As used in this article, the following terms shall have the meanings indicated:
PERSONS
All individuals, partnerships, corporations, owners, tenants, lessees, occupants, associations and organizations residing, owning or operating, managing, leasing or occupying any premises or business, commercial or industrial, within the Borough of Totowa.
YARD WASTE
Consists solely of leaves for purposes of this article.
On and after the effective date of this article, it shall be mandatory for all persons, except the handicapped or disabled, to separate yard waste from all other solid waste produced in or disposed of by such residential or nonresidential purposes. Yard waste shall be bagged.
On the dates set forth in the regulations promulgated hereunder, said bags shall be placed at curbside for collection by the Borough municipal trucks or by such agents for certain designated firms specifically authorized by the Borough to make such collections.

From the time of placement at the curb by any person of yard waste for collection by the Borough of Totowa in accordance with the terms hereof, such material shall be and become the property of the Borough of Totowa or its authorizing agent, and it shall be a violation of the chapter for any person not expressly authorized by the Borough to collect or pick up or cause to be picked up any such yard waste. Each collection and violation hereof from one or more residences shall constitute the separate and distinct offense punishable as hereinafter provided.

The Department of Public Works is hereby authorized and directed to enforce this article and to establish a reasonable schedule or regulations as to the manner, days and times for the collection of yard waste in accordance with the terms of this article.
Except as otherwise permitted, it shall be unlawful for any person unauthorized by the Borough of Totowa to collect, pick up or cause to be collected or picked up the yard waste. Each collection or pickup shall constitute a separate and distinct offense punishable as herein provided. A violation of or negligent failure to comply with the provisions of this article may be punishable by a fine of $25 for the first offense, which may be paid in writing, and for all other offenses by a fine not to exceed $200 per violation. There shall not be any enforcement of this article until six months after the effective date of this article.
Yard wastes shall be stored in a location designated by and monitored by the Department of Public Works. Residents of the Borough of Totowa may avail themselves of this compost material at their convenience in whatever quantities they desire. Transportation of this compost from the site will be the resident's responsibility.
The penalties for failure to comply with the provisions of this article, both separation and collection, will commence six months after the effective date of this article. During the six-month period, every effort will be made to acquaint all affected residents of the need for and the requirements of the legislation; further, new residents to the municipality will be informed of the provisions of this article by the Department of Public Works at the time of issuance of a certificate of occupancy on their dwelling.
