Authorizing the execution of a contract with the New Wilmington Swimming Association, to lease with an option to purchase, the swimming pool and equipment of said Association, and providing for submission of the question of such leasing to the electors of said Borough. (Ordinance 165, September 4, 1934) (A referendum was to be held November 6, 1934, on the question of an 11-year lease beginning January 1, 1935, at an annual rental of $700, the lease to be subject to a 90-day notice by the Borough to terminate in any year. The swimming pool was purchased by the Borough in 1936.)

Authorizing a contract between the Borough of New Wilmington, Lawrence County, Pennsylvania, and Pennsylvania Power Company, its successors and assigns, for the purchase of electric service from said company for the Borough's own use and resale at retail, subject to the company's reservation to serve certain premises in the Borough as specified in the contract. (Ordinance 279, June 20, 1966) (This contract was for 10 years.)

The amendments made by this ordinance affected the provisions of the appropriation and annual tax for redemption of the bonds and for sinking fund purposes.

Providing for the increase of the indebtedness of the Borough of New Wilmington, Lawrence County, Pennsylvania, and authorizing and directing the issuance of general obligation coupon, serial bonds of the said municipality, in the amount of twenty-seven thousand ($27,000) dollars, in sums of one thousand ($1,000) dollars each; for the following purposes, to wit: for the erecting and construction of a Municipal Building for the housing of Borough offices and the New Wilmington Volunteer Fire Department; approving the form of bond and coupon; providing for the rate of interest on said bonds and fixing the maturity dates thereof; stating the estimated period of usefulness of the property and collection of a tax to pay the interest covenanted to be paid thereon and the principal thereof at maturity; directing Howard W. Rodgers, and Thomas V. Mansell, being respectively the Burgess and Borough Secretary, to prepare, verify and, file with the Department of Internal Affairs certified copies of the necessary proceedings. 3-24.
(1) Authorizing, directing and providing for the incurring of non-electoral indebtedness of the Borough in the aggregate principal amount of $1,500,000, to be evidenced by (a) $250,000 principal amount of the Borough's General Obligation Note, Series of 1978, to be issued for the purpose of providing funds on a permanent basis to pay that part of the cost of the project not payable from government construction grants and anticipated investment earnings, and (b) $1,500,000 principal amount of the Borough's General Obligation Note, Issue of 1978, to be issued to provide temporarily for construction costs payments pending receipt of reimbursement from governmental grants; (2) authorizing the preparation and filing of debt statement, a borrowing base certificate, and a request for approval of proceedings for incurring non-electoral debt by issuing such notes; (3) describing the project and approving the estimate cost of the initial construction program of the project; (4) setting forth the useful life of the project; (5) providing for the designation, interest rates, redemption provisions, place of payment, and form of said notes; (6) covenanting to pay the principal and interest and providing for maturities with respect to said General Obligation Notes; (7) establishing a sinking fund for the project, to include, among others, debt service accounts for the notes to pay the principal and interest with respect to the notes, and a construction account for holding and disbursing proceeds from the notes and governmental construction grants; (8) authorizing a contract with a bank for services as the sinking fund depository for the project and paying agent for the notes; (9) authorizing and accepting the private sale proposals for the said notes, awarding the said notes to the purchasers thereof at the prices set forth and authorizing execution and delivery of said notes; (10) providing said notes are general obligation nonelectoral debt and issued within applicable legal limitations; (11) appointing consulting engineer and legal solicitor for the initial construction program of the project; (12) authorizing and directing Borough officers to advertise the ordinance, and to do and perform all other necessary acts in connection with issuing such notes or any similar additional notes. (Ordinance 359, August 15, 1978) (The project referred to is upgrading of sewage treatment facilities in cooperation with State and federal environmental protection agencies.)
3-25.
(1) Authorizing the incurring of non-electoral indebtedness of the Borough of New Wilmington in the aggregate principal amount of $350,000, to be evidenced by a General Obligation Note of $350,000, to be issued for the purpose of providing funds to repay indebtedness (Issue of 1978) incurred to finance part of the construction costs of the project; (2) defining the project as the upgrading of the Borough's sewer treatment facilities, including waste water treatment plant additions, intercepting and collecting sewers, inspection and repair thereof, and other improvements to the sewerage system, and stating the outstanding balance of the indebtedness incurred for the construction of the project to be $350,000 or less; (3) setting forth the useful life of the project as 40 years; (4) stating the indebtedness evidenced by a General Obligation Note in the principal amount of $350,000, designated as "issue of 1979"; (5) defining the indebtedness as non-electoral debt; (6) authorizing the proper officers of the Borough (which designation may be changed) to prepare, certify, and file the debt statement, the borrowing base certificate, a request for approval of proceedings for incurring non-electoral debt by issuing notes, to execute and deliver the notes to the purchaser and receive payment therefor on behalf of the Borough, and to take all other necessary action, provided the note is as shown in exhibit "A" and dated as of delivery date and the Department of Community Affairs has approved the proceedings; (7) stating the note is to be a General Obligation Note, covenanting to include in the Borough's annual budget the amount of debt service on the note, to appropriate sums from general revenues to pay such debt service, to pay the principal and interest on the note at the dates and places and in the manner stated in the note, and pledging the Borough's full faith credit and taxing power; (8) setting forth the designation of the note, its interest rates, dates of payment of interest, dates and amounts of payment of principal, redemption provisions, place of payment and form of said note; (9) creating a sinking fund, designating the sinking fund depository, and authorizing and directing the proper Borough officers to contract with the sinking fund depository; (10) authorizing and accepting the private sale proposal for the note and awarding the note to the purchaser thereof at par; (11) designating that the proceeds of the note are to be deposited with the sinking fund depository and restricting the use of the proceeds solely to the repayment of indebtedness incurred in paying the construction cost of the project or in reducing the indebtedness of the within note; (12) confirming the designation of the consulting engineer and the solicitor; (13) authorizing and directing Borough officers to advertise the ordinance; (14) authorizing and directing the proper officers of the Borough to do all further acts and things in order properly to issue the note and fulfill the intent of the ordinance; (15) providing that upon payment of the note, Issue of 1978, Ordinance no. 359 of 1978 shall be of no further force and effect, and providing for the repeal of all other ordinances insofar as they conflict with the within ordinance. (Ordinance 53, January 6, 1910) (The land was located in Wilmington Township adjoining the east Borough line.

Granting to the Quality Tool Company, its successors and assigns, the right to use certain land belonging to the Borough of New Wilmington for manufacturing purposes, for a period of ten years, together with the option of purchasing same at the end of said period at a certain price, provided said land is used by the Quality Tool Company, or its successors or assigns, for manufacturing purposes during said ten years. (Ordinance 124, December 11, 1924) (This refers to property along the Sharpsville Railroad; the Borough granted the Company the right to lay a water line and to use a 20-foot right of way over other Borough property north of this land, to be used in common with the Borough, for water, gas or electric lines. The Company, authorized to purchase the land or any part of it for not more than $100 an acre, did eventually purchase the land.)

The McClure Run sewer, beginning at New Castle Street and Water Street, running westwardly on Water Street to an unnamed street separating the lands of William Bennett and those of T. S. McAntis, thence southwardly along the unnamed street for approximately 780 feet, thence through a private right of way following more or less closely the channel of McClure's Run, to the east Borough line.

The Water Street sewer, beginning at New Castle Street and Water Street and extending eastwardly along Water Street to a point approximately 300 feet east of Oak Alley; thence by a private right of way to join the McClure Run sewer at a point about 240 feet east of the Sharpsville Railway.

Note: The ordinances listed below were superseded and probably repealed by implication by the present zoning ordinance, Ordinance 275. (See Chapter XXV.) These ordinances are still of interest, however, because it may be necessary to consult them in order to determine whether certain uses of land and buildings, not lawful under the present zoning ordinance, are lawful nonconforming uses because of having been permitted by these ordinances or because of having been established prior to the effective date of these ordinances.
