It is the purpose of this article:
A. 
To prevent the destruction and deterioration of those roads which are used by trucks which carry heavy loads and/or materials;
B. 
To provide funds for the repair and maintenance of such roads; and
C. 
To allocate the cost of repairing and maintaining roads which are used by trucks carrying heavy loads and/or heavy vehicles according to the damage so caused by said vehicles and/or operations.
This article and/or amendment thereto shall apply to:
A. 
Any vehicle that travels over Township roads or roads maintained by the Township that possesses a gross vehicle weight rating of greater than 20,000 pounds, regardless of the nature of the load or item(s) being hauled.
B. 
Any vehicle which has a combined vehicle weight and load weight in excess of the weight limit established for the specific road as specified herein.
Each vehicle which is subject to this article shall comply with the following in addition to the other terms and conditions contained in the original ordinance and/or amendment thereto which are not otherwise specifically excused hereby;
A. 
Each vehicle shall bear a card, sticker or document issued by the municipality indicating that the truck which is transporting material possesses a valid permit from the Township which was acquired or obtained pursuant to this article and/or any amendments thereto; and
B. 
Each owner and operator of said vehicle shall comply with all applicable state and federal rules and regulations pertaining to the use, ownership, maintenance and operation of said vehicle.
Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus all costs of prosecution, including, but not limited to, attorneys' fees, and in default of payment thereof, shall be imprisoned for a term not to exceed 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. All fines and penalties collected for the violation of this article shall be paid to the Township Treasurer.

Attached hereto and made a part hereof is a copy of the engineering report pertaining to Township roads, portions thereof and weight restrictions.[1]

B. 
Said designation of roads and/or portions thereof, together with weight restrictions, are hereby enacted as pertains to the limitations and/or requirements for operation on Township roads and/or roads maintained by the Township.
C. 
Upon receipt by the Township of any additional or new engineering study as pertains to a change or changes in the limitations for Township roads and/or portions thereof and/or weight limits referred to in previously accepted engineering report and/or the designation of additional areas and/or roads, the Township may by resolution accept said additional engineering study or studies, and the same shall thereafter be a part of this amendment to ordinance and/or ordinance as if originally enacted hereby.
