This chapter shall be known as the "Planning Board Membership Law for the Town of Niles."
This chapter is enacted pursuant to Article 2 of the Municipal Home Rule Law of the State of New York.
It is the intent of this chapter to set the terms of office and the designation of the Chairperson of the Planning Board.

The membership of the Planning Board for the Town of Niles shall be chosen by the Town Board at its organizational meeting in January or at some other time during the calendar year as the Town Board deems necessary. The Planning Board shall consist of five members who are residents of the town. The first person chosen shall serve an initial term of one year. The second and third persons chosen shall serve initial terms of two years each. The fourth and fifth persons chosen shall serve initial terms of three years each. The sixth and seventh persons chosen shall serve initial terms of four years each. Thereafter, all terms shall be for four years. The Town Board may appoint no more than two alternate members of the Planning Board who shall each serve a four-year term.
Each year the Town Board of the Town of Niles shall choose a person(s) to fill the position(s) on the Planning Board for those member(s) whose term(s) have expired or whose position(s) have become vacant.
The Town Board of the Town of Niles shall appoint annually from the membership of the Planning Board the person who shall serve for the calendar year as its Chairperson.

This chapter shall supersede Town Law § 271 as far as establishing the terms of office for each of the five positions on the Planning Board.
