The Borough Council must create, by ordinance or resolution, any new position or office. In addition, there must be provided in the proper current budget account specific and adequate funds to compensate any appointee.
All employees, officers and department heads of the Borough shall be appointed and promoted by the Mayor, with the advice and consent of the Borough Council, except where the power to appoint or promote rests with other Borough boards or bodies as provided for by general law or ordinance.
All candidates for temporary or permanent employment by the Borough of Totowa shall be residents of the Borough and shall be citizens of the United States at the time of filing their applications and at the time of their appointment, and shall maintain such residence in the Borough during their tenure of employment, unless such requirements are specifically waived by the Borough Council.
A. 
Original appointments by the Borough Council to vacancies in the Borough service shall be based upon merit. Such factors as education, experience, aptitude, knowledge, character and physical and mental fitness shall be considered, but no inquiry will be made into the political or religious affiliation or the race of any candidate.
B. 
All other considerations being equal, preference in appointments will be given first, to resident veterans of the military service of the United States; second, to residents of the Borough of Totowa; third, to nonresident veterans; and fourth, to nonresidents.
C. 
The Borough complies with all applicable laws ensuring equal opportunities to qualified individuals with a disability by making reasonable accommodations for these individuals whenever possible in accordance with the Americans with Disabilities Act.

A. 
It is the policy of the Borough of Totowa to ensure equal employment opportunity for all persons, regardless of race, color, creed, national origin, political or religious opinions or affiliations, ancestry, age, marital status or sex or because of a physical disability that does not interfere with ability to do work required. Age shall be a valid factor for employment only where it is required for the position by law and where it is lawfully an occupational requirement.
B. 
It is the personnel objective of the Borough of Totowa to employ any person who is qualified and/or trainable for each position by virtue of job-related standards of education, training, experience and personal qualifications.
C. 
This policy shall be applied to all phases of employment, such as recruitment, selection, appointment, placement, promotion, demotion, transfer, training, wages, benefits and working conditions, and such personnel actions as layoff, recall, discharge, disciplinary action, performance evaluation and use of all facilities.
A. 
An application for employment form, obtained at the office of the Borough Clerk, must be completed by each person applying for a position with the Borough of Totowa. The application will be referred by the Borough Clerk to the Mayor and Council who will then refer the application to the Council committee responsible for the department having the particular opening.
B. 
The Council committee may conduct an interview with the applicant, investigate references and check previous employment. The Council committee shall have the applicant whom it intends to recommend for employment interviewed by the department head.
C. 
If the Council committee finds that the applicant is suitable to hire, it will request the Borough Clerk to arrange a physical examination of the applicant by a Borough-designated physician at the Borough's expense.
D. 
Following a favorable report on the physical examination, the appointment of the applicant will be referred to the Borough Council for final action, including the amount of salary to be offered.
A. 
If approved by the Council, the Borough Clerk will so notify the applicant, advise him of his starting date and arrange for him to report to his office to complete the necessary employment formalities.
B. 
The Borough Clerk will check all papers for completeness and set up a personal history file for the employee.
Each new employee shall be considered as being on trial or probation for the first six months of employment and shall be so advised when his appointment is made. He may be dismissed without explanation during or at the end of that period.
A. 
Applications may be rejected where the candidate:
(1) 
Lacks any of the established qualifications and requirements for appointment to the position for which he has applied.
(2) 
Is physically unfit to perform the duties of the position to which he seeks appointment.
(3) 
Is addicted to the habitual or excessive use of drugs or intoxicants.
(4) 
Has been convicted of any crime or disorderly persons offense involving moral turpitude or disgraceful conduct.
(5) 
Has received other than an honorable discharge from the Armed Forces of the United States and has not received a presidential pardon.
(6) 
Has been dismissed from previous employment for delinquency, insubordination or misconduct.
(7) 
Has practiced or attempted to practice any deception or fraud in his application, in his examination or in securing his eligibility for appointment.
(8) 
Is not within the age limit prescribed in the class specification or examination announcements.
B. 
Employment during a probationary period shall not be considered a waiver of such reasons.
