A general board composed of three discreet freeholders, who shall be residents of the Borough of Totowa, is hereby created for the purpose of making all assessments for benefits accruing from local improvements. Said Board shall be known as the "Board of Assessments of the Borough of Totowa."
The Board of Assessments shall hereafter make all assessments for benefits accruing from local improvements and incidental damages, and also, when any improvement ordinance shall require the taking of lands or real estate or any right or interest therein of any owner thereof, said Board shall make an award, for said lands or real estate or right or interest therein to be taken, to the owner or owners as provided by law.[1]

The members of said Board shall hold office during the pleasure of the Council and until their successor or successors are appointed and qualified. Vacancies on said Board shall be filled by the Mayor, with the advice and consent of the majority of the Council present and voting at such meeting.
Each member of the said Board of Assessments of the Borough of Totowa, before entering upon his duties, shall take and subscribe an oath or affirmation to faithfully, impartially and justly discharge and perform all the duties of his office as a member of said Board of Assessments, according to the best of his ability and understanding. Such oath or affirmation shall be filed with the Borough Clerk.
