A.
Except as otherwise specifically provided in this
chapter, all provisions of Chs. 340 to 348, Wis. Stats., describing
and defining regulations with respect to vehicles and traffic for
which the penalty is a forfeiture only, including penalties to be
imposed and procedure for prosecution, are adopted and by reference
made a part of this chapter as if fully set forth in this chapter.
Any act required to be performed or prohibited by any statute incorporated
in this chapter by reference is required or prohibited by this chapter.[1]

There are also adopted by reference the following sections of the Wisconsin Statutes, but the prosecution of such offenses under this chapter shall be as provided in Chs. 340 to 348, Wis. Stats., and the penalty for violation thereof shall be limited to a forfeiture as provided in § 317-14 of this chapter: § 941.01(1) (negligent operation of vehicle off highway).[2]

The deposit schedules as established by the
Wisconsin Judicial Conference and the Municipal Bond Schedule as adopted
by the Sauk Prairie Court Commission are hereby incorporated by reference.[1]
A.
Definition. "Dynamic braking device" (commonly referred
to as a "jacobs brake," "jake brake," "engine brake" or "compression
brake") means a device primarily on trucks for conversion of the engine
from an internal combustion engine to an air compressor for the purpose
of braking without the use of wheel brakes.

B.
Use prohibited. It is unlawful for any person to operate
any motor vehicle with a dynamic braking device engaged, except for
the aversion of imminent danger, within the Village limits.

The Village Board determines that the statutory
speed limits on the following streets or portions thereof are unreasonable,
unsafe or imprudent and modifies such speed limits under authority
granted by § 349.11, Wis. Stats., as follows:
A.
Speed limits established by § 346.57(4)(e),
(f) and (g), Wis. Stats., are increased as hereafter set forth upon
the following streets or portions thereof.
(1)
Thirty miles per hour: Phillips Boulevard, from the
east corporate limits of the Village to 80 feet east of the curbline
of Sycamore Street.
(2)
Thirty-five miles per hour in the following areas:
(a)
Water Street, from the north curbline of Bates
Street to the north corporate limits of the Village.
(b)
Phillips Street, from the west corporate limits
of the Village to its intersection with Water Street
(c)
Water Street, from its intersection with Phillips
Street to the south line of the railroad crossing of the Chicago,
Milwaukee, St. Paul & Pacific Railroad Company.
(d)
Phillips Boulevard, from 80 feet east of the
curbline of Sycamore Street to the west corporate limits of the Village.
(e)
All of Lueders Road.
(f)
Oak Street, from Lueders Road west to the Village
limits.
A.
Through streets. In the interest of public safety and pursuant to § 349.07, Wis. Stats., the following streets or portions thereof are declared to be through highways, and traffic signs or signals giving notice thereof shall be erected by the Public Works and Utility Director in accordance with § 317-12 of this chapter:
(1)
Water Street south from the north corporate limits
of the Village to the intersection of Water Street with the north
curbline of Phillips Boulevard and from the south curbline of Phillips
Boulevard to Water Street.
(2)
Madison Street south from the north corporate limits
of the Village to the intersection of Madison Street with the north
curbline of Phillips Boulevard and from the south curbline of Phillips
Boulevard to Water Street.
(3)
Phillips Boulevard west from the west curbline of
Water Street to the west corporate limits of the Village.
(4)
Jackson Street west from the west curbline of Water
Street to the east curbline of Madison Street and from the west curbline
of Madison Street to the east curbline of Dallas Street.
(5)
Van Buren Street west from the west curbline of Water
Street to the east curbline of Madison Street and from the west curbline
of Madison Street to the west curbline of Maple Street.
(6)
Polk Street west from the west curbline of Water Street
to the east curbline of Madison Street and from the west curbline
of Madison Street to the east curbline of Maple Street.
(7)
Washington Avenue west from the west curbline of Water
Street to the east curbline of Madison Street and from the west curbline
of Madison Street to the east curbline of Lueders Road and from the
west curbline of Lueders Road to the corporate limits of the Village.

C.
Four-way stop signs. Four-way stop signs shall be
maintained at the intersections of Oak Street and Washington Avenue,
and Oak Street and Helen Street.
A.
Heavy traffic routes designated. The following highways
or parts thereof within the jurisdiction of the Village of Sauk City
are hereby designated heavy traffic routes: Phillips Street from Lueders
Road to Water Street; Water Street from Phillips Street to Phillips
Boulevard; Madison Street from Water Street to John Quincy Adams Street;
John Quincy Adams Street from Water Street to Dallas Street; Dallas
Street from Phillips Boulevard to John Quincy Adams Street; and all
streets, existing and future, within the Sauk City Industrial Park.
B.
Heavy traffic defined. In this chapter, "heavy traffic"
means all vehicles not operating completely on pneumatic tires and
all vehicles or combination of vehicles, other than motor buses, designed
or used for transporting property of any nature and having a gross
weight of more than 6,000 pounds.
C.
Restrictions on use of other streets by heavy traffic. No person shall operate or move a vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 6,000 pounds on any highway not part of the heavy traffic route designated in Subsection A of this section, except for the purpose of obtaining orders for or moving or delivering supplies or commodities to or from a place of business or residence which has an entrance thereon, provided that in no event shall the weight of vehicle and load on any street not defined or designated as a heavy traffic route under Subsection A exceed the limitations pertaining to Class "A" highways or deliveries on Class "B" highways established by the Wisconsin Statutes.

A.
Parking, stopping or standing prohibited.
(1)
No person shall at any time park any vehicle at:
(a)
The south curbline of Van Buren Street between
Water Street and Madison Street.
(b)
The west curbline of Madison Street between
the north curbline of Polk Street and the south curbline of Washington
Avenue.
(c)
The south side of Oak Street from a point lying
70 feet west of the west line of Helen Street to a point lying 85
feet east of the east line of Washington Street.

(2)
There shall be no parking, stopping or standing at:
(a)
The west curbline of Madison Street between
the south curbline of Van Buren Street and the north curbline of Phillips
Boulevard.
(b)
The west curbline of Madison Street between
the north curbline of Van Buren Street and the south curbline of Polk
Street.
(c)
Along the north curbline of Van Buren Street,
between the east curbline of Monroe Street and the west curbline of
Madison Street.
(d)
The south curbline of Jackson Street, for a
distance of 44 feet east of the east curbline of Water Street.
(e)
The west curbline of Water Street between the
north corporate limits of the Village and a point 125 feet to the
south.
(3)
No person shall at any time park any vehicle at the
intersection of US Highway 12 and Madison Street, as follows:
(a)
Madison Street: 100 feet, north approach, east
side; 100 feet, north approach, west side; 100 feet, south approach,
east side; 100 feet, south approach, west side.

(4)
No person shall at any time park, stop or stand on
either the north or south side of Phillips Boulevard between Water
Street and Lueders Road.
(5)
No person shall park, stop or stand on either side
of Water Street from Van Buren Street to Phillips Boulevard between
the hours of 3:00 a.m. and 6:00 a.m.; no person shall park, stop or
stand on either side of Water Street from Phillips Boulevard to Carolina
Street between the hours of 3:00 a.m. and 6:00 a.m.
(6)
Fire Department personnel are exempt from the above
parking restrictions during fire emergencies.
(7)
Fifteen-minute parking. As posted on the east side
of Water Street between Phillips Boulevard and Jackson Street, no
person shall park for more than fifteen minutes in the parking stall
in front of 830 Water Street.

B.
Trucks. No person shall park any truck tractor, trailer,
or tractor-semitrailer combination as such terms are defined in § 340.01(73),
(71) and (67r), Wis. Stats., at any time on any street, road, boulevard,
avenue, lane, alley, or other thoroughfare within the limits of the
Village of Sauk City.
C.
Limited parking. When signs are erected in any block
giving notice thereof, no person shall park a vehicle for longer than
the periods specified in this subsection at any time between the hours
of 8:00 a.m. and 6:00 p.m., and except Sundays and the following holidays:
New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving
and Christmas, upon the following streets or portions of streets:
(3)
Twenty-four-hour parking limit:
(a)
All of spaces in the municipal parking lot in
Block 24 of the original plat of the Village, the same being bounded
by Phillips Boulevard, Water Street, Jackson Street and John Adams
Street.
(b)
All of the spaces along the east curbline of
Riviera Drive located in Blocks 25 and 26 of the original plat of
the Village.
(4)
School zones.
(a)
On school days between the hours of 7:30 a.m.
and 3:30 p.m., no person shall park on the south side of Oak Street
between Maple Street and Spruce Street and as marked in front of St.
Aloysius School and on the north side of Polk Street between Jefferson
Street and John Adams Street.
(b)
On school days between the hours of 8:30 a.m.
and 4:30 p.m., no person shall park for more than one hour on either
side of Maple Street and Spruce Street from the south curbline of
Oak Street for a distance of 580 feet to the south.[1]

(5)
Emergency personnel only. On weekdays between the
hours of 6:00 a.m. and 6:00 p.m. no person shall park on the east
side of Washington Street from the south curbline of Oak Street for
a distance of 200 feet to the south.
(6)
Compact cars only. As posted, the following parking
spaces shall be used only for the parking of compact cars: the northerly
three parking spaces on the east side of Water Street between Jackson
Street and Van Buren Street and the southerly three parking spaces
on the east side of Riviera Drive between Jackson Street and Van Buren
Street.
(7)
Post office. As posted on the west side of Water Street
between Jackson Street and Van Buren Street, no person shall park
for more than five minutes in the parking stall in front of the post
office.
D.
Additional parking restrictions.
(1)
No person shall park or stand any vehicle for a period
of time longer than 24 consecutive hours on any street, alley, parking
lot or parking area in the Village from 12:00 midnight Monday through
12:00 midnight Saturday except on weekdays observed by the Village
as holidays.

(2)
It is unlawful for the operator of any vehicle to
park such vehicle in any space appropriately marked for "No Parking"
as so designed officially.
(3)
No person shall stand or park a vehicle on any street
or alley in the Village for the purpose of repairing such vehicle
or for storage purposes.
(4)
No person shall park any car with trailer attached
or any vehicle longer than 20 feet on any street where angle parking
is so provided and allowed.
(5)
No person shall park any vehicle or other piece of
equipment on any tree bank in the Village, except in such areas where
stand-up curbing does not exist. No person shall park any vehicle
or other piece of equipment on any sidewalk, or on any portion of
the street right-of-way that has been designated as sidewalk area,
in the Village.
(6)
No person shall park any vehicle or other piece of
equipment directly in front of or within 15 feet in either direction
of a mailbox. This restriction shall apply from 8:00 a.m. through
3:00 p.m., Mondays through Saturdays.
(8)
Physically disabled parking. Except for vehicles displaying
special registration plates or cards issued under Wis. Stats. § 341.14(1),
(1a), (1m), (1q), or (1r)(a) or § 343.52, as may be amended,
which designates the vehicle as being used by a physically disabled
person, or vehicles similarly registered from another jurisdiction
and displaying the required plate, card or emblem, no person shall
park, stop or leave standing any vehicle or other piece of equipment,
whether attended or unattended and whether temporarily or otherwise,
upon any portion of the following Village locations:

(a)
The south side of Oak Street, starting at the
intersection of Washington Street and Oak Street and continuing east
on Oak Street for the first four parking stalls.
(b)
Any other Village street, road, highway or parking
facility posted with a standard uniform traffic control sign, signal
or marking prohibiting parking by vehicles other than those described
above.
E.
Angle parking. All vehicles shall be parked parallel
to the curb except on such streets where angle parking spaces are
so designated and so provided by appropriate markings.
F.
Signage authority. The Public Works and Utility Director
is hereby authorized to erect such signs as are in conformity with
the rules promulgated by the Department of Transportation governing
the design, size and installation of the official traffic signs.
G.
Parking map. The Village Clerk shall maintain on file at the Village
Hall a map entitled "Village of Sauk City Parking Map" showing the
parking restrictions set forth in this section, as may be amended.

Except as provided in Subsection C of this section,
whenever there shall be an accumulation of snow not less than two
inches during a twenty-four-hour period and such accumulation hinders
the safe movement of traffic or impedes the ability of an emergency
vehicle or public transportation vehicle to travel safely and expeditiously
over the streets and highways of the Village, there shall then exist
a snow emergency and the following restrictions shall go into effect.
A.
Emergency snow parking regulations shall mean that
no person shall park on any public street or highway in the Village
of Sauk City during any such snow emergency condition as described
above, immediately following or during such emergency. Such emergency
regulation shall continue in effect for 48 hours after the snow has
ceased to fall, or until such time as the snow has been removed from
the streets or highways within said Village.
B.
For the purpose of this section, "parking" is defined
to mean leaving a vehicle or permitting it to remain unattended but
shall not include the following vehicles:
(1)
A vehicle by a doctor making a house call.
(2)
Business vehicles being used for temporary deliveries
or temporary pickups during these hours.
(3)
Police, fire or other emergency vehicles.
(4)
A vehicle holding a valid permit issued by the Village
Administrator after approval of the Village Board for a handicapped
person.
(5)
A vehicle holding a valid permit issued by the Village
Administrator after approval of the Village Board for extreme hardship
cases.
C.
Whenever an emergency snow removal condition exists
as defined within this section, the following parking restrictions
shall apply to the area so designated:
(1)
Water Street. On Water Street, between Jefferson Street
and Carolina Street, there shall be alternate-side parking, with parking
permitted on the odd-numbered side of the street on odd-numbered days
and parking permitted on the even-numbered side of the street on even-numbered
days. The status of the days, as to whether they are even or odd,
shall be determined as of 12:01 a.m. that day.

(2)
Sycamore Street - Industrial Park. On the east side
of Sycamore Street, between Carolina Street and Industry Road, trucks
having a gross weight of 6,000 pounds or more shall be permitted to
park during any such snow emergency from 6:00 p.m. to 9:00 a.m. the
following day.
D.
The Village Public Works and Utility Director is hereby
instructed to secure and have posted on all county trunk highways
and state highways leading into the Village of Sauk City a sign giving
notice to the effect that the Village of Sauk City has an emergency
snow ordinance.
Any person owning or having control of any truck,
truck power unit, tractor, trailer, semitrailer, or bus in excess
of 10,000 pounds' gross weight, or having a length over 16 feet in
length, except for pickup trucks, in which case, having a length in
excess of 21 feet, or having an enclosed area of a height of more
than eight feet from the roadway, is prohibited from driving on Business
Drive, located south of Phillips Boulevard, in Sauk City.
A.
Hazard to public safety. Any vehicle parked, stopped
or standing upon a highway in violation of any of the provisions of
this chapter is declared to be a hazard to traffic and public safety.
B.
Removal by operator. Such vehicle shall be removed
by the operator in charge, upon request of any traffic officer, to
a position where parking is permitted or to a private or public parking
or storage premises.
C.
Removal by traffic officer. Any traffic officer, after
issuing a citation for illegal parking, stopping or standing of an
unattended vehicle in violation of this chapter, is authorized to
remove such vehicle to a position where parking is permitted.
D.
Removal by private service. The officer may order
a motor carrier holding a permit to perform vehicle towing services,
a licensed motor vehicle salvage dealer or a licensed motor vehicle
dealer which performs vehicle towing services to remove and store
such vehicle in any public storage garage or rental parking grounds
or any facility of the person providing the towing services.
E.
Towing and storage charges. In addition to other penalties
provided in this chapter, the owner or operator of a vehicle so removed
shall pay reasonable costs of moving, towing and storage. If the vehicle
is towed or stored by a private motor carrier, motor vehicle salvage
dealer or licensed motor vehicle dealer, actual charges regularly
paid for such services shall be paid. If the vehicle is stored in
a public storage garage or rental facility, customary charges for
such storage shall be paid. Upon payment, a receipt shall be issued
to the owner of the vehicle for the towing or storage charge.
A.
Purpose. The development and execution of this section
are based upon the problems associated with the collection of forfeitures
for moving and nonmoving violations. Furthermore, the policies, goals
and objectives of the Village relating to moving and nonmoving violations
have not been effectively communicated to these operators. The Village
Board, after studying the various problems and considering possible
solutions, hereby finds that a traffic violation and registration
program would best suit the needs of the Village.
B.
Participation. The Village of Sauk City shall participate
in the Wisconsin Department of Transportation Traffic Violation and
Registration Program as set forth in § 345.28, Wis. Stats.,
and Ch. Trans 128, Wis. Adm. Code, and all amendments or changes thereto.
C.
Designation and authority. The Sauk Prairie Police
Department is hereby designated as a delegated authority for purposes
of §§ 85.13 and 345.28, Wis. Stats., and Ch. Trans
128, Wis. Adm. Code.
(1)
The Sauk Prairie Police Department is authorized to
perform, on behalf of the Village of Sauk City, all functions required
of a local authority under said statutes and code, including but not
limited to:
(a)
Prepare and complete all forms and notices,
notifying the Wisconsin Department of Transportation of unpaid citations
for nonmoving traffic violations.
(b)
Specify whether the registration of vehicles
involved in unpaid citations for nonmoving traffic violations should
be suspended and/or whether registration should be refused for any
vehicle owned by persons with unpaid citations for nonmoving traffic
violations.
(c)
Determine the method by which the Village of
Sauk City will pay the Wisconsin Department of Transportation for
administration of the program and establishing the effective date
for participation.
(d)
Take such other action as is necessary to institute
and continue participation in the Wisconsin Department of Transportation
Traffic Violation and Registration Program.
(2)
The Chief of Police is hereby authorized to assign
a member of the Sauk Prairie Police Department to perform such acts
as are necessary to effectuate this section.
D.
Program costs.
(1)
In addition to all applicable fines and court costs,
the cost of using the Wisconsin Department of Transportation Traffic
Violation and Registration Program shall be assessed as permitted
by § 345.28(4)(d), Wis. Stats. The Sauk Prairie Police Department
may refuse to notify the Wisconsin Department of Transportation of
payment of a citation until all applicable fines and costs, including
costs assessed under this section, are paid.
(2)
This section shall not be interpreted as requiring
all unpaid citations for nonmoving traffic violations be processed
through the Wisconsin Department of Transportation Traffic Violation
and Registration Program. The Village of Sauk City's participation
in such program shall be in addition to any and all other means legally
available to enforce such citations.
E.
Requirements. The Sauk Prairie Police Department shall
follow the following procedures in issuing nonmoving violations:
(1)
Issue citation. A notice of the violation should be
left on the parked vehicle.
(2)
Two warning notices of an unpaid citation must be
sent to the owner of the vehicle within a twenty-eight-day period
from the violation, which should include the date the citation was
issued; the license number of the vehicle involved; the place the
citation may be paid; the means by which the citation must be paid
or contested to avoid further action; and the action which will be
taken by the Sauk Prairie Police Department should the operator fail
to respond.
(3)
In the event no action is taken by the operator, the
Sauk Prairie Police Department shall direct such violation to the
Wisconsin Department of Transportation Traffic Violation and Registration
Program, indicating how the Sauk Prairie Police Department wishes
to proceed. The following actions may be directed to the Wisconsin
Department of Transportation Traffic Violation and Registration Program:
A.
Erection and maintenance. The Public Works and Utility
Director is authorized and directed to procure, erect and maintain
appropriate standard traffic signs, signals and markings conforming
to the rules of the State Highway Division giving such notice of the
provisions of this chapter as required by state law. Signs shall be
erected in such locations and manner as the Village Board shall determine
will best effect the purposes of this chapter and give adequate warning
to users of the streets or highways.
B.
Removal of unofficial signs or signals. The Public
Works and Utility Director shall have the authority granted by § 349.09,
Wis. Stats., and is directed to order the removal of a sign, signal,
marking or device placed, maintained, or displayed in violation of
this chapter or § 346.41, Wis. Stats. Any charge imposed
on a premises for removal of such an illegal sign, signal, or device
shall be reported to the Village Board at its next regular meeting
for review and certification.

A.
Purpose and authority. This section is adopted pursuant
to the authority set forth in Wisconsin Statutes § 349.26
and adopted for the protection of the public health, benefit and welfare
of the Village.
B.
Neighborhood electric vehicles permitted.
(1)
Definition and requirements.
(a)
"Neighborhood electric vehicle" (NEV) means
a self-propelled motor vehicle that has successfully completed the
Neighborhood Electric Vehicle America test program conducted by the
federal Department of Energy, and that conforms to the definition
and requirements for low-speed vehicles as adopted in the Federal
Motor Vehicle Safety Standards for low-speed vehicles under 49 CFR
571.3(b) and 571.500. NEV does not include an electric golf cart.
(b)
NEVs shall be four-wheeled and have a speed
range of at least 20 miles per hour and not more than 35 miles per
hour on a paved surface and have a gross vehicle weight at rest of
less than 2,500 pounds.

(c)
All NEVs shall be equipped with the following:

Headlamps.

Front and rear turn signals.
[3]
Stop lamps.
[4]
Reflex reflectors: one red on each side as far
to the rear as practicable, and one red on the rear (three total).
[5]
An exterior mirror mounted on the passenger
side or an interior rearview mirror.
[6]
Parking brakes.
[7]
A windshield that conforms to the requirements
of the Federal Motor Vehicle Safety Standard on glazing materials
(49 CFR 571.205).
[8]
A vehicle identification number that complies
with federal law (49 CFR 565).
[9]
A Type 1 or Type 2 seatbelt assembly conforming
to 49 CFR 571.209 and Federal Motor Vehicle Safety Standard No. 209,
for each designated seating position.

Permitted users. To use an NEV on Village streets meeting the criteria set forth in Subsection B(1) above, the individual driver must have a valid Wisconsin driver's license.
(3)
Permitted use on Village streets. Any driver meeting the requirements of Subsection B(2) above may operate a licensed NEV on Village of Sauk City streets having a posted speed limit of 35 miles per hour or less. The holder of this license shall also be permitted to operate within the Village of Prairie du Sac. Headlamps must be on at all times during operation on Village streets.

Compliance with traffic laws. NEVs shall comply with all state and local traffic laws, including but not limited to Chapter 317 of the Sauk City Village Code, and owners and operators of NEVs shall be subject to citations and forfeitures for any such violation.
(5)
License requirements; fee.
(a)
Neighborhood electric vehicles shall be licensed
by the Village, and the license shall be issued to the owner of the
vehicle. The licenses shall be issued by the Sauk City Village Administrator
or designee.

(b)
Owners shall complete a license application
prior to issuance of a license, which application shall be provided
by the Village Administrator, or designee.

(c)
Fees for licenses issued under this section
shall be set by the Village Board as part of the Village fee schedule.

(d)
The license shall only be issued following inspection of the vehicle by the Village Administrator, or designee, for compliance with the provisions set forth in Subsection B(1) above. The Village Administrator may require a manufacturer's certification indicating compliance with such provisions.
(e)
Prior to obtaining a license, the applicant
must furnish proof of insurance for the NEV and a current valid driver's
license.
(f)
The license shall be displayed on the rear of
the NEV.
A.
Generally. The provisions of this chapter shall be
enforced in accordance with the provisions of §§ 345.20
through 345.53, Ch. 799 and § 66.0114, Wis. Stats.
B.
Uniform citations. The uniform citations promulgated
under § 345.11, Wis. Stats., shall be used for all moving
traffic violations under this chapter.
C.
Parking citations. Citations for all nonmoving traffic
violations under the provisions of this chapter shall conform to § 345.28,
Wis. Stats., and shall permit direct mail payment of the applicable
minimum forfeiture to the Police Department within seven days of the
issuance of the citation in lieu of court appearance. The issuing
officer shall specify thereon the amount of the applicable forfeiture
as provided in this chapter.

D.
Notice of demerit points and receipt. Every officer
accepting a forfeited penalty or money deposit under this chapter
shall receipt therefor in triplicate as provided in § 345.26(3)(b),
Wis. Stats. Every officer accepting a stipulation under the provisions
of this chapter shall comply with the provisions of §§ 343.28,
345.26(1)(a) and 345.27(2), Wis. Stats., and shall require the alleged
violator to sign a statement of notice in substantially the form contained
on the uniform citation and complaint promulgated under § 345.11,
Wis. Stats.
E.
Forfeitures in treasury. Any officer accepting deposits
or forfeited penalties under the provisions of this chapter shall
deliver them to the Chief of Police within 24 hours.[1]

A.
Forfeiture penalty. The penalty for violation of any provision of
this chapter shall be a forfeiture as provided in this section, together
with court costs and fees prescribed by §§ 814.63(1)
and (2), or 814.65(1), Wis. Stats., and if applicable, the penalty
surcharge imposed by § 757.05, Wis. Stats., the driver improvement
surcharge imposed by § 364.655, Wis. Stats., and the safe
ride programs surcharge imposed by § 346.657, Wis. Stats.
Any person 18 years of age or older who shall fail to pay the amount
of the forfeiture, court costs, or any applicable surcharge or penalty
imposed for violation of this chapter may be imprisoned until such
amounts are paid, but not to exceed 90 days, upon order of the court
entering judgment and having jurisdiction of the case.
B.
Other sanctions.
(1)
By court. Nothing herein shall preclude or effect the power of the
sentencing court to exercise additional authorities granted by the
Wisconsin Statutes to suspend of revoke the operating privileges of
the defendant, order the defendant to submit to assessment and rehabilitation
programs, or to attend traffic safety school in addition to payment
of a monetary penalty or in lieu of imprisonment.
(2)
By municipality. No person who has been convicted of a violation
of any provision of this chapter shall be issued a license or permit
by the Village Administrator, except a dog license, until the forfeiture,
court costs, and any applicable surcharges or penalties for such violation
is paid.
C.
Forfeitures for violation of moving traffic regulations.
(1)
Forfeitures for violations of any moving traffic regulations set forth in the Wisconsin Statutes and adopted by reference in § 317-1 shall conform to the forfeiture penalty permitted to be imposed for violations of the comparable Wisconsin Statute, including any variations or increases for subsequent offenses; provided, however, that this subsection shall not be construed to permit prosecution under this chapter for any offense described in Chapters 341 through 348, Wis. Stats., for which an imprisonment penalty may be imposed upon the defendant.
D.
Forfeitures for parking violations.
(1)
Forfeitures for uniform statewide parking, stopping and standing offenses. Forfeitures for violation of nonmoving traffic violations adopted by reference in § 317-1 as described in Chapters 341 to 348, Wis. Stats., shall be as provided for the comparable state nonmoving traffic violation as set forth in the State Uniform Traffic Deposit Schedule, as amended or revised.
(2)
Forfeitures for parking violations during snow emergencies. Forfeitures for violations of § 317-8 shall be $40.
(3)
Forfeitures for other parking violations. The penalty for any other parking violation not included under Subsection D(1) or (2) above shall be a forfeiture of not less than $20 and not more than $50 for the first offense, and for any subsequent offence within one year shall be forfeiture of not less than $30 and not more than $100.
E.
Other violations. The forfeiture for any violation not otherwise
established by this section shall be not less than $10 and not more
than $200.
