No insurance company authorized to issue fire insurance policies in this state shall pay any claims in excess of $2,500 on any real property located within the Township of Carneys Point unless or until the insured person claiming a loss orders an official certificate of search for municipal liens pursuant to N.J.S.A. 54:5-12 from the Collector of Taxes and submits to the fire insurance company said search certifying that all taxes, assessments and other municipal liens or charges levied and assessed and due and payable against said property have been paid, or the Township of Carneys Point has submitted a resolution to said insurance company pursuant to § 97-2 of this chapter.
The Township Committee of Carneys Point may enter into an agreement authorized by resolution permitting payment of delinquent taxes, liens and other assessments in installments in those cases in which the Township Committee of Carneys Point is satisfied that the claim for fire damages is to be used to restore or improve the fire-damaged property. In the aforesaid circumstances, the fire insurance company shall be authorized to make full payment of the claim to the insured person after receiving a certified copy of a resolution authorizing said installment payments.

No insurance company authorized to issue fire insurance policies in this state shall pay any claims in excess of $2,500 on any real property located within the Township of Carneys Point until one of the following conditions shall have occurred:
A. 
The insured submits to the insurance company an official certificate, to be issued by the Construction Official of Carneys Point Township, verifying that demolition is not required or that the costs of demolition have been paid.
B. 
The insurer pays the anticipated costs of demolition to the Township of Carneys Point.
C. 
The Township of Carneys Point and the owner of the fire-damaged property enter into an agreement, approved by resolution adopted by the Carneys Point Township Committee, establishing the terms and conditions of payment in full of any anticipated costs of demolition, as provided by N.J.S.A. 17:36-11.

The Construction Official for Carneys Point Township shall be authorized to issue, upon payment of a fee in the amount of $10, a certificate verifying that demolition of fire-damaged property is not required or, alternatively, that the costs of such demolition have been paid. The Construction Official may require the owner of the property to provide such documents as shall be necessary to verify payment of demolition costs.

In the event that the Carneys Point Township Committee receives funds pursuant to § 97-3B hereof, said funds shall be deposited in an interest-bearing escrow account in a state- or federally chartered bank, savings bank or savings and loan association in the State of New Jersey. Said funds shall be utilized solely for the payment of costs related to the demolition of fire-damaged property in Carneys Point Township.
