As used in this chapter, the following terms shall have the meanings
indicated:
PERMANENTLY DISABLED DRIVER
A person with so seriously impaired mobility as to prevent that person
from walking without the assistance of an artificial device.
In the event that any disabled or handicapped resident of the Village
of Massapequa Park makes application to the Board of Trustees for exemption
from the terms and provisions of Local Law No. 15 of 1975 on the grounds of undue hardship, the Board of Trustees is authorized
to review written medical or other written documentation on an annual or earlier
basis, as the Board of Trustees shall decide, proving to the satisfaction
of the Board of Trustees that the operation and enforcement of Local Law No.
15 of 1975 would result in an undue hardship and burden to said disabled or
handicapped resident.
The Board of Trustees shall have the discretion to grant such annual
exemptions (on January 1) to Local Law No. 15 of 1975 after reviewing all
of said written evidence annually and to issue a special permit acknowledging
such exemption to a disabled or handicapped resident, which special permit
shall only be valid in a residential area and only in front of the disabled
or handicapped resident's real property or residence.
A special permit shall be permanently attached to the visor of said
motor vehicle being exempted from the operation of Local Law No. 15 of 1975
owned and/or operated by the disabled or handicapped resident, and such permit
shall be clearly visible at all times to any authorized person inspecting
said motor vehicle while said motor vehicle is parked on the
village street in front of the applicable real property or residence.
A sign shall be posted and affixed by the village in front of said real
property or residence of the disabled or handicapped resident indicating that
there is a special permit relating to parking on the village street for such
disabled or handicapped resident.
The Board of Trustees shall have the authority at any time, upon sufficient
evidence to the satisfaction of the Board, to revoke or suspend said special
permit for any disabled or handicapped resident.
The Board of Trustees may from time to time by resolution set aside
public places, municipal parking fields, streets or portions of streets within
the Incorporated Village of Massapequa Park as parking spaces for motor vehicles
for the sole and exclusive use by holders of valid physically disabled drivers'
parking permits issued by the Village of Massapequa Park.
The Board of Trustees shall have the sole and exclusive discretion to
determine if a person is entitled under the provisions of this chapter.
The Board of Trustees shall have the discretion to renew all applications
from time to time after a review of the written evidence pertaining thereto.
