The purpose of this article is to ensure the
safety, comfort, and convenience of the public in their appropriate
uses of Lake Avenue Park.
It shall be unlawful to occupy Lake Avenue Park
between the hours of 12:00 midnight and 6:00 a.m. daily.
The possession or consumption of alcoholic beverages
of any type is prohibited within the park.
Motorcycles, snowmobiles, motor scooters, bicycles,
rollerblades, skateboarders or motorized vehicles are prohibited from
the park.
No person shall operate any amplified device
within the park.
All park users shall stay on the footpaths and
on the sand beach area so designated. No users are permitted off the
pathways, flowerbeds or planting areas.
All visitors must dispose of any containers,
paper products, or other disposables brought to the park by disposing
of same in approved trash receptacles.
Swimming from the shoreline of the park is prohibited.
Wading is permitted only under the direct supervision of an adult.
This park shall be for the peace and tranquility
of all users. Anyone disturbing the contents of the park, destroying
same or acting in a disturbing manner shall be deemed a disorderly
person and be subject to a penalty of $250.
Launching of boats shall be restricted to nonmotorized
craft only, such as kayaks, canoes, rowboats or other hand-powered
boats. Trailered vessels are prohibited.
A.
Every violation of this article shall constitute an
offense, as defined by § 10.00 of the Penal Law of the State
of New York, and shall be punishable by a fine of not more than $100.
B.
In addition to any other remedies or penalties that
may be imposed, a violation of this article shall entitle the Board
of Trustees to undertake a remedy to repair any damage caused by the
violation of any section or provision of this article, and the actual
disbursements and expenses therefor shall be added to the fine(s)
set forth in this article. This provision shall be in addition to
any other provisions, penalties or powers available to the Village
for enforcement of this article.
