The Oconto Falls Police Department shall be administered by the Mayor of the City. The Police Department shall consist of such divisions and ranks as deemed necessary by the Mayor and Chief of Police consistent with departmental size, duties, statutory authority and approval by the Common Council.
A. 
Chief of Police. The Chief of Police shall have general supervision over the day-to-day operating of the Police Department. The Chief shall:
(1) 
Have command of the Police Department on administrative matters pursuant to the Oconto Falls Code and state statutes.
(2) 
Cause to be maintained accurate records of all Department activities and prepare monthly activity and incident reports for the Common Council.
(3) 
Cause to be prepared and maintained departmental policies and rules approved by the Common Council.
(4) 
Cause to be maintained adequate records of employment, assignment, promotions, attendance, performance and training for all members of the Department. He shall ensure that all personnel and activities of the Department conform to Law Enforcement Standards Board standards and state statutes and Administrative Code. The Chief shall formulate procedures for recognizing outstanding performance by Department members and for investigating complaints of misconduct by any member of the Department. The Chief shall prepare and maintain job descriptions for each and every position authorized for the Department.
(5) 
Ensure compliance with the policies established by the Common Council and Mayor.
(6) 
Administer all departmental contracts and collective bargaining agreements and ensure compliance with the terms of the same.
(7) 
Have exclusive control of the assignment, hours of duty, and transfer of all members of the Department.
(8) 
Plan, organize, staff, direct and control all of the human and material resources of the Department to ensure the most effective and efficient discharge of departmental duties.
(9) 
Strive to maintain suitable, productive, cooperative relationships with other municipal departments and with other governmental agencies and private organizations concerned with law enforcement, crime prevention, administration of justice and public safety.
(10) 
Serve as custodian of all municipal property, equipment, and supplies under the control of or used by the Police Department and shall be responsible for the care, maintenance, safeguarding, and accurate records of such property, equipment, and supplies.
(11) 
Be the custodian of all property and evidence in the possession of the Department and be responsible for the safekeeping, lawful disposition and accurate record of the same. The Chief shall see that all such property is returned to its lawful owner or otherwise disposed of according to applicable statutes.
B. 
Officers of rank. The Chief shall determine what other officers of rank are necessary within the Department to discharge the duties of the Department in the absence, disability or suspension of the Chief. The recommendation of the Mayor and approval of the Common Council are necessary before any positions of rank within the Department are established or eliminated.
C. 
Police personnel. The personnel of the Police Department shall consist of such number of police personnel as authorized by the Council and shall be increased or decreased by the Council consistent with the needs of the City. All promotions within the Department require the recommendation of the Chief of Police, concurrence of the Mayor and approval of the Common Council.
A. 
Preservation of public peace. The Chief of Police and all police officers shall preserve the public peace and quell disturbances and breaches of the peace and they shall, according to law, apprehend disorderly persons or disturbers of the peace.[1]

B. 
Enforcement of ordinances. The Chief of Police and all police officers shall see that all ordinances are enforced, and whenever any violation thereof comes to their knowledge, whether by personal observation or by information from others, they shall make complaint and cause the person so offending to be prosecuted. They shall cause all ordinances of the City relating to offenses against public morals and decency, public peace and quiet, public policy and public safety to be enforced.
C. 
Licenses. The Chief of Police shall see that all necessary permits and licenses issued by the state, county and City are in the possession of and properly displayed by any person engaged in an activity or business within the City for which such permit or license is required and that the terms and requirements for all such permits and licenses are complied with in full.
D. 
Reporting. The Chief of Police and all police officers shall report all street and sidewalk obstructions; unlit streetlamps; substandard or defective utility facilities; theft of utility services; unlawful signs or signals; apparent building, fire, health, and nuisance code violations; unsecured public and private property, including buildings, equipment, and vehicles; and defective or dangerous streets and sidewalks to the appropriate person or organization responsible for their repair, service, or enforcement.[2]

E. 
Contracts. The Oconto Falls Police Department shall, with the approval of 2/3 of the Common Council for the City of Oconto Falls, have the authority to contract with adjoining municipalities for the delivery of law enforcement services. Such contracts shall only be entered into provided that:
(1) 
Law enforcement services afforded the residents of the City are at no time diminished below the level provided prior to entering into a contract with adjoining municipalities;
(2) 
The City of Oconto Falls is reimbursed 100% inside City limits of all labor, material, equipment, and associated costs for such services and 125% outside City limits at the discretion of the Police Chief; and[3]

(3) 
The length of term of such contracts is subject to annual renewal and shall be reviewed, at a minimum annually, for adjustment of cost, adjustment of level of service, etc.
The Oconto Falls Police Department shall be funded by the City of Oconto Falls and subject to the fiscal policy of the City. The Department shall prepare a budget annually during September for consideration by the City's Finance Committee. The budget shall include payroll costs for staff, operating expenses for the Department, maintenance expenses for departmental facilities, and a capital budget. The Department's annual budget shall be subject to the approval of the Common Council.
All persons in the City, when called upon by any police officer or City official, shall promptly aid and assist in as required and whoever shall neglect or refuse to give such aid or assistance shall be subject to the general penalty as provided in §§ 1-9, 1-10 and 1-11 of the Oconto Falls Code.
A. 
Position. The position of adult crossing guard shall be filled by the Chief of Police. The Chief shall be responsible for their supervision and direction. They shall not be police officers and shall have no powers of arrest.
B. 
Equipment. Adult crossing guards shall be equipped as prescribed by the Chief of Police.
C. 
Salary. Adult crossing guards shall receive such salary as set by the Common Council.
