This chapter shall be known as the "Ordinance for the Regulation of Vehicles, as Amended."
To regulate the operation of all vehicles in the public ways and on publicly owned property within the Town of Madison.
As used in this chapter, the following terms shall have the meanings indicated:
CROSSWALK
A. 
That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured for the curbs, or in the absence of curbs, from the edge of traversable roadways; or
B. 
Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.
CURB
The outer edge of a defined sidewalk or either edge of the wrought or usually traveled part of a way.
DRIVEWAY
That portion of the roadway used by an individual or business for purposes of barrier-free access onto their property. Barriers shall include but are not limited to curbing, severe slope, walls and/or fencing.
INTERSECTION
The area embraced within the prolongation or connection of the lateral curblines of the roadways of two highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict.
PARKING
The stopping or standing of motor vehicles on a roadway whether occupied or unoccupied, attended or unattended, otherwise than for the purpose of loading or unloading passengers and/or merchandise or in obedience to police officers or traffic regulations, signs or signals, or while making emergency repairs if disabled, while arrangements are being made to move such vehicle.

PERSON
Any individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity.
PUBLIC PROPERTY
Includes parking lots, cemeteries, parks, sidewalks and land leased by the Town.
SNOW EMERGENCIES
A time designated by the Road Commissioner during which special parking restrictions are put into effect for the purpose of plowing and removing snow.
STOP or STOPPING
When prohibited, means halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device.
VEHICLE
Includes all kinds of conveyances on ways for persons and for property, except those propelled or drawn by human power.
WAY
Includes all lands of public ways including Town ways, state aid roads, and state highways.
It shall be unlawful for the operator of any motor vehicle to park the same on the following designated ways or areas:
Beach Road
There will be no parking on the northerly side of Beach Road, beginning at the intersection of Route 201; thence commencing in an easterly direction to the shore of Wesserunsett Lake.
Grange Road
There will be no parking on the northwest side of the Grange Road, beginning at the intersection of the East Madison Road; thence commencing in a southwesterly direction to the shore of Wesserunsett Lake.
There will be no parking on the southeast side of the Grange Road, beginning at the shore of Wesserunsett Lake; thence commencing in a northeasterly direction for a distance of approximately 220 feet.[1]
Kennebec Street
There will be no parking on either side of Kennebec Street from the west side of the intersection with Old Point Avenue, to the west side of the intersection with Pine Street.
Madison Avenue
On the east side of the road, beginning at the southerly corner of the intersection of Main Street and Madison Avenue; thence commencing northerly to the southerly side of the driveway of One Madison Avenue.
From 6:00 a.m. to 6:00 p.m. on the west side of Madison Avenue; beginning at the northerly corner of the intersection of Main Street and Madison Avenue; thence commencing in a northerly direction a distance of 90 feet.
Main Street
On the north side of the road from the easterly side of the driveway of the Maplecrest Nursing Home; thence commencing easterly to the west side of the easterly most driveway of Skowhegan Savings Bank.[2]
On the north side of the road from the westerly side of the driveway of Dunkin Donuts; thence commencing westerly 50 feet.

From 6:00 a.m. to 6:00 p.m. on the north side of the road, beginning at the westerly corner of the intersection of Main Street and North Street; thence commencing westerly to a point 20 feet therefrom.
From 6:00 a.m. to 6:00 p.m. on the north side of the road, beginning at the easterly corner of the intersection of Main Street and North Street; thence commencing easterly to the westerly side of the driveway of No. 220 Main Street.
It shall be unlawful for the operator of any motor vehicle to stop or park said motor vehicle from 6:00 a.m. to 6:00 p.m. on the north side of Main Street, beginning at the westerly side of the intersection of the driveway for the Skowhegan Savings Bank; thence commencing easterly a distance of approximately 200 feet to the easterly side of the driveway at 200 Main Street.

On the north side of the road beginning at the westerly corner of the intersection of Main Street and what was once known as Water Street and then commencing westerly to the Anson/Madison Town line.
On the south side of the road from the Anson/Madison Town line easterly a distance of approximately 285 feet.

It shall be unlawful for the operator of any motor vehicle to stop or park said motor vehicle from 6:00 a.m. to 6:00 p.m. on the south side of Main Street, beginning at the easterly corner of Nichols Street; thence commencing in an easterly direction a distance of approximately 75 feet.

It shall be unlawful for the operator of any motor vehicle to stop or park said motor vehicle from 6:00 a.m. to 6:00 p.m. on the south side of Main Street, beginning at the westerly corner of Nichols Street; thence commencing in a westerly direction a distance of approximately 75 feet.

Maple Street
On the east side of Maple Street from the north side of the intersection of Maple Street and Main Street; thence commencing in a northerly direction to the northern most property line of The Bangor Savings Bank.
On the west side of Maple Street from the south side of the intersection of Maple Street and Main Street; thence commencing in a southerly direction to the southeastern most corner of Camden National Bank.

On the west side of the road from the west corner of the intersection of North Street and Main Street; thence commencing northerly to the southwest corner of the intersection of North Street and Heald Street.
Old Point Avenue
On the east side of the road from the north corner of Pleasant Street; thence commencing northerly to the southernmost corner of the intersection of Main Street.

On the north side of the road from the easterly side of the driveway of the VFW Post No. 7865; thence commencing easterly to the easternmost side of the second entrance to the Recreation Ball Fields.

On the north side of Route No. 148 starting at the westernmost point of the driveway at 450 Main Street to the easternmost point of the driveway at 504 Main Street, a total of approximately 1,320 feet.

On the west side of the road from the northwesternmost corner of the intersection of Weston Avenue and Main Street; thence commencing northerly to a point one-foot north of the southernmost point of Clark Court (the drive which runs around the Post Office property).

It shall be unlawful for the operator of any motor vehicle to park the same for more than two hours on the following ways:
A. 
Weston Avenue.
(1) 
During the hours of 6:00 a.m. to 6:00 p.m. on the east side of the road from a point 135 feet from the northeast corner of the intersection of Weston Avenue and Main Street; thence commencing northerly to the south corner of the intersection of Weston Avenue and Heald Street. This section of this chapter shall not apply during snow emergencies.
B. 
Main Street.
(1) 
During the hours of 8:00 a.m. to 8:00 p.m. Monday through Saturday, on both sides of the road from its intersection of Old Point Avenue and Weston Avenue; thence commencing westerly to the Anson/Madison Town line, excepting all areas described in this chapter under § 399-4.

C. 
Municipal Parking Lot, South Maple Street.
(1) 
During the hours of 8:00 a.m. to 8:00 p.m., parking spaces numbered 1 through 55, as shown on the plan for Municipal Parking Lot, South Maple Street, dated August 1990.

It shall be unlawful for the operator of any vehicle to park the same on any way within the Town for a period of time longer than 30 minutes between the hours of 12:00 midnight and 6:00 a.m. from the first day of November in any year to the first day of April in the following year.
It shall be unlawful for the operator of a motor vehicle to park in such a manner as to block the flow of other vehicles in a line of traffic except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic signs.

With the exception of emergency vehicles, it shall be unlawful for an operator of a motor vehicle to change lanes for the purpose of changing the direction of said vehicle from whence it is headed to the opposite direction. The above restriction applies to the following areas:
A. 
Main Street.
(1) 
Beginning at Garden Street and thence commencing in a westerly direction to the Madison-Anson Town line.
B. 
Weston Avenue.
(1) 
Beginning at the intersection of Weston Avenue and Main Street and thence commencing in a northerly direction to the intersection of Weston Avenue and Park Street.
C. 
Old Point Avenue.
(1) 
Beginning at the intersection of Old Point Avenue and Main Street and thence commencing in a southerly direction to the intersection of Old Point Avenue and Kennebec Street.

Except when necessary in obedience to traffic regulations or traffic signs or signals, the operator of a motor vehicle shall not park said motor vehicle along Main Street other than parallel with the curb or edge of the roadway, headed in the direction of traffic, with the motor vehicle within six inches of the curb or edge of such roadway and with a clear space of three feet left ahead and behind the same except where diagonal parking is provided. Where diagonal parking is permitted, motor vehicles shall park so as to be entirely within the marked-off or painted area.

It shall be unlawful for an operator of a motor vehicle to park in a handicap parking space, which vehicle does not bear a special registration place or placard issued under 29-A M.R.S.A. § 521, or similar plate issued by another state.
Double parking on any way is prohibited at all times except in cases of vehicle loading and unloading when the vehicle is unable to park next to the curb due to the presence of a second vehicles.
It shall be unlawful for any person or corporation engaged in the garage, repair or automobile service business to park any motor vehicle in a street or highway for the purposes of assembling, dismantling or repairing any vehicle.
A. 
It shall be unlawful for an operator of a noncommercial motor vehicle to park within the following designated areas:
(1) 
Madison Avenue.
(a) 
From 6:00 a.m. to 6:00 p.m. on the west side of Madison Avenue; beginning at the northerly corner of the intersection of Main Street and Madison Avenue; thence commencing in a northerly direction a distance of 90 feet.[1]

B. 
Commercial operators may use these areas for loading and unloading of merchandise only. No commercial vehicle shall be permitted to park more than two hours or overnight in said areas.

It shall be unlawful for an operator of a motor vehicle to park within a distance of 15 feet from any corner of an intersection in Town. It shall be unlawful for an operator of a motor vehicle to park said vehicle within a distance of 15 feet from a hydrant. It shall be unlawful for an operator of a motor vehicle to park in front of all driveway entrances, and 10 feet to either side.
It shall be unlawful for an operator of a motor vehicle to park the same or a portion of the same on a sidewalk, crosswalk or within an intersection.

Local law enforcement may cause any motor vehicle parked in violation of this chapter to be removed at the expense of the owner of the vehicle. This section may be enforced in addition to other penalty provisions provided hereinafter.

In an emergency, law enforcement, the Fire Chief and/or the Road Commissioner may impose a parking ban on designated streets or may waive the prohibition of parking on designated streets on a temporary basis. The Selectmen may prohibit parking on a designated street or may waive the prohibition of parking on designated streets for a period not to exceed three months. For details on road postings and seasonal closings see the Roads and Highways Ordinance (Chapter 694).

It shall be unlawful for an operator of a motor vehicle to enter the limits of an intersection designated as a "yield intersection" without first yielding the right-of-way to all vehicles and pedestrians approaching from either direction.
The operator of a motor vehicle facing a traffic control signal exhibiting the word "Stop" or the color "red" shall bring his vehicle to a complete stop, and shall not proceed until said traffic control signal exhibits the word "Go" or the color "green" except when directed otherwise by state law or by a police officer. It shall be unlawful for the operator of a motor vehicle to drive in a northerly direction on the alleyway from the Municipal Parking Lot behind R.H. Renys at the rear of buildings towards Main Street.

A. 
A person who violates any provision of this chapter may be subject to having the vehicle removed in accordance with § 399-20.
B. 
Local law enforcement will enforce the terms, conditions and fines clearly marked on signage at or near a location where parking is prohibited in part or entirely.
C. 
Parking fines are set at the discretion of the Madison Select Board.
If a vehicle is unlawfully parked in violation of the provision of this chapter, this shall be prima facie evidence of the unlawful parking of such vehicle by the person in whose name such vehicle is registered.

In the event of a dispute over enforcement of the provisions of this chapter, the Town Manager or their designee shall serve as arbitrator for contested cases.
