[HISTORY: Adopted by the Board of Trustees

It is the intent of the Village of Lake George,
as an exercise of its police power, to promote the general health,
safety and welfare of the residents and inhabitants of the Village
by enacting this chapter. It is the finding of the Village of Lake
George Board of Trustees that the residents, inhabitants, and vacationers
to the Village of Lake George enjoy free and unhampered pedestrian
travel up and down the sidewalks of the Village of Lake George. It
is the finding of the Village of Lake George Board of Trustees to
keep pedestrian traffic open and unhampered as a health, safety and
welfare benefit to its residents and inhabitants and a desired benefit
by those who visit the Village. Therefore, it is the intent of the
Village of Lake George to provide designated areas for street performers,
on Village property, that do not interfere with pedestrian traffic.
The Village of Lake George Board of Trustees has designated areas
in Blais Park, Shepherds Park, the lower Montcalm concourse, and the
Beach Road sidewalk abutments to accommodate a permitting scheme for
street performers and entertainers.
No person shall perform magic, act, sing, dance,
play music, act as a mime, juggle or engage in similar entertainments
upon the streets, sidewalks or other outdoor public places of the
Village of Lake George without first obtaining a license to do so
from the Mayor.

A.
Application for such licenses shall be made upon a blank form furnished
by the Mayor, signed and verified, giving the name, address and telephone
number of the applicant. Said application shall be filed with the
Village of Lake George offices and accompanied by a fee of $75.
B.
Applicants may be required to perform their chosen skills at a time
and place so designated by the Mayor in advance of each season.

All licensees shall be furnished a copy of this
chapter, together with a list of areas and places where performances
are permitted.
All persons licensed hereunder shall display
their licenses at all times during the street performances.
B.
Performances may also take place at a fair or public
festival authorized by Village law and upon written permission of
the sponsor therein.
C.
Performances shall be restricted to the following:
6:00 p.m. to 10:00 p.m. on Thursdays, Saturdays and Sundays only.

A.
Amplified equipment. A performer licensed hereunder
may use amplified equipment only with permission from the Mayor or
Board of Trustees and shall be for background effect only. Amplified
equipment shall be battery-powered only and shall be audible for a
distance not to exceed 50 feet.
B.
Passage of public. No licensee shall perform so as
to block the passage of the public through a public area, unless permitted
to do so at a fair or public festival by the sponsor thereof. The
Mayor and/or state and local police authorities are hereby authorized
to disperse a crowd or portion thereof which is blocking the passage
of the public but shall not order the licensee to quit the location
absent a violation of this Code or other statute, rule or regulation.
C.
Contributions. A licensee may accept contributions
at a performance in a hat, instrument case or other receptacle. All
signs requesting contribution shall be limited in size to 12 inches
by 11 inches.
Upon the recommendation of the Mayor and/or
any local or state police authorities, the Village Board of Trustees
may conduct a public hearing to determine whether a public area should
be excluded from performances by persons licensed under this chapter.
The Village Board of Trustees shall determine whether the public health,
safety or welfare would require such an exclusion and may exclude
any public area from performances. No such exclusion shall be effective
until seven days after notice thereof has been mailed to all licensees.
A.
A license issued hereunder may be suspended or revoked
by the Village Board of Trustees for cause after notice and an opportunity
for a hearing have been afforded the licensee.
B.
Upon revocation, the former licensee may be restricted
from application for a license for such time as the Village Board
of Trustees may determine but no longer than one year.
C.
A license may be temporarily suspended hereunder by
the Mayor for cause and until the hearing is conducted as set forth
in this section. "Cause" shall be defined as any act or omission by
the licensee that is inconsistent with the public health, safety or
welfare of the community. Any licensee whose license is temporarily
suspended by the Mayor as set forth herein shall be entitled to a
hearing in no fewer than seven days from the day of such suspension.
