§ 193-24 Transferability.

[Amended 12-9-2003, effective 12-19-2003] No license shall be transferred from one location to another nor shall it be transferred from one person to another without the consent of the Commissioner of Permit and Inspection Services endorsed in writing on said license.

§ 193-25 Expiration.

[Amended 5-22-1995, effective 6-2-1995] Each license shall expire every two years on the first day of April. No license shall be issued for a part of a year at a reduced fee.

§ 193-26 Revocation.

[Amended 12-9-2003, effective 12-19-2003] Any license granted hereunder may be revoked by the Commissioner of Permit and Inspection Services in the manner provided by law.

§ 193-27 Fees.

The following annual license fees for the sale of the articles mentioned in this article are hereby fixed as provided in Chapter 175, Fees.

§ 193-28 Applicability.

A. The provisions of this article shall not apply to the sale of canned meats, canned poultry, canned fish or canned seafoods. B. The provisions of this article shall not apply to the offering for sale or the sale of live or dressed poultry within the limits of a private market, as defined in Chapter 275, Markets, of the Code, by the person who produces, raises and dresses the same, his servants or employees; provided, however, that any person so producing, raising and selling shall obtain a permit annually therefor from the Director of Licenses, in the form prescribed by said Director. All permits issued hereunder shall expire on the first day of April in each year and may be renewed.

§ 193-29 Definitions.

As used in this article, the following terms shall have these meanings:

193-29{1} COMMISSIONER OF HEALTH

COMMISSIONER OF HEALTH The Health Officer of the County of Erie.

193-29{2} CONSUMER

CONSUMER A person who secures milk, cream, skimmed milk and/or milk drinks for himself or others, but not for resale.

193-29{3} CREAM

CREAM That portion of milk containing not less than 18% of milk fat and intended for human consumption in a liquid state.

193-29{4} DAIRY

DAIRY The place where milk is produced.

193-29{5} DEALER

DEALER A person who is engaged in the business of selling milk, cream, skimmed milk and/or milk drinks.

193-29{6} MILK

MILK Lacteal secretion from one or more herbivorous animals containing not less than 3% of milk fat and not less than eleven and one-half per centum (11 1/2%) of milk solids intended for human consumption in a liquid state, except when in hermetically sealed containers.

193-29{7} MILK DRINK

MILK DRINK A liquid containing milk, cream and/or skimmed milk and intended for human consumption in a liquid state.

193-29{8} PERSON

PERSON A corporation, association, copartnership, firm or individual.

193-29{9} PLANT

PLANT The place where milk, cream, skimmed milk and/or milk drinks are received, pasteurized and/or bottled.

193-29{10} PRODUCER

PRODUCER A person who maintains animals for the purpose of obtaining milk, cream and/or skimmed milk.

193-29{11} RETAIL STORE

RETAIL STORE Any place where milk is purchased from a dealer and resold to consumers.

193-29{12} SKIMMED MILK

SKIMMED MILK That portion of milk from which the milk fat has been removed and which contains no less than eight and one-half per centum (8 1/2%) of milk solids and intended for human consumption in a liquid state.

193-29{13} TRUCKER

TRUCKER A person who is engaged in the business of transporting milk, cream and/or skimmed milk to a dealer or plant.
