A. 
This chapter is intended to provide a framework for municipal review of subdivisions in accordance with 30-A M.R.S.A. § 4401 et seq.
B. 
All subdivisions as defined by state law, M.R.S.A. 30-A § 4401(4), shall by reviewed and approved by the Town of Madison prior to development or sale of lots or dwelling units. This applies to all divisions of land and all divisions of buildings, except as provided below:
(1) 
Subdivision review of multifamily dwellings (as defined) and all accessory structures to same, whether attached or detached, will defer to review of the development under Chapter 484 of the Madison Code of Ordinances (Site Review);
(2) 
No lot exceeding 40 acres shall be counted as a subdivision lot for review purposes; and
(3) 
Additional conditions and exceptions within 30-A M.R.S.A. § 4401(4).
A. 
This chapter shall be administered by the Code Enforcement Officer and the Planning Board. All applications for subdivision review shall be submitted to the Code Enforcement Officer.
B. 
The Madison Planning Board is responsible for reviewing and approving applications for subdivision review under this chapter. The Planning Board shall decide if:
(1) 
A proposed development requires subdivision review under § 490-1B of this chapter.
(2) 
A subdivision application is, in fact, complete, and if not, what additional items or information must be submitted.
(3) 
A subdivision application shall be approved or denied.
(4) 
Amendments or changes to an existing approved subdivision must be reviewed under § 490-7 of this chapter.
(5) 
The applicant is exempt from review.
A. 
No person may sell, lease, develop, build upon, or convey for consideration, or offer or agree to sell, lease, build upon or convey for consideration any land or dwelling unit in a subdivision within the Town of Madison that has not been approved by the Town of Madison Planning Board.
B. 
The Code Enforcement Officer shall not issue a permit for building or use within a land subdivision unless the subdivision has been approved by the Town of Madison Planning Board.
