As used in this article, the following terms shall have the meanings indicated:
DOG
Any member of the species Canis familiaris of either sex or any age unless otherwise stated.

DOG CONTROL OFFICER
Any member of the Norwood Police Department or other certified police officer of the county or state and, in the case of Agriculture and Markets Law violations, the Potsdam Town Dog Control Officer.
HARBOR
To provide food or shelter to any dog.
OWNER
Any person who harbors or keeps a dog within the limits of the Village of Norwood and the parent or guardian or other adult person with whom a minor dog owner resides.

VILLAGE
The Village of Norwood.
A. 
Any person owning or harboring a dog shall not suffer or allow it to run at large in any of the streets or public places of this Village or upon premises of anyone other than the owner or keeper unless the owner or occupant of such premises grants permission. And no dog shall be permitted in any public place or street within this Village unless it be effectively restrained by a chain or leash not exceeding six feet in length or is attended by a person of adequate age and discretion able to properly control its actions.
B. 
Owners and custodians to be responsible. Any person who owns a dog or has custody of a dog, which dog has caused its feces to be deposited upon any Village property or upon the property of another, shall immediately remove such feces or cause it to be removed and shall dispose of it in a sanitary manner. A person will be considered to have disposed of feces in a sanitary manner if such person places such material in a bag or wrapper made of paper, plastic or some similar material and places it in a refuse container which is regularly emptied, or otherwise disposes of such material on his or her own property.

A dog shall be considered a public nuisance if it shall:
A. 
Engage in habitual loud howling, barking, crying or whining or conduct itself in such a manner so as to unreasonably disturb the repose or comfort of any person other than the owner of said dog.
B. 
Uproot, dig or otherwise damage any vegetables, lawns, garden beds or other property not belonging to the owner of said dog.
C. 
Chase, jump upon or at or otherwise harass any person in such manner as to reasonably cause intimidation or fear or to put such person in reasonable apprehension of bodily harm or injury.
D. 
Habitually chase, run alongside of or bark at motor vehicles while on a public street or highway or upon public or private property other than the property of the owner of said dog.
E. 
Create a nuisance by defecating, urinating or digging on public property or private property other than the property of said owner.
F. 
Be a female dog in heat off the owner's premises.
G. 
Be at large on any school premises or recreational area or the sidewalks adjacent thereto unless said dog is on a physical leash.[1]

It shall be unlawful for any owner of a dog or dogs to fail to provide such dog or dogs with adequate food, water and shelter at all times.
A person shall at all times keep the area wherein dogs are kept or harbored in a neat, clean, sanitary condition in accordance with the regulations of the Board of Health and the Public Health Law of the State of New York.

Any dog which serves as a guide dog shall be exempt from the provisions of this article while such dog is accompanying a blind person.

Any person designated in § 55-1 of this article or any other person empowered by law to seize and impound a dog pursuant to Article 7 of the Agriculture and Markets Law shall have the authority to enforce the provisions of this article and shall have the power to seize and impound any dog in violation of any provisions of this article and to issue an appearance ticket for said dog owner or harborer to appear in court.

Except as provided in § 119 of the Agriculture and Markets Law, any person violating any of the provisions of this article, upon conviction thereof, shall be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both such fine and imprisonment.
This article is enacted pursuant to the following:
A. 
Authority: Article 1, Title II, § 12-b, of the Public Health Law; §§ 120 and 121 of the Agriculture and Markets Law; §§ 2140, 2141 and 2142 of the Public Health Law.
B. 
Authority to impose penalty: Agriculture and Markets Law.
C. 
Redemption of animal: Potsdam SPCA rules and regulations.
D. 
Seizure of unleashed and/or unlicensed dogs: Agriculture and Markets Law.
