A. Applications. Applications for funding are submitted, reviewed, and recommended to Annual Town Meeting (ATM) on a once-per-year cycle, typically: (1) End of June: CPC notice seeking applications for funding. (2) End of September: application submittals due to CPC. (3) October through December: schedule and hold meetings with each applicant. (4) January: CPC votes to recommend projects to ATM. § 138-6 General evaluation criteria.
In reviewing requests for funding, the Harvard Community Preservation Committee will consider evaluation criteria, including but limited to the following: A. The leveraging capability of the grant. Can it be used to attract other funds? B. The precedent setting capability of the grant. Will it serve as a model for other projects? C. The ability of the applicant to execute the grant. Is the project feasible and does the applicant have the skills and other resources to implement it? D. Does the application fit within the restrictions of the Community Preservation Act? § 138-7 Specific criteria by category.
The CPA funds three key community interests: historic preservation, affordable housing and open space and recreation needs. A. Historic preservation. Proposals that address as many of the following criteria possible will receive preference for funding: (1) Protect, preserve, enhance, restore and/or rehabilitate historic, cultural, architectural or archaeological resources of significance, especially those that are threatened. (2) Protect, preserve, enhance, restore and/or rehabilitate Town-owned properties with features or resources of historical significance. § 138-8 Project oversight.
A. Once approved by ATM, an applicant can submit invoices and request payment from the CPF based on the funding source and the timing of fund availability; note that funds approved by ATM from the next fiscal year's CP Fund cannot be disbursed prior to July 1. B. All requests for payment of invoices must be submitted by the applicant to the Finance Department at Town Hall, and must note account number, Town Meeting date, and warrant article number for proper accounting. § 138-9 Recordkeeping.
In accordance with MGL c. 44B, § 13, the Committee shall keep a full account of all of its actions, including its recommendations and the action taken on them and records of all appropriations or expenditures made from the CPF. The Committee shall also keep records of any real property interests acquired, disposed of or improved by the Town upon its recommendations, including the names and addresses of the grantors or grantees and the nature of the consideration. All records and accounts shall be public record.
§ 138-10 Reporting requirements.
A. Committee reports. The Chairman or designee shall prepare the following documents of CPC activities: (1) CPC report for the Annual (Town) Report, to be submitted to the Town Administrator's Office no later than the first week of January. (2) Report of the CPC for the Annual Town Meeting Report to be submitted to the Town Administrator's office no later that the end of February. (3) CPC annual calendar. B. Town reports. The CPC is responsible for acknowledging the yearly CPF recap prepared by the Town Assessors Office on Bureau of Accounts Schedule A-4 form. § 138-11 Hearings.
A. The Committee will hold public informational hearings on the needs, possibilities and resources of the Town regarding community preservation possibilities and resources every five years or more frequently at the request of the Chairman to address the changing needs within the Town. B. Notice of informational hearings shall be posted in accordance with MGL c. 39, § 23B, and publicly and published in a newspaper of general circulation once in each of two successive weeks. The first such publication shall appear not less than 14 days before the day of the hearing, and a copy of the notice shall be posted in a conspicuous place in the Town Hall for a period of not less than 14 days before the date of the hearing. § 138-12 Appeals.
Any applicant who is dissatisfied with the decision of the Committee denying, denying in part or approving in part, a request for funding may seek reconsideration from the Committee. All reconsideration requests shall be made in writing to the CPC Chairman within 14 days of receiving the Committee's determination. Upon receipt of a request for reconsideration the Committee shall review the application as well as any additional information the applicant may provide at the next scheduled CPC meeting. The Committee may affirm, reverse or modify its decision. The Committee's reconsideration determination shall be in writing and shall be included in the Committee records. The Committee's decision shall be final.
§ 138-13 When effective.
These rules shall take effect upon filing in the office of the Town Clerk.

§ 140-1 Definitions.
For the purpose of this article, the words and phrases used herein shall have the following meanings except in those instances where the context clearly indicates a different meaning:
140-1{1} EMERGENCY VEHICLE
EMERGENCY VEHICLE Vehicles of the Fire Department (Fire Patrol), police vehicles, ambulances and emergency vehicles of federal, state or municipal departments.
140-1{2} FUNERAL
FUNERAL Any procession of mourners properly identified as such accompanying the remains of a human body.
140-1{3} LANE
LANE A longitudinal division of a roadway into a strip of sufficient width to accommodate the passage of a single line of vehicles.
140-1{4} OFFICER
OFFICER Any officer, any investigator, examiner or inspector of the Registry of Motor Vehicles, any constable or special officer, provided he has his badge of office displayed over his left breast and upon his outer garment.
