Chapter 720. Vehicles and Traffic

Article III. Commercial Quadricycles

§ 720-17. License application review.

A. 
The Police Department shall review the application for compliance with this article. The Police Department may also limit the license to any period of time or route to protect the health, safety, and welfare of the citizens, and may prohibit operation of the quadricycles in areas of the City hosting festivals or special events. The Police Department may also deny an application for a license to operate a quadricycle based on potential traffic congestion and its impact of the health, safety, and welfare of the citizens. The City may assess a fee for its incremental costs associated with its review of the application.
B. 
Violations and penalties. A person who owns or operates a commercial quadricycle that is operating without a license approved by the Police Department is responsible for a civil infraction. The court in its discretion may impose the following sanctions:
(1) 
For a first violation: a civil fine of not more than $50.
(2) 
For a second or subsequent violation: a civil fine of not more than $100.
C. 
Additional sanctions. The owner of a quadricycle who does not comply with provisions of this article, or where the operator of the quadricycle violates provisions of Chapter 720 of this Code may have the license to operate a quadricycle revoked by the Police Department. The owner can appeal the decision of the Police Department to the City commission. The commission shall give the owner an opportunity to be heard at a public hearing before ruling on the appeal.
