[HISTORY: Adopted by the Board of Supervisors of the Township of Upper Providence 4-19-2004 by Ord. No. 441. (This ordinance also repealed former Ch. 60, Building Construction, adopted 1-21-1997 by Ord. No. 359.) Amendments noted where applicable.]

This chapter shall be known and may be cited as the "Upper Providence Township Building Code" and/or the Pennsylvania "Uniform Construction Code."
In accordance with the Pennsylvania Construction Code Act, Act 45 of 1999, Chapter 5, Section 501(a)(1), the Township of Upper Providence situate in Montgomery County Pennsylvania hereby elects to administer and enforce the Uniform Construction Code as their municipal building code and the International Fuel Gas Code for purposes described in Section 302(A) of said Act 45.
This adoption shall include all relative codes specifically provided for under said Act 45 to include but not limited to the International Building Code, the International Residential Code, the International Fire Code and all other referenced codes. As provided for under Act 45, Section 304, all subsequent editions or successor codes are hereby adopted. In addition, the following appendices to the International Residential Code 2003 are hereby adopted: A, B, C, F, G and H. The following appendices of the International Fire Code are hereby adopted: B, C, D, E and F. Upon adoption by the Commonwealth of Pennsylvania of successor codes, those codes and the appendices corresponding to those listed are hereby adopted.
Administration and enforcement of the Code within the Township shall be undertaken in any of the following ways as determined by the governing body of the Township from time to time by resolution:
A. 
By the designation of an employee of the Township to serve as the municipal code official to act on behalf of the Township.
B. 
By the retention of one or more construction code officials or third-party agencies to act on behalf of the Township.
C. 
By agreement with one or more other municipalities for the joint administration and enforcement of this Act through an intermunicipal agreement.
D. 
By entering into a contract with another municipality for the administration and enforcement of this Act on behalf of the Township.
E. 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.
A. 
Administrative: modification of the administrative regulations, chapter 403.
(1) 
Section 401.2a(a) add: "Fees for building permits shall be in accordance with a schedule adopted by resolution of the Board of Supervisors."
(2) 
All building code ordinances or portions of ordinances which were adopted by the Township on or before July 1, 1999, and which equal or exceed the requirements of the Code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Code, as amended from time to time.

Pursuant to and in accordance with State Act 92 Section 104 (B), the Township will require permits for residential alterations and repairs pursuant to the International Residential Code 2003 Chapter 1 Section 105 or any subsequent edition thereof.

Pursuant to and in accordance with State Act 92 Section 104 (B), the Township will require zoning permits for all utility and miscellaneous use structures. Utility and miscellaneous use structures in excess of two hundred (200) square feet will require building permits.

(3) 
All building code ordinances or portions of ordinances which are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the Code are hereby amended to conform with the comparable provisions of the Code.
(4) 
All relevant ordinances, regulations and policies of the Township not governed by the Code shall remain in full force and effect.
(5) 
Section 403-62(c) shall have the following items amended or deleted from the list of permit exempt items as indicated.
(a) 
(1)(xiv) add: after... located above the porch or stoop and is not over 30 inches above grade.
(b) 
(1)(xvii): delete.
(c) 
(2)(vi): delete.
(d) 
(5)(viii): delete.
(e) 
(5)(ix): delete.
(f) 
(6)(vi): delete.
B. 
Technical modifications of the International Building Code 2003.
(1) 
Section 705.3 shall be enforced as written in the 2003 International Building Code.

(2) 
Section 1003.2.10.1 add: "Two exit signs shall be located at all exit doors or exit access area so as to be readily visible. One sign shall be located in the wall so that the bottom of the sign is eight inches from the floor on the latch side of the door and the second sign shall be located in a standard position above the exit doorway."
(3) 
Sections 903.2.1.1, 903.2.1.2, 903.2.1.3, 903.2.1.4, 903.2.3, 903.2.6 and 903.2.10, amend as follows: All references to square footage in these sections shall read "2500 square feet per floor."
C. 
Technical modifications of the International Residential Code 2003.
(1) 
The Design Data in Table R301.2(1) shall read as follows: snow load 30 pounds per square foot; wind speed 90 miles per hour, Seismic Design Category C; weathering severe; frost depth 36 inches; termite probability moderate to severe; decay slight to moderate; winter design temp 10° F.; ice shield no; air freezing index 1500; mean annual temp. 52° F.
(2) 
Section R321.2 (Section 317.2 of the 2003 International Residential Code) shall be enforced as written in the 2003 International Residential Code.

D. 
Administrative modifications of Chapter One of the International Fire Code 2003.
(1) 
Section F-101.1 insert: "Upper Providence Township, Montgomery County."
(2) 
Section F-103.1 General shall be modified and read as follows: The Department of Fire Prevention is established within the jurisdiction and under the direction of the Planning and Zoning Administrator/Code Official. The Fire Marshal/Code official shall be in charge of the operation of this Department and its function shall be the implementation, administration, and enforcement of the provisions of this Code.
(3) 
Section F-103.2 Appointment shall be deleted and the following language substituted: The Fire Marshall position shall be filled as prescribed in the Code of the Township of Upper Providence.
(4) 
Add Section F-105.1.4 Fees: "Fees for fire permits shall be in accordance with a schedule adopted by resolution of the Board of Supervisors."
(5) 
Sections F-105.6 and F-105.7 Required Permits shall read as follows: "The Fire Code Official is authorized to issue permits and collect fees as enumerated in Sections 105.6.1 through 105.6.47 and Sections 105.7.1 through 105.7.12 in accordance with a schedule adopted by resolution of the Board of Supervisors.
E. 
Technical modifications of the International Fire Code 2003.

(1) 
Section F-505, Premises identification, shall be added to read as follows:
F-505.3 Identification of Truss Construction.
Except as provided in subparagraph (e) below, the owner of a building or structure containing truss construction in any form or manner shall install and maintain a truss emblem to the left of the main entrance and at a height of not less than five feet above grade. The truss emblem required under this section shall be purchased from the Township at a cost determined from time to time by resolution of the Township Board of Supervisors.
The owner and/or developer of a residential subdivision or residential condominium shall install and maintain a truss emblem within the public right-of-way or upon the common elements/area (in the case of a private street or condominium) at each entrance to such subdivision or condominium.
F-505.3.1. Purpose. The purpose of this chapter is to install identification emblems on certain properties, buildings or structures containing truss construction for the protection of the health, safety and welfare of emergency responders.
F-505.3.2. Definitions. (A) As used in this chapter, the following terms have the meanings indicated, unless a different meaning clearly appears from the context.
(1) Truss Construction: A combination of members, such as beams, bars and ties, usually arranged in triangular units to form a rigid framework for supporting loads over a span of structural members that connect together to span the space between the walls of the building to support a vertical load.
(2) Truss Emblem: A sign consisting of an isosceles triangle not less than 12 inches horizontally by six inches vertically made of reflective material with white as the background and red lettering, containing the following: "F" to signify a building or structure having a floor with truss construction; "R" to signify a building or structure having a roof with truss construction; or "FR" to signify a building or structure having both a floor and roof with truss construction.
F-505.3.3. Exemption. Except for nonresidential buildings or structures, the owner of a building or accessory structure within a residential subdivision or residential condominium referred to in subparagraph (b)(2) above shall be exempt from installing and maintaining a truss emblem. The owner of any other single-family dwelling unit or semidetached dwelling containing not more than two dwelling units shall also be exempt from installing and maintaining a truss emblem.
F-505.3.4. Fire Marshal Approval. The owner and/or developer of any building or structure required to have a truss emblem under this section shall submit a plan for such truss emblem as to design and location for the prior review and approval of the Township Fire Marshal or Building Inspector.
F-505.3.5. Retroactive Compliance Required. The provisions of this section shall apply to the owners of existing buildings or structures having truss construction, but such owners shall have one year from the effective date of this section to comply.
A Board of Appeals shall be established by resolution of the governing body of this Municipality in conformity with the requirements of the relevant provisions of the Code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, the Board of Appeals shall be established by joint action of the participating municipalities.
