Open burning is allowed within the Town limits of the Town of Zolfo
Springs so long as the person(s) conducting the burn strictly adheres to the
requirements of state law and has obtained any and all necessary permits or
permission from the State of Florida for such open burning and such open burning
does not create a nuisance within the Town limits. "Open burning" shall be
defined as provided in state statutes and rules.
The Town may seek enforced compliance with this chapter by any means
provided by law, including but not limited to injunctions or enforcement procedures
provided in F.S. Chs. 162 and 166 and the Town's Code Enforcement Ordinance
and policies.[1] The civil penalty for persons found in violation of this chapter
shall not exceed $500 per day per violation.
Any person who willfully refuses to sign and accept a citation issued
by a code inspector shall be guilty of a misdemeanor of the second degree,
punishable as provided by F.S. § 775.082 or 775.083.
