The Commission, after its deliberations, shall
act on each application by approval, denial, or tabling. The Commission
must take action by approval, denial, or tabling of said application
within 65 days of the date of application. Failure to act within 65
days of the date of receipt of application shall constitute approval.
A.
If the Commission approves the application, a Certificate
of Appropriateness shall be issued.
B.
The Certificate may contain additional stipulations
clarifying time of completion, or identifying types of materials.
A copy of the Certificate shall be mailed to the applicant. Additional
copies shall be distributed to the Building Inspector for his file,
and the Borough Clerk. A copy, along with the original application
and attachments, shall be maintained in the Commission's file.
C.
Certificates shall be valid for a period of six months
from the date of issue. Renewals may be granted upon request from
the Certificate holder.
D.
Approved Certificates, where the approved work has
not been started or completed, shall be withdrawn upon the transfer
of property ownership. The Certificate may be reinstated by the Commission
without a public hearing based upon a written request from the new
owner and provided no change in the nature of the request in involved.
A.
A Certificate of Appropriateness may be denied by
the Commission when, in the opinion of the Commission, the issuance
of such a Certificate would be detrimental to the interest of the
historic district.
B.
Written notice of the denial shall be sent to the
applicant and the Building Inspector. The notice shall state the specific
reason(s) for denying the application.
The Commission, in its discretion, may table
action on any application before it until the next regular meeting
or special meeting of the Commission, at which time the application
shall be approved or denied.
A.
The Commission may institute action in Superior Court
to prevent the violation of any action taken or ruling made as described
herein, in accordance with Section 7-147h of the Connecticut General
Statutes of the State of Connecticut.
B.
Regulations and orders of the Commission shall be
enforced by lawful officials of the Borough, Borough enforcement officers,
including the Building Inspector, who shall require in writing the
remedying of any condition that is found to be in violation.
C.
Fines shall be collected and used in accordance with
applicable State Statutes.
