A Length of Service Awards Program (LOSAP) is
hereby created in accordance with Chapter 388 of the Laws of New Jersey
of 1997, being N.J.S.A. 40A:14-183 et seq., to award members of the
volunteer fire department for their loyal, diligent, and devoted services
to the residents of the Borough of Caldwell.
The LOSAP shall provide for fixed annual contributions
to a deferred income account for each volunteer member that meets
criteria set forth below. Such contributions shall be made in accordance
with a plan that shall be established by the Mayor and Council of
the Borough of Caldwell pursuant to P.L 1997, c. 388 and its implementing
regulations and such plan shall be administered in accordance with
the laws of the State of New Jersey, the U.S. Internal Revenue Service,
and this article.
The LOSAP shall provide for annual contributions
to each eligible member that meets the criteria as follows:
A. As used in this article, the following terms shall
have the meanings indicated:
ACTIVE VOLUNTEER MEMBER
Any Caldwell volunteer firefighter who meets the minimum
annual attendance (30% of fire alarms, drills, meetings and other
fire department activities increased by approved extra credit events)
and training requirements set forth in the Fire Department regulations.
B. An active member shall receive from the Borough an annual LOSAP contribution based on the number of LOSAP points earned during the year. The maximum LOSAP contribution which an active volunteer member may receive in a year is $1,150. An active volunteer member must earn Forty One LOSAP points in a year to receive the minimum LOSAP contribution of $100 or 5% of the maximum annual LOSAP contribution, whichever is greater. As set forth in §
28-5 of this article, an active member shall earn LOSAP points based on his or her seniority, annual attendance and extra credit LOSAP points.
The estimated total amount to be budgeted for
the program is $40,000.
Each active volunteer member shall be credited
with points for volunteer services provided to the Caldwell Volunteer
Fire Department in accordance with the following schedule:
A. Seniority. An active volunteer member shall receive
one LOSAP point for each year of active emergency service after completing
three years of service. An active volunteer member may earn a maximum
of 30 LOSAP points in any year for seniority.
B. Participation in Department responses to alarms. An
active volunteer member shall receive 25 LOSAP points for responding
to 15% attendance at the Fire Department responses to which volunteer
firefighters have been dispatched.
C. Drills. An active volunteer member shall receive one
LOSAP point for each authorized Fire Company, Department, mutual aid and special drills of a minimum of two hours in duration.
An active volunteer member may earn a maximum of 20 LOSAP points in
any year for drills.
D. Attendance at meetings. An active volunteer member
shall receive one LOSAP point for each regular and special Fire Company
and Department meeting. An active volunteer member may earn a maximum
of 20 LOSAP points in any year for attendance at meetings.
E. SCBA's, house cleanup and work details. An active
volunteer member shall receive one LOSAP point for the attendance
of each SCBA's, house cleanup and work detail. An active volunteer
member may earn a maximum of 15 LOSAP points in any year for attendance
at SCBA's, house cleanups and work details.
F. Miscellaneous officials and appointees. An active
member shall receive LOSAP points for holding the following elected
or appointed positions within the Department:

G. Extra credit. An active volunteer member shall receive
one LOSAP point for the attendance at extra credit events as approved
by the Fire Chief or the designated officer in charge. An active volunteer
member may earn a maximum of 15 LOSAP points in any year for attendance
at extra credit events.
H. An active volunteer member shall receive a percentage
of the maximum LOSAP contribution based on the number of LOSAP points
earned in a year.

This article shall not take effect unless approved
by the voters as a public question at the next general election as
provided by New Jersey Statute, and if approved, shall become effective
January 1, 2003.
The following referendum question shall be submitted
to the voters of the Borough of Caldwell at the November 5, 2002,
general election:

to establish a Length of Service Awards Program for the volunteer
firefighters that serve the Borough, pursuant to the following terms
and conditions:

by the Borough of Caldwell.

loyal, diligent and devoted services to the residents of the Borough
of Caldwell.
The LOSAP shall provide for fixed annual contributions
to a deferred-income account for each volunteer member that meets
the criteria set forth below. Such contributions shall be made in
accordance with a plan that shall be established by the Mayor and
Council of the Borough of Caldwell pursuant to P.L. 1997, C 388, and
such plan shall be administered in accordance with the laws of the
State of New Jersey, the U.S. Internal Revenue Code, and this article.
The West Essex First Aid Squad services the
municipalities of Caldwell, Fairfield, North Caldwell and West Caldwell
that have a total population of 33,255 (2000 census) and total number
of estimated calls of 2,016. The breakdown of the population and number
of calls for the municipalities serviced by the West Essex First Aid
Squad would be as follows:

The LOSAP shall provide for annual contributions
to each eligible member that meets the criteria as follows:
A. Five hundred points are required for a member to be eligible for an annual contribution (see
Schedule A).
B. Five years of service are required for vesting.
C. The annual contribution shall be 24.9% of $1,150 or
$286.35 per eligible member.
D. The cost to be budgeted annually by the Borough of
Caldwell is anticipated to be $12,600.
This article shall not take effect unless it
is approved by voters as a public question at the next general election.
