This article shall be known and may be cited as the "Park and
Public Property Ordinance of 2010."
For the purpose and within the meaning of this article, the
following definitions shall pertain:
AUTHORIZED REPRESENTATIVE
The Township Manager or other employees or officials authorized
by the Board of Supervisors of the Township to administer and enforce
the provisions of this article.
PARK
Parks, park reservations, playgrounds, recreation centers,
swimming pools, golf courses, watersheds and all other areas of the
Township of East Hempfield devoted to active or passive recreation
by the public within the Township of East Hempfield.
PUBLIC PROPERTY
All other lands owned by the Township of East Hempfield and
devoted to uses other than those listed above.
TOWNSHIP
The Township of East Hempfield.
All public parks and playgrounds owned, operated, maintained
or supported by the Township of East Hempfield shall be closed between
the hours of sunset and sunrise. No person, other than authorized
supervisors, police, guards, or similar personnel, shall occupy, frequent
or use the parks and playgrounds between such hours, except when such
parks and playgrounds are being used for special events, entertainments,
athletic contests or similar affairs which have been authorized. In
such cases, the closing time of the park and playground where such
event is being held shall be 1/2 hour after the event has ended, but
no later than 12:00 midnight.
Any person who shall violate or fail to comply with the provisions
of this article or any regulations adopted by the Board thereunder
is guilty of a summary offense and upon conviction thereof shall before
a District Justice be sentenced to pay a fine of not less than $25
nor more than $300, together with costs of prosecution, and in default
of payment thereof shall be imprisoned for not more than 30 days.
This article shall become effective five days after adoption.
This article is intended as a modification and general restatement
of Ordinance No. 093-5, adopted December 29, 1993. Such ordinance
is repealed only to the extent that this article materially differs
from Ordinance 093-5.
