The current special assessments for streetlighting
in Section B of the Ridge Run subdivision tract imposed under authority
of Village resolution dated on or about February 13, 1990, shall be
abolished and converted into benefit district charges as provided
herein.
The 17 lots having frontage on Lamplighter Lane and
embraced within the Village subdivision commonly known as "Ridge Run
Section B," as designated in a certain final subdivision map prepared
by Jack W. Cottrell, last dated and revised on August 19, 1985, entitled
"Section B Amended Ridge Run," as filed with the Onondaga County Clerk
on November 22, 1985, as Map No. 6377, shall constitute and be designated
as Benefit District No. 1 within the Village.
The Village, through its Planning Board subdivision
approval process, has previously approved the location and installation
of three one-hundred-seventy-five-watt mercury vapor streetlights
and associated facilities on Lamplighter Lane, at the locations shown
on the Ridge Run Section B U.R.D. Niagara Mohawk Power Corporation
lighting location plan ("NIMO plan"). Two of the aforesaid streetlights
have been installed to date, and the installation of a fourth streetlight
is optional at the location shown on the approved NIMO plan.
The Niagara Mohawk Power Corporation ("NIMO") shall
at all times, own, maintain and operate said streetlighting equipment
and facilities within Benefit District No. 1.
The Village shall pay NIMO for streetlighting services
within Ridge Run as provided in accordance with the standard streetlighting
rates Service Classification No. 2 charged by NIMO on an annual basis,
subject to rate increases in the event that the streetlights and associated
facilities are removed before the year 2005.
The Board of Trustees of the Village shall cause the
annual cost for NIMO streetlighting charges for Benefit District No.
1 (including but not limited to installation, annual cost and fuel
maintenance fees) to be assessed annually and shared equally by said
17 property lots within Benefit District No. 1.
The Board of Trustees of the Village hereby reserves
the right, by resolution without the necessity of a public hearing,
to modify Benefit District No. 1 herein created by adding new property
or territory to it, by eliminating from it any or all property or
territory which is included within it or by disestablishing the same
Benefit District No. 1 in its entirety.
