No autobus or automobile for hire, commonly called a "jitney," heretofore licensed to operate in the Township of Carneys Point, County of Salem, State of New Jersey, shall operate on the streets or roads of the Township of Carneys Point unless, within 30 days after the adoption of this chapter, the owner or owners thereof shall file with the Township Clerk an insurance policy of a company duly licensed to transact business under the insurance laws of the State of New Jersey, in the sum of $5,000, against loss from the liability imposed by law upon the autobus owner for damages on account of bodily injury or death suffered by any person or persons as a result of an accident occurring by reason of the ownership, maintenance or use of such autobus upon the public streets or roads of said Township. Such insurance policy shall provide for the payment of any final judgment recovered by any person on account of the ownership, maintenance and use of such autobus, or any fault in respect thereto, and shall be for the benefit of every person suffering loss, damage or injury as aforesaid; provided, further, that a power of attorney shall be executed and delivered to such fiscal officer concurrently with the filing of the policy hereinbefore referred to, wherein and whereby said owner shall nominate, constitute and appoint such fiscal officer as his true and lawful attorney for the purpose of acknowledging service of any process out of a court of competent jurisdiction to be served against the insured by virtue of the indemnity granted under the insurance policy filed.
No new license to operate a jitney in the Township of Carneys Point, County of Salem, State of New Jersey, shall be granted until an insurance policy as provided for in § 123-1 hereof shall be first filed with the Township Clerk.

Any person now holding a license for the operating of a jitney in the Township of Carneys Point who shall continue to operate after 30 days have elapsed after the adoption of this chapter, who fails or refuses to file the bond as herein prescribed or any other person who shall operate a jitney without having first obtained a license of the Township of Carneys Point or has failed to file the said bond shall forfeit and pay for such neglect or refusal the sum of $1,000 or be imprisoned for a term not exceeding 90 days, or both, for each offense, to be recoverable by action in the name of the Township of Carneys Point in any court of competent jurisdiction and, when collected, paid into the Township treasury.
