State traffic laws adopted.

(1) 
Except as otherwise specifically provided in this chapter, the statutory provisions in Chs. 340 through 348, Wis. Stats., describing and defining regulations with respect to vehicles and traffic, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions or modifications of the statutes incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the state.
(2) 
State forfeiture statutes. Any forfeiture for violation of the state statutes adopted by reference in this chapter shall conform to the forfeiture permitted to be imposed for violation of such statutes as set forth in the Uniform State Traffic Deposit Schedule and Uniform Misdemeanor Bail Schedule of the Wisconsin Judicial Conference, including any variations or increases for subsequent offenses, which schedule is adopted by reference.
B. 
Other laws adopted. There are also hereby adopted by reference the following sections of the Wisconsin Statutes, but the prosecution of such offenses under this chapter shall be as provided in Chs. 340 through 348 of the Wisconsin Statutes and the penalty for violation thereof shall be limited to a forfeiture as provided in § 465-17 of this chapter:

The Common Council of the City of Oconto Falls hereby determines that the statutory speed limits on the following streets or portions thereof are unreasonable, unsafe or imprudent and modifies such speed limits under authority granted by § 349.11, Wis. Stats., as follows:

Speed limits increased. Speed limits established by § 346.57(4)(e), (f) and (g), Wis. Stats., are increased as hereinafter set forth upon the following streets or portions thereof:

A. 
School bus use of flashing red lights.

(1) 
Authority to use flashing red warning lights. Pursuant to the authority granted the municipality in § 349.21(1), Wis. Stats., school bus operators shall utilize flashing red warning lights when pupils or other authorized passengers are loaded or unloaded within a public street in a residential or business district within the corporate limits of the City of Oconto Falls.
(2) 
Vehicles to stop for school buses. The operator of a vehicle which approaches from the front or rear of any school bus which has stopped on a street or highway when the bus is equipped according to § 347.25(2), Wis. Stats., and when it is displaying flashing red warning lights shall stop the vehicle not less than 20 feet from the bus and shall remain stopped until the bus resumes motion or the operator extinguishes the red warning lights.
(3) 
Penalty. The penalty for violation of this section shall be as prescribed by the State of Wisconsin Revised Uniform State Traffic Deposit Schedule (or any subsequent amendment thereto).
B. 
General provision. When municipal signs are in place giving notice of parking restrictions of any kind or nature, no person shall park, stop, or allow to stand, any motor vehicle contrary to the provisions of this section.
C. 
Highway defined. As used in this section, "highway" includes all public ways and thoroughfares and all bridges upon the same.
D.

(7) 
Disabled vehicles; repairs, maintenance or dismantling.
(a) 
No disabled motor vehicle shall be parked or allowed to remain on any highway.
(b) 
No repair or dismantling work shall be performed on any motor vehicle while such vehicle is parked or standing on a highway.
(c) 
No maintenance work, such as, by way of example but not by way of restriction or exclusion, changing tires or changing oil, shall be performed on any motor vehicle while such vehicle is parked or standing on a highway.

(9) 
Blocking mail delivery. No vehicle shall be parked so as to prevent the delivery of mail to a postal box. Upon receiving a complaint from a resident or postal carrier that mail could not be delivered because a parked motor vehicle blocked the carrier's access to the box, a police officer shall investigate and, if the vehicle is so parked as to prevent mail delivery, may issue a parking citation.

E. 
Penalties.

(1) 
The penalty for a violation of this section shall be a forfeiture in the amount set forth, from time to time, in the Municipal Fee Schedule.
(2) 
Nonmoving violation and registration program. The City of Oconto Falls shall participate in the Nonmoving Traffic Violation and Registration Program of the Wisconsin Department of Transportation, established under § 345.28, Wis. Stats., and pay the costs established by the Department under § 85.13, Wis. Stats.
(3) 
Recovery of costs. Costs paid by the City to the Department shall be assessed to, and recovered from, persons convicted of nonmoving traffic violations.
(4) 
Compliance with state law. The Police Department and the Municipal Court shall be responsible for the City's compliance with § 345.28, Wis. Stats., and any amendment or renumbering thereof.

A. 
An oversize vehicle, as defined within this chapter, shall mean any truck, trailer, truck power unit, tractor, bus, recreation vehicle, boat trailer or combination of vehicles weighing in excess of 12,000 pounds gross weight, or over 16 feet in length (including accessories, racks, or other physical extension), or having a height of more then eight feet from the roadway.
B. 
No person owning or having control of such vehicle shall park the same on any public street, avenue, roadway, alley, public parking lot or other public way in the City except under the following circumstances:
(1) 
For the lawful parking of such equipment for the actual loading and unloading of goods, wares or merchandise. "Loading" and "unloading," as used in this section, shall mean the actual time consumed in such operation, and provided that loading and unloading activities take place during reasonable daylight hours and do not extend for an unreasonable length of time.
(2) 
In truck/bus parking zones specifically designated by the Common Council.[1]

(3) 
By special permit by the City Police Department.
(a) 
Such permit will be given for one specific physical location and only after a thorough investigation of the safety issues involved with the specific location and the specific vehicle for which parking is requested.
(b) 
Permits for oversized vehicle parking shall only be valid for a period of 72 hours from the time of issue.
C. 
Such vehicles may park on any public street, avenue, roadway, alley, or other public way in the City for a period of up to two consecutive hours between the hours of 6:00 a.m. and 8:00 p.m. in any one City block, provided that the said vehicles can be parked legally and will not obstruct traffic or hamper the safe use of public streets, avenues, roadways, alleys, public parking lots, or other public ways in the City.

A. 
No operator of a school bus or other bus, regardless of its size, shall park such vehicle in any residential district, on the street, on a lawn, in the alley, in a driveway, or anywhere else, except for such time as is reasonably necessary to facilitate the loading or unloading of the vehicle.
B. 
This section shall not prohibit the parking of school buses at any school when required.

No person owning or having control of any truck, refrigerated trailer, truck power unit, tractor, bus, or recreational vehicle shall permit the primary engine or auxiliary engines, generators, or refrigeration units to idle, operate, or run for more then 20 consecutive minutes while parking, standing, or stopped within the City of Oconto Falls except:
A. 
When parked, stopped or standing on the property of the vehicle's owner when such property:
(1) 
Lies within an industrial or commercial zone; or
(2) 
Is more than 500 feet from the nearest residence, whether or not occupied; or
B. 
When such vehicle is located at a vehicle repair facility owned and operated by someone other then the vehicle owner, provided that such facility is properly zoned for the business being conducted therein and the proprietor possesses the proper business licenses and registrations required by the State of Wisconsin; or
C. 
When such vehicle is discharging or loading materials or passengers at a public or private school.

Nothing in § 465-6, 465-7, 465-8 or 465-9 shall be interpreted to permit the parking of oversize vehicles contrary to the winter parking restrictions found in § 465-5 or other parking restrictions as may be found in municipal codes.

Municipal vehicles, vehicles operated by an authority or commission under the jurisdiction of the City, vehicles under the control of contractors in the direct employ of the City, its authorities and/or commissions, and emergency vehicles are exempt from §§ 465-6, 465-7 and 465-8.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
CAMPING TRAILER
A vehicle designed for human habitation and towed upon a highway by a motor vehicle.[1]
DISASSEMBLED, INOPERABLE, JUNKED or WRECKED
A motor vehicle in such state of physical or mechanical ruin as to be incapable of propulsion, incapable of being operated upon the public streets or highways, or incapable of meeting state motor vehicle equipment laws.
MOBILE HOME
A vehicle designed to be towed as a single unit or in sections upon a highway by a motor vehicle and equipped and used or intended to be used primarily for human habitation, with walls of rigid, noncollapsible construction.
MOTOR HOME
A motor vehicle designed to be operated upon a highway for use as a temporary or recreational dwelling and having the same internal characteristics and equipment as a mobile home.
MOTOR VEHICLE
A vehicle, including a combination of two or more vehicles or an articulated vehicle, which is self-propelled, except a vehicle operated exclusively on a rail. "Motor vehicle" includes, without limitation, a commercial motor vehicle or a vehicle which is propelled by electric power obtained from overhead trolley wires but not operated on rails. A snowmobile and an all-terrain vehicle shall only be considered motor vehicles for purposes made specifically applicable by statute.
MUNICIPAL PARKING LOT
Those areas designated in Subsection B below, consisting of property owned or leased by the City of Oconto Falls and made available to the public for the purpose of parking motor vehicles.
OVERSIZED VEHICLE
As defined in § 465-6 of this chapter.
RECREATIONAL VEHICLE
A mobile home that does not exceed the statutory size under § 348.07(2), Wis. Stats.
UNLICENSED
A motor vehicle which does not bear lawful current license plates or for which the owner of such vehicle has not applied for current registration.

B. 
Designation of municipal parking lots. The following municipally owned and maintained parking lots, open for use by the public, are regulated under this section:
(1) 
Municipal Building. The parking lot adjacent to the Municipal Building, 500 North Chestnut Avenue.
(2) 
Downtown. The parking lot lying on the southwest corner of North Main Street and Caldwell Avenue.
(3) 
East Side Beach. The parking lot lying within the boundaries of the East Side Beach Park.
(4) 
Greetan Park. The parking lot lying along the south side of Monroe Street within the boundaries of the municipal lands known as "Greetan Park."
(5) 
Library. The parking lot adjacent to the library at 251 North Main Street.
(6) 
Memorial Field. The parking lot immediately adjacent to Memorial Field, lying between the north end of Jefferson Street and the east end of Central Avenue.
(7) 
Pioneer Drive truck lot. The parking lot lying north of Pioneer Drive and immediately west of the municipal recycling center.
(8) 
Pleasant View Park. The parking lot lying within the boundaries of the dedicated park land in the Pleasant View Estates Subdivision.
(9) 
Post office. The parking lot lying along North Franklin Street directly north of the post office.
(10) 
West Side Park. The parking lot lying within the boundaries of the West Side Beach Park.
C. 
Parking prohibitions.
(1) 
Overnight parking prohibited. Stopping, standing, and parking are prohibited within all municipal parking lots between the hours of 2:00 a.m. and 6:00 a.m. local time.
(2) 
Oversized vehicle parking. Oversized vehicles are prohibited from parking in the municipal parking lots designated in Subsection B above.
(3) 
Except as provided in Subsection C(4), in the event of a snowfall of two inches or more, stopping, standing, and parking is prohibited in all municipal parking lots until such time as the parking lots are plowed.
(4) 
The East Side Beach, Greetan Park, and West Side Park parking lots are designated as unplowed parking lots and are exempt from the provision of Subsection C(3) above.
D. 
Disabled/abandoned vehicle parking prohibited.
(1) 
No disabled, disassembled, inoperable, unlicensed, junked, wrecked, or abandoned vehicle, whether awaiting repair or not, and no parts or accessories thereof or therefrom, shall be parked, stored or allowed to remain in a municipal parking lot.
(2) 
No vehicle shall be repaired or maintained within a municipal parking lot.
E. 
Pioneer Drive municipal parking lot. The Pioneer Drive municipal parking lot was established for the purpose of providing off-street and overnight parking for the residents of Oconto Falls who, as part of their employment, are required to drive oversized vehicles and for residents who, as part of their employment, are required to transport goods in oversized vehicles destined for or originating within the corporate limits of the City. The Pioneer Drive parking lot is not intended to be a secondary storage yard for oversized vehicles belonging to or serving community industries and businesses.
(1) 
All drivers of oversized motor vehicles using the Pioneer Drive parking lot must register with the City of Oconto Falls Police Department.
(2) 
Nonresidents of the City of Oconto Falls are prohibited from using the Pioneer Drive parking lot unless they are transporting products destined for or originating from locations within the corporate limits of the City or unless authorized or directed to do so by the Oconto Falls Police Department.
(3) 
The Pioneer Drive parking lot is exempt from Subsection C(2) and (3); provided, however, that owners of all vehicles using the lot are required to move their vehicles within two hours of being notified by the Administrator - Clerk/Treasurer or designee or Police Department for parking lot maintenance.
(4) 
No camping trailer, mobile home, motor home, recreational vehicle or motor vehicle may be parked or allowed to remain in the Pioneer Drive parking lot for a period of time exceeding 72 hours, except as may be otherwise authorized by the Oconto Falls Police Department.
F. 
Library parking lot.
(1) 
The library parking lot is intended to provide a location for parking for patrons of the community library and not as an off-street parking lot for downtown merchants. The Library Board may establish and adopt additional rules governing the use of this parking lot.
(2) 
No parking is permitted in the library parking lot except by patrons and staff of the library and as permitted under rules promulgated by the Library Board.
(3) 
The library parking lot is exempt from Subsection C(3) above.
G. 
Municipal/emergency/contractor vehicles exempted. Municipal vehicles, vehicles operated by an agency, entity or commission under the jurisdiction of the City, vehicles under the control of contractors in the direct employ of the City, its agencies, entities and/or commissions, and emergency vehicles are exempt from Subsection C(3) above.
H. 
Implementation. The Administrator - Clerk/Treasurer or designee is authorized and directed to post appropriate signs consistent with the provisions of this section.
I. 
Penalty. Any person violating the provisions of this section shall be subject to the forfeitures provided for in § 1-9 of this Code.
A. 
Class "B" highways designated. All streets and alleys within the City of Oconto Falls, except the following enumerated streets and alleys, are hereby designated Class "B" highways and shall be subject to the weight limitations imposed by § 348.16, Wis. Stats.:

B. 
Special and season weight limitations. The Chief of Police shall have the authority to impose special or seasonal weight limits to prevent injury to the road of any highway, bridge or culvert within the jurisdiction of the City, or for the safety of users of such highways, bridge or culvert, and shall be responsible for erecting signs giving notice thereof in accordance with § 349.16, Wis. Stats.
C. 
Heavy traffic routes.
(1) 
Heavy traffic routes designated. The following streets and parts of streets within the City of Oconto Falls are hereby designated heavy traffic routes:

(a)

(2) 
Restrictions on use of other streets by heavy traffic. No vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 6,000 pounds shall be operated or moved on any street or alley not part of the heavy traffic route designated in Subsection C(1) of this section in the City of Oconto Falls, except for the purpose of obtaining orders for, moving or delivering supplies or commodities to or from a place of business or residence facing thereon, provided that, in no event shall the weight of vehicle and load on such other street exceed the limitations of § 348.15 or 348.16(3), Wis. Stats., pertaining to Class "A" highways or deliveries on Class "B" highways.

A. 
Compression brakes prohibited. No person shall use motor vehicle brakes within the corporate limits of the City of Oconto Falls which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof. It shall be an affirmative defense to prosecution under this section that said compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.
B. 
Penalty. Any person violating the provisions of this section shall have committed a traffic violation, and a forfeiture as provided in § 465-17 shall be imposed.[1]

C. 
The Administrator - Clerk/Treasurer or designee is authorized and directed to post appropriate signs consistent with the provisions of this section.
The operator of any vehicle involved in an accident shall, within 10 days after such accident, file with the City Police Department a copy of the report required by § 346.70, Wis. Stats., if any. If the operator is unable to make such report, any occupant of the vehicle at the time of the accident capable of making such report shall have the duty to comply with this section. Such reports shall be subject to the provisions and limitations in §§ 346.70(4)(f) and 346.73, Wis. Stats.

A. 
City Administrator - Clerk/Treasurer or designee authorized to procure and erect signs and signals. The City Administrator - Clerk/Treasurer or designee is hereby authorized and directed to procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the Uniform Traffic Control Devices Manual of the Department of Transportation giving such notice of the provisions of this chapter as required by state law. Signs shall be erected in such locations and manner as the Administrator - Clerk-Treasurer or designee shall determine will best effect the purposes of this chapter and give adequate warning to users of the street or highway.[1]

B. 
Removal of unofficial signs and signals. The Administrator - Clerk/Treasurer or designee shall have the authority granted by § 349.09, Wis. Stats., and is hereby directed to order the removal of a sign, signal, marking or device placed, maintained or displayed in violation of this chapter or § 346.41, Wis. Stats. Any charge imposed on a premises for removal of such an illegal sign, signal or device shall be reported to the Common Council at its next regular meeting for review and certification.
The penalty for violation of any provision of this chapter shall be a forfeiture as hereinafter provided together with the cost of prosecution imposed as provided in §§ 345.20 to 345.53, Wis. Stats.
A. 
Uniform offenses. Forfeitures for violation of any provision of Chs. 341 to 348, Wis. Stats., adopted by reference in § 465-1 of this chapter shall conform to forfeitures for violation of the comparable state offense, including any variations or increases for second offenses.
B. 
Parking. The forfeiture for violation of parking regulations in this chapter, where no other penalty is prescribed, shall be established in a fee schedule set by the Common Council.
C. 
Other local regulations. The penalty for violation of any other provision of this chapter, where no other penalty is prescribed, shall be as provided in § 1-9 of this Code.

This chapter shall be enforced in accordance with the provisions of §§ 66.0114 and 345.20 to 345.53 and Ch. 799, Wis. Stats..
A. 
Stipulation of guilt or no contest. Stipulations of guilt or no contest may be made by persons arrested for violations of this chapter in accordance with § 66.0114(1)(b), Wis. Stats., whenever the provisions of § 345.27, Wis. Stats., are inapplicable to such violations. Stipulations shall conform to the form contained on the uniform traffic citation and complaint under § 345.11, Wis. Stats., and may be accepted within five days of the date of the alleged violation. Stipulations may be accepted by the City Police Department.
B. 
Deposits. Any person stipulating guilt or no contest under Subsection A of this section must make the deposit required under § 345.26, Wis. Stats., or, if the deposit is not established under such statute, shall deposit a forfeited penalty as provided in the schedule established by the Common Council. Deposits may be brought or mailed to the office of the Police Department or Municipal Judge as directed by the arresting officer. Deposits for parking or nonmoving violations shall be mailed or brought to the Police Department.[1]
