It is hereby ascertained, determined, and declared that:
A.
Section 125.01(1)(q) of the Florida Statutes provides
legislative authorization for the governing body of a county to establish
a municipal service unit for all or any part of the unincorporated area within
its boundaries, or within the municipal boundaries of an incorporated area
upon consent of the governing body of the affected municipality, within which
may be provided streets, fire protection, sidewalks, streetlighting, solid
waste collection and disposal, drainage, and other essential facilities and
municipal services.
B.
The Board of County Commissioners of Hardee County, Florida
(the "county"), has enacted an ordinance authorizing the county to establish
a municipal service unit to impose and collect solid waste disposal services
assessments within the unincorporated area of the county.
C.
The Town Council of the Town of Zolfo Springs has determined
that the creation of a municipal service unit for the purpose of providing
solid waste disposal services is in the best interest of the owners of property
within the corporate limits of the Town of Zolfo Springs.
The Town Council of the Town of Zolfo Springs hereby consents to the
inclusion of all of the incorporated area of the Town of Zolfo Springs within
a municipal service unit created by the county to provide solid waste disposal
services, facilities, and programs and to the imposition of a special assessment
for such purposes. Such consent shall become effective upon adoption of this
article for the upcoming fiscal year and hereafter. Further, the Town acknowledges
that assessments for solid waste disposal services have been imposed within
the Town's boundaries by the county in prior years. The Town expressly affirms
that such actions were taken by the county with the consent of the Town. The
Town Council ratifies and approves the imposition of those assessments by
this article. The Town Council of the Town of Zolfo Springs finds that the
provision of solid waste disposal services is an essential municipal purpose.
Consent of the Town Council of the Town of Zolfo Springs given to the
county by this article shall be deemed given in advance for each fiscal year
hereafter and shall be automatically renewed for each succeeding fiscal year
unless such consent is subsequently withdrawn as provided herein. Consent
shall be irrevocable for any fiscal year in which the subject solid waste
disposal services assessments are levied by the county within the incorporated
area. The Town of Zolfo Springs may only withdraw such consent for any subsequent
fiscal year by adopting an ordinance abandoning its consent and providing
a certified copy of such ordinance to the county prior to June 1 preceding
the fiscal year for which consent is being withdrawn.

identify a municipal service taxing or benefit unit or other specific geographic
area within incorporated or unincorporated areas of the county.
B.
The Town Council of Zolfo Springs has determined that
the inclusion of the incorporated area of the Town of Zolfo Springs within
such municipal service benefit unit or specific geographic area by the county
for the purpose of providing fire rescue services is in the best interests
of the owners of property within the corporate limits of Zolfo Springs.
The Town Council of Zolfo Springs hereby requests and consents to the
inclusion of all of the incorporated area of Zolfo Springs within an identified
municipal service taxing or benefit unit or specific geographic area created
or identified by the county to provide fire rescue services, facilities, and
programs and to the imposition of a special assessment by the county to fund
such fire rescue services, facilities and programs. Such request and consent
shall become effective upon adoption of this article for the upcoming fiscal
year. The Town of Zolfo Springs finds that the provision of fire services
is an essential municipal purpose.
Request and consent of the Town Council of Zolfo Springs given to the
county by this article shall be deemed given in advance for each fiscal year
