation of any duly published order or ordinance adopted by the Town Board.
(7) 
Cause to be prosecuted all violations of law of which he has knowledge or information.
(8) 
Perform all other duties required by any law.
(9) 
Cause to be enforced and prosecuted all violations of Town ordinances of which he has knowledge or information.
(10) 
Act on behalf of the Town Board as directed:
(a) 
By the Town Board's work manual for the Town Constable.
(b) 
To see that Town orders and ordinances are obeyed.
(c) 
To see that peace and order are maintained in the Town.
(d) 
To obtain necessary assistance, if available, in case of emergency, except as provided under Ch. 166, Wis. Stats, for emergency government.
D. 
Nonexclusivity.
(1) 
Other ordinance. Adoption of this section does not preclude the Town Board from adopting any other ordinance or providing for the enforcement of any other law or ordinance relating to the same or other matter.
(2) 
Other remedies. The jurisdiction and duties of the Town Constable as stated herein shall not preclude the Town Board or any other Town officer from proceeding under any ordinance or law or by any other enforcement method to enforce any ordinance, regulation, or order.

Other duties prescribed by law. He shall perform such other duties as shall be prescribed by state law, supervisory personnel of the State Department of Revenue and the Town Board, including attendance at all meetings of the Board of Review.
C. 
Confidential information. Whenever the Assessor, in the performance of the Assessor's duties, requests or obtains income and expense information pursuant to § 70.47(7)(af), Wis. Stats., or any successor statute thereto, then such income and expense information that is provided to the Assessor shall be held by the Assessor on a confidential basis, except, however, that the information may be revealed to and used by persons in the discharge of duties imposed by law; in the discharge of duties imposed by office (including but not limited to use by the Assessor in performance of official duties of the Assessor's office and use by the Board of Review in performance of its official duties); or pursuant to order of a court. Income and expense information provided to the Assessor under § 70.47(7)(af), Wis. Stats., unless a court determines that it is inaccurate, is, per § 70.47(7)(af), not subject to the right of inspection and copying under § 19.35(1), Wis. Stats.[1]
