Charges for water service and water supplied shall be billed quarterly to the property owner. Such bills are due and payable upon presentation and represent charges for water services and water supplied for the previous quarter. Payments shall be made to the Highland Water District and shall be made at the office of the Town Clerk of the Town of Lloyd, 12 Church Street, Highland, New York 12528.

In the event that any charges shall be unpaid for 30 days from the date of the billing thereof, a penalty in the amount of 10% of the charges thereon stated shall be added thereto.

Unpaid charges for water service and water shall constitute a lien upon the real property benefited and may, in the discretion of the Town Board, be levied upon such real property in the manner set forth in § 198(3)(d) of the Town Law. In addition, the Town Board, as Commissioners of the Highland Water and Sewer Districts, by a civil action brought by the Supervisor, may sue in the Town Justice Court or any other state or federal court with jurisdiction over the consumer for all amounts owed, along with a reasonable attorney's fee in addition to costs and disbursements, for all amounts due, either separately for amounts due the Highland Water District or in an action for amounts due for both water and sewer usage. The water service to the premises may also be discontinued for nonpayment of amounts billed, in addition to the reasons set forth in § 98-11.
