A.
All residential units within the corporate boundaries
of Leonardtown shall avail themselves of the Leonardtown municipal refuse
collection service. The quarterly refuse collection fee for all residential
refuse collection within the corporate boundaries of Leonardtown shall be
as set forth from time to time by the Mayor and Council. Rental dwellings
will be billed on the basis of rentable units, regardless of occupancy.

B.
All residential units shall provide receptacles to contain
all garbage, rubbish and other refuse as may be necessary or heavy duty, securely
tied plastic bags. All such receptacles shall be maintained at all times in
good order and repair. The receptacles shall be made of metal or other suitable
material and be provided with tight covers. No such receptacles shall exceed
30 gallons in capacity, except that this maximum capacity shall not apply
to mechanically handled "dumpsters."
C.
Where alleys are used by the refuse collection personnel,
receptacles shall be placed on or within six feet of the alley line so as
not to intrude upon the traveled portion of the alley. Where streets are used
by the refuse collection personnel, receptacles shall be placed adjacent to
and behind the curb or street line at such times as refuse collection is scheduled.
Upon completion of collection, the owner shall remove all receptacles away
from the curb or street line to his own premises.
D.
The Commissioners of Leonardtown[1] and their duly authorized officers, agents and employees shall be empowered to waive or amend the requirements of Subsection C where curbside collection would result in undue hardship due to age or handicap. Such waiver must be requested, in writing, by the residential unit occupant, and each such request for waiver will be determined on its own merits.

B.
The refuse collection fee for all commercial refuse collection
using mechanically handled dumpsters within the corporate boundaries of Leonardtown
shall be billed on a cubic yard rate as set forth from time to time by the
Mayor and Council.

C.
For small businesses, a minimum fee shall apply.
