No animals other than domesticated household pets shall be kept within the Borough of New Wilmington, Lawrence County, Pennsylvania.
A. 
"Domesticated household pets" are defined as those animals that it is not unusual to find not only in a residence occupied by human beings but permanently staying within such home except for periods of exercise when the same may be allowed out of doors.
B. 
Domesticated household pets, although of a kind that can be kept permanently indoors (except for periods of exercise as set forth above in Subsection A), may be kept outside of the residence but on the same premises as the residence, provided that the keeping of such domesticated household pet outside of the residence is confined to the premises and does not lead to offensive sounds, sights or odors or other conditions generally regarded as a nuisance to neighbors or persons using the public ways, streets and sidewalks on the premises.

C. 
A domesticated household pet, when taken from the residential premises where it resides, must be on a leash or similar restraint, and the owner and the person taking the domesticated household pet from the premises are each separately and collectively responsible for the domesticated household pet's behavior so that such behavior will not be offensive, create fear, or cause damage to property, or otherwise become a nuisance, and includes the immediate clean up and removal of any excrement from the animal.

D. 
Animals not household pets, although not permitted to be kept inside the borough, may be brought into the borough on a temporary basis for purposes of work (such as draft or riding horses being driven or ridden into the borough), treatment (such as visits to a veterinarian's office), sale, display, competition or other similar temporary use, which temporary use is not otherwise prohibited under any other ordinance; provided, always, that such animals when temporarily brought into the borough are brought into the borough in connection with such temporary use which requires their presence in the borough and such animals are not kept overnight inside the borough unless required by such temporary use inside the borough and, in such event, with permission having been specifically given by the Mayor or his delegate.

Any person who shall violate or fail to comply with any of the provisions of this article shall, upon conviction thereof before the District Justice, be punishable by a fine not exceeding $600, plus costs of prosecution for each offense. Each day that any such violation or failure to comply shall continue shall constitute a separate violation of this article. In the enforcement of this article, more than one violation may be alleged in one action.
