The purpose of this article is to ensure the safety, comfort and convenience of the public in their appropriate uses of Shepard Memorial Park.

It shall be unlawful for any person to bring or otherwise possess any domestic animal, in Shepard Memorial Park, unless such animal is on a leash. The person with such animal will be responsible for controlling such animal and removing any waste. No animals shall be permitted in the sandy beach area.

Vehicles, motor scooters, motorcycles, minibikes, snowmobiles, bicycles, rollerblades and skateboards are prohibited within the confines of Shepard Memorial Park, except in the exercise of a governmental function or in case of a bona fide emergency.
It shall be unlawful to sit, stand, or walk on or inside the pool area. Littering, defacing, altering or removing any contents of the Centennial Fountain area is prohibited.

A. 
It shall be unlawful to conduct performances of any nature whatsoever, including, but not limited to, concerts, dramas, shows, parades, drills, reviews, speeches, playing of musical instruments, within Shepard Memorial Park, except upon first obtaining a permit from the Village, on a form approved by the Village and fulfilling the requirements of any fees or proof of insurance.
B. 
Requests for permits must be made in writing, at least seven days in advance, and will be acted upon by the Village Board of Trustees. Uses involving one day only in duration may be approved by the Mayor or Deputy Mayor. Requests should state the purpose, intent and hours of the performance as well as the person responsible.
C. 
Use of Shepard Memorial Park shall be in strict compliance with all rules and regulations as listed in this article unless waived or modified by writing in the use permit.

D. 
In addition, the Village Board reserves the right to waive Chapter 59 within the confines of Shepard Memorial Park during the permitted use of a special event.

E. 
Such special event application must contain proof of approval by the New York State Liquor Authority (SLA) and any other applicable agency.

It shall be unlawful to occupy Shepard Memorial Park between the hours of 11:00 p.m. and 7:00 a.m.

A. 
All vehicles shall be prohibited from Shepard Park except in accordance with § 148-3 unless permitted for a special event. Such vehicles shall number no more than four and be parked in the area designated south of the amphitheater.
B. 
Any vehicles parked on lawns or elsewhere shall be deemed parked in a "No Parking Zone" and be subject to a ticket or removal.
It shall be unlawful for any person to occupy or otherwise use any beach or swimming area within Shepard Memorial Park unless he be clothed in a bathing suit or similar attire.

No person shall dive, jump or otherwise enter the water from MacDonald Pier.
It shall be unlawful to bring or possess bottles or cans of any type upon any beach or swimming area within Shepard Memorial Park.
It shall be unlawful to play any ball game or any other game that may inhibit or disturb users of the swimming area or beach within Shepard Memorial Park.

Light picnicking will be allowed in an area so designated for the same. No fires or cooking is permitted. Picnicking privileges are limited to bathers only.

A. 
It shall be unlawful to enter the water during times when the beach is officially closed. Such closures shall be designated by signs at the waterfront.
B. 
Normal hours of operation during July and August are 9:00 a.m. to 6:00 p.m. daily. Lifeguards will alert bathers to closing hour by a blast of the whistle.
C. 
It shall be unlawful for anyone to enter the water in areas designated "Closed" during certain open hours as the lifeguards deem appropriate for reasons of safety.

It shall be unlawful for any person to smoke or use tobacco products within the park in designated areas surrounding the children's playground and amphitheater seating area. Such areas are defined by appropriate signage.

Every violation of this article shall constitute an offense, as defined by § 10.00 of the Penal Law of the State of New York, and shall be punishable by a fine of not more than $250.
