A. 
Doña Ana County is required to provide for the temporary detention of juvenile offenders; and
B. 
The Board of County Commissioners of Doña Ana County, New Mexico wishes to seek reimbursement from the parents, guardians or legal custodians of juveniles so detained for money expended for the care, support and ancillary service provided to such child pursuant to NMSA § 4-36-9(A) and (B).
The child support guidelines set forth in NMSA § 40-4-11.1 shall be used for the purpose of determining the payment owed by a parent, guardian or legal custodian for the care, support and provision of ancillary service to juveniles held in the Doña Ana County Juvenile Detention Center.
When a parent, guardian or legal custodian refuses or fails to reimburse the County for expenses incurred pursuant to NMSA § 4-36-9(A) or (B), the Board of County Commissioners may cause a civil action to be brought against the parent, guardian or legal custodian to recover the amount of money owed to the County.
