It shall be unlawful for any person to commit an assault or battery upon another under circumstances not constituting a felony.
A.ย 
It shall be unlawful for any person to attempt to commit any act which is prohibited by this Code or other ordinance or by any rule, regulation, order or notice duly promulgated or given pursuant to authority thereof; and it shall be unlawful for any person to aid or abet another in the commission or attempted commission of any act which is prohibited by this Code or other ordinance or by any rule, regulation, order or notice duly promulgated or given pursuant to authority thereof.
B.ย 
It shall be unlawful for any person to attempt to avoid the doing of any act which is required by this Code or other ordinance or by any rule, regulation, order or notice duly promulgated or given pursuant to authority thereof; and it shall be unlawful for any person to aid or abet another in the avoidance or attempted avoidance of any act which is required by this Code or other ordinance or by any rule, regulation, order or notice duly promulgated or given pursuant to authority thereof.
A.ย 
It shall be unlawful for any minor who has not yet attained the age of 18 years to loiter, idle or play in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places in the Town, between the hours of 11:00 p.m. and 6:00 a.m. the following day, provided that the provisions of this section shall not apply to such a minor accompanied by his parent, guardian or other adult person having the care and custody of the minor or when such minor is upon an emergency errand or legitimate business directed by his parent, guardian or other adult person having the care and custody of such minor. Each violation of this subsection shall constitute a separate offense. Any minor violating the provisions of this section shall be dealt with in accordance with the Commonwealth Juvenile and Domestic Relations Law and procedure.
B.ย 
It shall be unlawful for the parent, guardian or other adult person having the care and custody of any minor who has not yet attained the age of 18 years knowingly to permit such minor to idle, loiter or play in or upon public streets, highways, roads, alleys, parks, playgrounds or other public places, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places in the Town, between the hours of 11:00 p.m. and 6:00 a.m. the following day, in violation of Subsection A. Each violation of this subsection shall constitute a separate offense. Any parent, guardian or other adult person having the care and custody of a minor violating the provisions of this section shall be fined not less than $5 nor more than $100 or be confined in jail not more than 10 days, or punished by both such fine and imprisonment for each offense.
A.ย 
Any person who shall do or engage in any of the following shall be guilty of disorderly conduct:
(1)ย 
Any person who shall act in a violent or tumultuous manner toward another whereby any person is placed in danger of safety of his life, limb or health.
(2)ย 
Any person who shall act in a violent or tumultuous manner toward another whereby public property or property of any other person is placed in danger of being destroyed or damaged.
(3)ย 
Any person who shall endanger lawful pursuits of another by acts of violence or threats of bodily harm.
(4)ย 
Any person who shall cause, provoke or engage in any fight, brawl or riotous conduct so as to endanger the life, limb, health or property of another or public property.
(5)ย 
Any person who shall assemble or congregate with another or others and cause, provoke or engage in any fight or brawl.
(6)ย 
Any person who shall assemble in bodies or in crowds and engage in unlawful activities.
(7)ย 
Any person who shall assemble or congregate with another or others and engage or attempt to engage in gaming.
(8)ย 
Any person who shall frequent any public place and obtain money from another by an illegal and fraudulent scheme, trick, artifice or device, or attempt to do so.
(9)ย 
Any person who assembles with another or others and engages in any fraudulent scheme, device or trick to obtain any valuable thing in any place or from any person, or attempts to do so.
(10)ย 
Any person who utters, in a public place or any place open to the public, any obscene words or epithets.
(11)ย 
Any person who frequents any place where gaming or the illegal sale or possession of alcoholic beverages or narcotics or dangerous drugs is practiced, allowed or tolerated.
(12)ย 
Any person who shall use fight-provoking words directed towards any person who becomes outraged and thus creates turmoil.
(13)ย 
Any person who shall assemble or congregate with another or others and do bodily harm to another.
(14)ย 
Any person who shall, by acts of violence, interfere with another's pursuit of a lawful occupation.
(15)ย 
Any person who shall congregate with another or others in or on any public way so as to halt the flow of vehicular or pedestrian traffic and refuses to clear such public way when ordered to do so by a peace officer or other person having authority.
(16)ย 
Any person who damages, befouls or disturbs public property or the property of another so as to create a hazardous, unhealthy or physically offensive condition.
B.ย 
Any person convicted of disorderly conduct, as defined in this section, shall be punished as provided in ยงย 1-16.
It shall be unlawful for any person to create a disturbance or use loud or profane or obscene language or loiter in any public, parochial or private school building or on the premises of any such school, or to refuse promptly to leave such school building and premises upon the request of the principal, superintendent or any officer or employee of the school.
It shall be unlawful for any person willfully to interrupt or disturb any assembly met for the worship of God, or, being intoxicated, to disturb the same whether willfully or not.
It shall be unlawful for any person, whether a passenger or not, while in or on any public conveyance, to behave in a riotous or disorderly manner. The agent or employees in charge of such public conveyance may require such person to discontinue his riotous or disorderly conduct and, if he refuses to do so, may eject him, with the aid, if necessary, of any persons who may be called upon for the purpose.
If any person behaves in a riotous or disorderly manner in any street, highway, public building or any other public place, other than those mentioned in ยงย 139-7, or causes any unnecessary disturbance in or on any public conveyance by running through it, climbing through windows or upon the seats, failing to move to another seat when lawfully requested to so move by the operator or otherwise annoying passengers or employees therein, he shall be guilty of an offense punishable by a fine not exceeding $2,500 or confinement in jail not exceeding 12 months, or both, in the discretion of the jury or of the court trying the case without a jury.
It shall be unlawful for any person to take a drink of any alcoholic beverage or to offer a drink of any alcoholic beverage to another, whether or not such offer shall be accepted, in any public place in the Town other than a place licensed by the state for on-premises consumption of alcoholic beverages.
A.ย 
No person shall distribute or cause to be distributed handbills in such manner as to interfere with the flow of traffic on any sidewalk or street.
B.ย 
No person shall throw or place or cause to be thrown or placed any handbill on any street, sidewalk or other public place.
C.ย 
No person shall distribute or cause to be distributed any handbill which is obscene or immoral.
D.ย 
No person shall distribute or cause to be distributed any handbill, the contents of which advocate unlawful conduct.
E.ย 
No person shall post or affix any handbill to any telephone, telegraph or other pole within the Town to which electric wires are affixed.
F.ย 
No person shall place or cause to be placed any handbill on any automobile or other private property, real or personal, unless previously invited by the owner or occupant of such property to do so; nor shall any person enter or cause entrance to be made on any private property at any time for the purpose of distributing handbills.
A.ย 
It shall be unlawful for any person over 12 years of age while wearing any mask, hood or other device whereby a substantial portion of the face is hidden or covered so as to conceal the identity of the wearer, to be or appear in any public place or to be or appear upon any private property in this Town without first having obtained from the owner or tenant thereof consent to do so in writing, provided that the provisions of this subsection shall not apply to persons wearing traditional holiday costumes nor to persons engaged in professions, trades, employment or other activities and wearing protective masks which are deemed necessary for the physical safety of the wearer or other persons nor to persons engaged in any bona fide theatrical production or masquerade ball.
B.ย 
It shall be unlawful for any person over 12 years of age to appear in or upon any of the streets, highways, alleys, public squares and other public places of the Town on Halloween in any mask or disguise whereby the identity of such person is concealed without permission of the Town Manager.
C.ย 
A special curfew hour of 9:00 p.m. on Halloween is hereby established for "trick or treat" visitations.
D.ย 
For the purpose of this section, Halloween shall be deemed to be the evening of the 31st day of October of each year or upon such other date as may be designated to be Halloween by applicable law or ordinance.
E.ย 
Any person violating any provision of this section shall be punished under the general provisions of ยงย 1-16 of this Code.
Any person who, in any public place or on any private property open to the public, unreasonably or unnecessarily obstructs the free passage of other persons to and from or within such public place or private property and who shall fail or refuse to cease such obstruction or move on when requested to do so by the owner or lessee or by an agent or employee of such owner or lessee or by a duly authorized law enforcement officer shall be guilty of an offense punishable by a fine not exceeding $2,500 or confinement in jail not exceeding 12 months, or both, in the discretion of the jury or of the court trying the case without a jury; but nothing in this section shall be construed to prohibit lawful picketing.
It shall be unlawful for any person to commit larceny from the person of another of money or other thing of value less than $5, or to commit simple larceny not from the person of another of goods and chattels of the value of less than $100.
A.ย 
It shall be unlawful for any poolroom, billiard hall or bowling alley to be open for business between the hours of 12:00 midnight and 6:00 a.m.
B.ย 
No person under 18 years of age shall frequent, play in or loiter in any public poolroom or billiard room or be permitted by the proprietor thereof or his agent to frequent, play in or loiter in any such public poolroom or billiard room located within the Town after 12:00 midnight.
It shall be unlawful for any prisoner in the custody of a duly qualified police officer, whether a regular officer or a special officer, to flee from such custody.
A.ย 
No person shall, knowingly and without proper authority, use, tamper with, render inoperative, destroy, damage, remove, deface, molest or otherwise interfere with any personal property of another.
B.ย 
No person shall, knowingly and without proper authority, destroy, damage, deface, molest or otherwise interfere with or trespass upon any real property of another.
If any person arrived at the age of discretion profanely curses or swears or gets or is drunk in public, he shall, upon conviction thereof, be fined not less than $1 nor more than $500.
Riots and unlawful assemblies shall be dispersed forthwith by the Town police and other law enforcement officers, and all persons present at the scene of any riot or unlawful assembly shall, upon command of any law enforcement officer to disperse, forthwith obey such command and peacefully disengage themselves from such riot or unlawful assembly and leave the scene thereof, and persons who fail to obey such command shall be subject to immediate arrest.
No person shall carelessly or willfully interfere with, hinder or obstruct any officer or employee of the Town who is engaged in, en route to or returning from the performance of official duty, whether such interference, hindrance or obstruction is by threat, assault or otherwise.
No person shall falsely represent himself to be an officer or employee of the Town, or without proper authority wear or display any uniform, insignia or credential which identifies any Town officer or employee; nor shall any person without proper authority assume to act as an officer or employee of the Town, whether to gain access to premises, obtain information, perpetrate a fraud or for any other purpose, provided that nothing in this section shall be construed to prevent a private citizen from making a lawful citizen's arrest for felony or breach of the peace committed in his presence.
A.ย 
No person shall, without proper authority, knowingly use, tamper with, render inoperative, destroy, damage, remove, deface, molest or otherwise interfere with any books, records, furniture, equipment, gear, apparatus, tools or other items of personal property belonging to, leased to or used by the Town or any agency thereof.
B.ย 
No person shall, without proper authority, knowingly destroy, damage, deface, molest or otherwise interfere with or trespass upon any real property belonging to, leased to or used by the Town or any agency thereof.
It shall be unlawful for any person, without authority from the Town so to do, to obstruct, hinder, abuse or otherwise interfere with any contractor or workman who is under contract with or employed by the Town while such contractor or workman is acting in the course of his duties.
It shall be unlawful for any person to willfully discharge or cause to be discharged within the corporate limits of the Town of Stanley any firearm, bow and arrow or crossbow; provided, however, that this section shall not apply to any law enforcement officer in the performance of his official duties nor to any other person as to whom said willful act is otherwise justifiable or excusable at law in the protection of his life or property, or as otherwise specifically authorized by law.
Except as hereinabove provided, any person violating the provisions of this chapter shall, upon conviction, be punishable under the provisions of ยงย 1-16 of this Code.
