It shall be unlawful for any owner, possessor or occupant of lands in
East Amwell Township to store or permit to be stored or placed upon said lands,
any motor vehicle of whatsoever nature so in need of repair as to render the
same incapable of being readily operated or used, except where such storage
is specifically authorized by license or other permission duly issued by the
East Amwell Township Committee, or unless the same is within a building or
not exposed to public view, excluding aerial view.
Except as to a motor vehicle temporarily disabled while traveling along
a public road or street, it shall be unlawful for any person to park or leave
standing any motor vehicle or parts thereof, so in need of repair as to render
the same incapable of being readily used on land of another or upon roads,
highways or other lands of the Township of East Amwell, without written permission
of the owner of said land or of the East Amwell Township Committee.
Upon written complaint of any five or more property owners or their
agents of this township, or upon his own motion, the Municipal Clerk, or his
designated agent, shall make an investigation of the condition complained
of and report thereon in writing to the Township Committee.
[Amended 4-12-1984 by Ord.
No. 84-02]
Upon receiving such report, if it shall appear to the Township Committee that a violation of §
132-1 or
132-2 hereof has occurred, the Township Committee or its designated agent shall direct that the owner, possessor or occupant of lands upon which such violation exists take such steps as will effectively remove said violation within a period of 45 days from the date of such notification.
At the expiration of said forty-five-day period, the Municipal Clerk,
or his agent, shall reinspect said lands and shall report to the Township
Committee whether or not the unlawful condition previously found to exist
has been abated or remedied.
If the owner, possessor or occupier shall refuse or neglect to abate
or remedy the condition constituting the violation within such period, he
shall be subject to one or more of the following: a fine not to exceed $1,000,
a term of imprisonment of not to exceed 90 days, or a period of community
service not to exceed 90 days at the direction of the Municipal Judge.
Appeals for relief from the provisions of this chapter may be made to
the Township Committee within a period of one month from the notification
of such violation as hereinabove provided, or any extension thereof, and relief
may, by resolution, be granted by said Township Committee when, in its opinion,
such relief would not be detrimental to the public interest.
