The office of Township Manager is hereby created by the Board of Commissioners of the Township of Penn, Westmoreland County, Pennsylvania.
A. 
As soon as practical after the enactment of this chapter, the Board of Commissioners of the Township of Penn shall elect, by a majority vote of its members present at a duly called meeting of the Board of Commissioners, one person to fill the Office of Township Manager, who shall serve until his successor is elected and qualified or until said Office of Township Manager is abolished.
B. 
In the case of a vacancy, the Board of Commissioners of the Township of Penn shall fill said office by a majority vote of the members in attendance at a regularly called meeting of the Board of Commissioners of the Township of Penn.
C. 
The Township Manager shall, however, be subject to removal at any time by a majority vote of all the members of the Board of Commissioners of Penn Township, provided that at least 30 days before such removal becomes effective, the Board of Commissioners of the Township of Penn shall furnish the Township Manager with a written statement setting forth its intention to remove him.
D. 
In the event the Township Manager shall decide to resign, a written notice of at least 90 days shall be given to the Board of Commissioners.

A. 
The Manager shall be chosen solely on the basis of his executive and administrative ability, with special reference to his actual experience or his knowledge of accepted practices in respect to the duties of his office as herein outlined.
B. 
The Township Manager need not be resident of the Township of Penn or of the Commonwealth of Pennsylvania at the time of his appointment, but during the tenure of his office he may reside outside the Township of Penn only with the approval of the Board of Commissioners. If the Board of Commissioners fails within a reasonable time, not to exceed 60 days after the appointment, to approve the Manager's residence outside the Township of Penn, he must immediately become and during his tenure remain a resident of the Township of Penn.

Before entering upon his duties, the Township Manager shall give a bond to the Township of Penn, with a bonding company as surety, to be approved by the Board of Commissioners, in an amount set by resolution of the Board of Commissioners, conditioned for the faithful performance of his duties, and the premium for said bond shall be paid by the Township of Penn.

The salary of the Township Manager shall be established by a resolution adopted by the Board of Commissioners. The Board of Commissioners may enter into an employment agreement with the Township Manager. The employment agreement may set forth the terms and conditions of employment, which shall be consistent with Chapter 32, Officers and Employees, of the Code of the Township of Penn. The agreement may provide that it shall remain in effect for a specified period of time terminating no later than two years after the effective date of the agreement or the date of the Board of Commissioners’ organizational meeting following the next municipal election, whichever shall first occur. The employment agreement may specify conditions under which the Township Manager would be entitled to severance compensation, but in no event shall the employment agreement guarantee employment through the term of the agreement or confer upon the Township Manager any legal remedy based upon specific performance.

The Township Manager shall be the Chief Executive Officer of the Township and shall be responsible to the Board of Commissioners of the Township of Penn as a whole for the proper and efficient administration of the affairs of Penn Township. The Township Manager’s powers and duties shall relate to the general management of all Township business as administrated by the departments created therefor by the Board of Township Commissioners and not expressly by statute imposed or conferred upon another Township officer or persons. Subject to recall by ordinance, the powers and duties of the Township Manager shall be as fully described in Chapter 32, Officers and Employees, § 32-1, Township Manager.

If the Township Manager becomes ill or needs to be absent from the Township, and should the position of Administrative Assistant to the Township Manager not be presently filled, the Township Manager shall recommend a qualified staff member to perform duties of the office, and if approved by the Board of Commissioners, the person so recommended shall temporarily perform the duties in the absence of the Township Manager. If there is no recommendation from the Township Manager, the Board of Commissioners shall choose such person as the Board deems qualified to perform the duties of the Township Manager. Said individual shall be bonded as required under § 28-4 herein.
