The authority of the Fire Chief and his designees shall follow applicable
provisions of the Code of the Village of New Glarus.
In their interpretation and application, the provisions of this chapter
shall be held to be minimum requirements liberally construed in favor of the
Village and for the utmost protection of the public health and shall not be
deemed a limitation on or repeal of any other power granted by state law.
In any case where a provision of this chapter is found to be in conflict
with a provision of any other local, state or federal law or regulation, the
provision which establishes a higher standard for the promotion and protection
of the health and safety of the people shall prevail.
Whenever the Fire Chief or Building Inspector disapproves an application
or refuses to grant a permit, or when it is claimed that the provisions of
this chapter do not apply or that the true intent and meaning of the Fire
Prevention Code have been misconstrued or wrongly interpreted, any person
or persons feeling aggrieved by such order or determinations may appeal to
the Zoning Board of Appeals. Those procedures customarily used to effectuate
an appeal to the Zoning Board of Appeals shall apply.
The Fire Chief, or his designee, may issue citations for violations of any provision of this chapter. Persons cited under this provision are subject to penalties as provided in Chapter
1, General Provisions, §
1-5 of this Code. The Fire Chief, or his designee, shall also have the power granted under Chapter
216, Public Nuisances, of the Village of New Glarus Code and under state law to abate violations of the Fire Code which constitute public nuisances.
For the purposes of this chapter, the following definitions are used
unless a different definition is specifically provided for a section. Words
used in the present tense include the future; the singular number includes
the plural number; and the plural number includes the singular number. The
word "shall" is mandatory and not permissive.
INTERIOR STORY
Every story, including but not limited to the basement, ground floor,
interior balcony and mezzanine floor.
LOCKBOX
A key box containing keys to gain access to a building. The box is
attached to the building and of a type approved by the Fire Chief.
REMODELING
To change a building or structure in any way that requires a building
permit.
WORKING DAY
Monday through Friday, 8:00 a.m. to 5:00 p.m.
The requirements of this chapter shall be applicable to new construction
or to existing structures when more than 50% reconstructed.
