§ 1.07.095 Aircraft operation rules.
(a) Aircraft tie downs. (1) All aircraft not hangared shall be tied down and additionally should have the wheels chocked when remaining overnight and during inclement weather. § 1.07.096 Fueling, flammable fluids, and fire safety.
(a) Fueling aircraft. (1) All aircraft fueling, fuel equipment, and procedures will be in accordance with the most recent version of Manual 407 - “Standard for Aircraft Fuel Servicing, published by the National Fire Protection Association, 1 Batterymarch Park, Quincy MA 02169-7471, 800-344-3555, http://catalog.nfpa.org . § 1.07.097 Lease of airport property and construction on airport.
(a) Hangars and other buildings or structures owned by the city may be leased to private individuals, companies, or corporations on a monthly or yearly basis for the storage of aircraft and ancillary equipment or to conduct a commercial fixed base operation (FBO). (b) The city may lease property within the building area or other portions of the airport for the construction of hangars, buildings, lean-tos, aprons, taxiways, and auto parking lots in accordance with an approved airport master plan/airport layout plan and design guidelines. § 1.07.098 Knowledge of rules implied.
By publication and adoption of this division, all persons shall be deemed to have knowledge of its contents. However, the airport manager or his/her designee is directed to have copies of this division posted in paper or electronically, where appropriate. Copies shall be available at all times in the airport manager’s office, and copies shall be furnished to all owners and operators of aircraft based at the airport. ( Ordinance 6303 adopted 7/6/20 )
§ 1.07.099 Conflict of rules and regulations.
If and where there are conflicts in the rules and regulations prescribed herein and the FAA’s Federal Aviation Regulations (FAR), the latter shall prevail. If and where there exists a conflict between any of the rules or regulations prescribed herein and any other city rules applicable to the same area, the more stringent limitation, or requirement shall govern and prevail. § 1.07.100 Penalty for violation.
The airport manager may deny use of the airport for a period not exceeding fifteen (15) days for any person violating or refusing to comply with any of the rules or regulations prescribed herein pending a hearing by the city council. Upon such hearing, such person may be deprived of the further use of the airport and its facilities for a period of time as may appear necessary for the protection of life and property. Any violation of this division shall be a misdemeanor, and upon conviction, be punishable by a fine not exceeding two hundred dollars ($200.00), and each day a violation continues to exist shall constitute a separate offense. § 1.07.101 Severability.
If any of the provisions of this division or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this division which can be given effect without the invalid provision or application, and to this end the provisions of this division are declared to be severable. § 1.08.031 General.
(a) All lots shall be held and used in accordance with the ordinances of the city and the rules and regulations of West Hill Cemetery and West Hill Annex, now in force and hereafter adopted. (b) Lots and portions thereof shall be used as burial places for human remains and personal possessions of the deceased. (c) Lot holders shall not allow interments to be made upon their lots for a compensation, nor shall any transfer or assignment of any lot or interest therein be valid without first obtaining the consent of the superintendent of the cemetery and all bills against said lot owner are paid. § 1.08.032 Monuments.
(a) The setting of more than one (1) monument, marker, or gravestone on any single grave space is prohibited without approval from the superintendent. Flat monuments, markers and gravestones are required in the section of the cemetery known as the Memorial Section and are permitted throughout the cemetery upon prior approval of the superintendent of the cemetery. (1) Monuments planed in Annex D shall be flat or slant style (bases are permitted). Combined height shall be no higher than fourteen (14) total inches above ground. § 1.08.033 Flowers and potted plants.
(a) Fresh cut flowers, artificial flowers, wreaths, potted plants, baskets, or paper are permitted at the grave site. The city and the cemetery are not responsible for the care or safety of any items placed at a grave site. Discarded, damaged, faded, torn or unsightly items at a grave site shall be immediately removed and placed in appropriate containers. (b) No tree, shrub, bush, plant, flowers or similar items shall be planted on or around a grave or lot locations. No existing planted tree, shrub, plant, flowers or bush shall be disturbed, damaged or removed. § 1.08.034 Funerals and interments.
(a) The city requires a minimum of twenty-four (24) hours notice of intended burial before an interment can be scheduled. The notice shall be given during regular business hours (Monday– Friday, excluding holidays, 8:00 a.m.–5:00 p.m.). (b) The city requires information from the arranging BSP to include the deceased individual’s name, lot identification, date of death, date/time of burial and type of container. The city also requires that a licensed mortician certify or attest to the remains being placed in interment. § 1.08.035 Visitors.
(a) Hours of access to the cemetery shall be from sunrise to sunset. (b) All persons are prohibited from gathering flowers or breaking any tree, shrub or plant, or writing upon or desecrating any monument, fence, or other structure in or belonging to the cemetery. (c) No assemblies, other than funerals, are permitted, unless prior consent of the superintendent is obtained. (d) The possession or consumption of alcoholic beverages, including beer, wine, liquor, etc., is not permitted in any part of the cemetery grounds. (e) The legal speed for any and all vehicles shall not be in excess of ten (10) miles per hour in any part of the cemetery grounds. § 1.08.036 Penalty.
(a) A person commits an offense if the person violates any provision of sections 1.08.031 through 1.08.035 , above. An offense under these sections is a class C misdemeanor, and each day that a violation occurs is a separate offense. (b) A person who violates any provision of section 1.08.031 , is liable for a civil penalty of not less than two hundred dollars ($200.00) and not more than one thousand dollars ($1,000.00) for each day the violation continues and shall be subject to being enjoined by the city attorney from committing future violations. § 1.08.037 Sunday burials.
(a) If a body is not embalmed, or if a body is in a state of decay where it cannot be embalmed and where in the opinion of duly authorized persons such body should be interred immediately, such burial shall be permitted to take place. (b) If, in the opinion of the health officer or a practicing physician, a person has died of a communicable disease his body shall be buried immediately. § 1.08.038 Burial Service Provider (BSP) customer delinquency procedures.
(a) Payment in full is due on or before the 25th day of the month following the invoice date. (b) If the customer account has a balance that is ninety (90) days past due from the invoice date, privilege of using the city cemetery services may be discontinued. (c) A late fee of five percent (5%) will then be assessed against the unpaid balance of the BSP account not paid in full within ninety (90) days from the invoice date and the account may be referred for collection.
