A. 
The Fire Department Chief shall be elected by the membership of the Fire Department and approved by the Mayor and Council of the Borough of Totowa. To be eligible as a candidate for the position of Fire Department Chief, a member of the Fire Department shall have been an Assistant Chief for a period of two years, have completed seven years of active service as of the time of election and shall also have completed all requirements as mandated by the State of New Jersey and the federal government for this position.

B. 
The term of office of the Department Chief shall be for a period of two years, subject to §§ 43-14 and 43-15 of this chapter.
C. 
In the case of a vacancy in the office of the Department Chief for any cause whatsoever, the office shall be filled by election and approval as aforesaid, but for the unexpired term only. Elections shall be held on the fourth Tuesday of November prior to the termination of the term of office of the Department Chief.
D. 
In the case of a vacancy in the office of the Department Chief during a specified term, an election for the successor in office shall be held within the period of one month from the date when the vacancy occurs.
The Chief of the Fire Department shall be paid such salary as shall be provided in the annual Salary Ordinance.[1]

The four Assistant Fire Department Chiefs shall be elected from the membership of their respective fire company in the Fire Department: one Assistant Chief shall be elected from each fire company. To be eligible as a candidate for the position of Assistant Fire Department Chief, a member shall have been a Captain for one full year prior to being elected and must have completed all the requirements as mandated by the State of New Jersey and the federal government for this position. Said election shall be held prior to December 31 of each year with the term to which the Assistant Chief is elected commencing on January 1 of the following year. Such Assistant Chiefs shall take office following the approval of said election by the Borough Council.
