Pursuant to the certification of the need and
estimated cost by the Doña Ana County Flood Commissioner and
NMSA § 4-50-2, the Board of Commissioners shall and hereby
does levy an annual tax at a rate of $1.50, or any lower maximum amount
required by operation of the rate limitation provisions of NMSA § 7-37-7.1,
upon a tax imposed under NMSA § 4-50-2, on each $1,000 of
net taxable value, as that term is defined in the Property Tax Code
(Articles 35 to 38 of Chapter 7, NMSA), of all the taxable property
within Doña Ana County, outside the city limits of the City
of Las Cruces, and located within five miles of both sides of any
river or stream which contributes to or is subject to flood conditions
destructive to property or dangerous to human life and that such taxable
property shall be designated as the "Lower Rio Grande and Hueco Flood
Districts."[1]

The Lower Rio Grande Flood District shall include
all lands within the following described sections and land grants
except for those lands within the city limits of the City of Las Cruces
which are set forth in the map of the city limits of the City of Las
Cruces:

Pursuant to the authority contained in NMSA
§ 4-50-2, the Doña Ana County Assessor is hereby
directed to annually assess a tax at a rate of $1.50, or any lower
maximum amount required by operation of the rate limitation provisions
of NMSA § 7-37-7.1, upon a tax imposed under NMSA § 4-50-2,
on each $1,000 of net taxable value, as that term is defined in the
Property Tax Code (Articles 35 to 38 of Chapter 7, NMSA), on all the
herein-described taxable property located within five miles of both
sides of any river or stream which contributes to or is subject to
flood conditions destructive to property or dangerous to human life,
and that the Doña Ana County Treasurer is hereby directed to
collect such tax. Such tax shall be assessed, levied and collected
as other taxes are collected, and when so collected shall be known
as the "County flood fund," and such fund shall be maintained in such
a manner as to keep separate records of all flood control taxes collected
from each stream or river drainage area. The taxes collected shall
only be used and disbursed for flood control projects in the drainage
area for which they were assessed in accordance with the provisions
of NMSA §§ 4-50-1 through 4-50-9, and shall not be
transferred to any other fund or purpose.
