Licensing — See Ch. 236.
No person, firm or corporation shall engage, either directly or indirectly, in the business of a retail florist as defined in § 192-2 hereof, within the Borough of Totowa, without first having obtained a license from the Council of the Borough of Totowa so authorizing such person, firm or corporation.
As used in this chapter, the following term shall have the meaning indicated:
RETAIL FLORIST
Any person, firm or corporation engaged in the business of selling at retail any flowers, funeral sprays, wreaths, designs, corsages, potted plants or cuttings, Christmas trees or bedding plants, all of which are of natural growth.
A. 
Nothing in this chapter shall be construed as applying to a farmer or a resident of the Borough of Totowa growing and selling produce or flowers from his own premises within the Borough of Totowa.
B. 
The following organizations shall not be required to obtain licenses to sell Christmas trees or grave coverings:
(1) 
Bona fide organizations of veterans.
(2) 
Religious organizations.
(3) 
Charitable and fraternal organizations.
(4) 
Civic and service clubs.
(5) 
Officially recognized volunteer fire companies and first-aid squads.
No licensee shall sell any flower product referred to in § 192-2 hereof except from a regular established retail flower store, shop or greenhouse, nor shall cut flowers for sale be displayed to the public except in the regular course of business as a retail florist to whom a license shall have been issued hereunder, at the location at which said licensee shall operate or conduct his, her, their or its business.
A. 
Application for a license under this chapter shall be made in writing to the Borough Council of the Borough of Totowa and filed in the office of the Borough Clerk, which application shall contain the following information:
(1) 
Names or name of applicants or applicant.
(2) 
Address at which applicant or applicants intend to carry on business.
(3) 
Address of each applicant.
(4) 
Name under which applicant intends to conduct business.
(5) 
Whether licensed as a permanent or transient merchant.
B. 
Each application for a license shall be accompanied, with cash or check in the sum of $20 made payable to the order of the Borough of Totowa, which shall be returned to the applicant in the event that no license is granted. In the event that the license is granted, the fee enclosed shall be applied to the payment of the license fee.

The license fee shall be $30.

Following the filing of the initial application with the Borough Clerk, the applicant shall cause to be published, for two consecutive weeks, once a week, in a newspaper published and circulated in the Borough of Totowa, a notice of his intention to obtain a license to conduct the florist business as defined in § 192-2, and shall thereafter file proof of publication as provided herein with the Borough Clerk of the Borough of Totowa.
Every application for an initial license under this chapter shall be submitted to the Borough Council of the Borough of Totowa for approval, and no license shall be granted or issued without first having been approved by the Borough Council of the Borough of Totowa. The licenses issued hereunder may, upon payment of the license fee aforesaid and compliance with the terms of this chapter, be renewed annually; provided, however, that renewals to the holder of an expiring or expired license shall be made upon payment of the annual fee and the filing of a short form application supplied by the Borough Clerk.
No license issued under the terms of this chapter shall be transferable without the consent of the Borough Council of the Borough of Totowa.
Every license issued under this chapter shall be conspicuously displayed in the place of business conducted by the licensee.
Any license issued pursuant to this chapter may be revoked by the Borough Council of the Borough of Totowa upon proof of the violation of any of the provisions hereof or the violation of any of the laws of the State of New Jersey relative or referring to the conduct of the business licensed under this chapter.
