§ 144-11B{1}(1) GRADE 1

(1) GRADE 1One who performs demolition on structures limited to 1 1/2 stories in height, to a maximum of 20 feet.

§ 144-11B{1}(2) GRADE 2

(2) GRADE 2One who performs demolition on structures limited to three stories in height, to a maximum of 30 feet.

§ 144-11B{1}(3) GRADE 3

(3) GRADE 3One who performs demolition on any structure.

§ 144-11B{1}(4) GRADE 4

(4) GRADE 4One who performs demolition by the use of explosives, including those who subcontract for other licensed demolition contractors or those subcontractors preparing the building for demolition by explosion.

§ 144-12 License and renewal fees.

Fees for license as a demolition contractor, and for any renewal thereof, shall be as provided in Chapter 175, Fees.

§ 144-13 Expiration of license.

All licenses shall expire each year on the 30th day of September.

§ 144-14 Suspension and revocation of license; hearings.

All persons holding a license as a demolition contractor shall be subject to the rules and proceedings contained in § 144-9 relating to suspension and revocation of licenses and to the procedures contained in § 144-10 relating to hearings and decisions on charges arising from complaints or improper conduct.

§ 144-15 Definitions.

As used in this article, the following terms shall have the meanings indicated:

144-15{1} ACTIVE LICENSE

ACTIVE LICENSE A license obtained by a person pursuant to this chapter which has neither expired nor been revoked.[Added 2-22-2011]

144-15{2} APPLICANT

APPLICANT Any person who owns or leases at least one motor vehicle used in conducting a snow removal and/or landscape business.

144-15{3} LANDSCAPE MATERIAL

LANDSCAPE MATERIAL All grass, weeds, brush, leaves, flowers, shrubs, limbs up to six inches in diameter and small stumps not to exceed 12 inches in diameter.

144-15{4} LANDSCAPER

LANDSCAPER Any person providing services of planting, trimming, cutting or removing bushes, shrubs, flowers, vegetables, trees or grass for which a contract or agreement for services has been established orally or in writing by means of an invoice, sales receipt or other competent evidence. A landscape contractor constructs, maintains, repairs, installs or subcontracts the development of landscaping systems and facilities for public and/or private gardens and other areas which are designed to aesthetically, architecturally, horticulturally or functionally improve the grounds within or surrounding a structure or a tract or plot of land. 144-15{5} MOTOR VEHICLE

MOTOR VEHICLE Any vehicle used for landscaping or snow removal purposes by a landscaper or snow remover as defined by this article.

144-15{6} PERSON

PERSON Any individual, firm, partnership, contractor, subcontractor, association or corporation for which a New York State tax identification number has been issued.

144-15{7} PRIVATE PROPERTY

PRIVATE PROPERTY All real property, improved or unimproved, owned by any municipal corporation, person or otherwise and which is not included in the definitions of "public highway" and "public place."

144-15{8} PUBLIC HIGHWAY

PUBLIC HIGHWAY Any street open to the public for its full use by all residents of the City of Buffalo.

144-15{9} PUBLIC PLACE

PUBLIC PLACE All real property available to or open to use by all residents of the City of Buffalo.

144-15{10} SNOW REMOVER

SNOW REMOVER Any person providing services of removing, dumping, heaping or plowing snow by means of a motor vehicle for which a contract or agreement for services has been established orally or in writing by means of an invoice, sales receipt or other competent evidence.

§ 144-16 License required.

A. No person who is a landscaper or snow remover shall conduct landscape or snow removal activities or remove any landscape materials or snow or transport the same through or upon any street, avenue, parkway, road, boulevard or highway within the City of Buffalo, unless he or she shall have first obtained a license from the Commissioner of Permit and Inspection Services and shall have agreed to conform to the provisions of this chapter.[Amended 12-9-2003, effective 12-19-2003] B.
