[Sec. 2-1.1 of the Revised General Ordinances]
The Administrator shall:
A. 
Serve as the personnel officer, having authority to hire, transfer, promote, demote and discharge employees;
B. 
Serve as purchasing agent of the Borough unless or until the Borough Council shall authorize the appointment of a purchasing agent; and
C. 
Under the supervision and control of the Borough Council:
(1) 
Represent the Borough and assess its proper interest in relation to this state and other political subdivisions and with respect to municipal contracts and franchises.
(2) 
Attend all meetings of the Borough Council with the right to take part in the discussions but without the right to vote.
(3) 
Keep the Borough Council advised of the financial condition of the Borough, make reports to the Borough Council as requested by it, and at least once a year, make an annual report on the government for the benefit of the Borough Council and the public.
(4) 
Study the governmental and administrative operations and needs of the municipal government and prepare and recommend to the Borough Council necessary and desirable plans and programs to meet present and foreseeable needs.
(5) 
Investigate, any time he deems desirable, the affairs of any officer or department of the Borough, with the right to take corrective action.
(6) 
Receive and reply to inquiries and complaints concerning Borough business, provide information and assistance and remedy and/or cause to be remedied the source of any just complaint.
[Sec. 2-1.2 of the Revised General Ordinances]
The Administrator shall:
A. 
Direct and supervise the administration of all departments and offices of the Borough, and except as provided by law, the Administrator shall be in charge of all the departments, offices and employees of the Borough and is to be in charge of and responsible for the smooth and efficient operation of the activities of the Borough on a day-to-day basis. The Administrator reports directly to the Mayor and Council.
B. 
Approve all bills and vouchers for payment prior to final approval by the Borough Council.
C. 
Maintain a continuing review of analysis of budget operations, work programs, and costs of municipal services.
D. 
Establish working, personnel, vacation and sick leave schedules and appropriate records and reports.
E. 
Recommend concerning the nature and location of public improvements, and coordinate and expedite the execution of public improvements authorized by the Borough Council.
F. 
Recommend, implement and enforce the procedures and policy of the Borough Council and its departments for the coordination, compiling, editing and prompt dissemination and release of public information.
G. 
Negotiate contracts for the Borough as authorized by and subject to the approval of the Borough Council.
H. 
Ensure that all terms and conditions favoring the Borough in any statute or contract are faithfully kept and performed and, upon knowledge of any violation, call the same to the attention of the Borough Council.
[Sec. 2-1.3 of the Revised General Ordinances]
The Administrator shall submit to the Mayor and Council the annual budget for the calendar year no later than January 25 of said year. The Administrator shall control the expenditure programs of each department and office through the application of work programs and periodic allotments of budget appropriations. No department or office shall incur any expenditure in excess of the amount so allocated. Whenever it shall appear to the Administrator that the amount appropriated for any department or any purpose within a department is in excess of the amount required to be authorized by the budget, the Administrator may, by administrative order with the approval of the Borough Council, reduce the amount available for expenditure by any department during the remainder of any year.
[Sec. 2-1.4 of the Revised General Ordinances]
The Administrator shall be the custodian of all official surety bonds furnished by or on account of any Borough office or officer or employee, except his own bond which shall be placed in the custody of the Borough Chief Financial Office; all insurance polices with respect to risks insured for the benefit of the Borough or to protect it against any claim, demand or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the Borough may be a party. The Administrator shall also have custody of all leases of property owned by the Borough. The Administrator shall be the depository for and have custody of all performance bonds running to the Borough as obligee and other forms of non-cash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Borough.
[Sec. 2-1.5a - h and j of the Revised General Ordinances]
A. 
In accordance with N.J.S.A. 40A:9-133, there shall be established a Municipal Clerk of the Borough of Wharton whose duties shall include the following:
(1) 
Ensure that the minutes and records of the proceedings of the Borough Council are kept.
(2) 
Preserve and compile all ordinances and resolutions, and at the close of each year, with the advice and assistance of the Borough Administrator and the Borough Attorney, the Clerk shall compile, codify and bind all the ordinances then in effect and shall properly index each compilation or codification.
(3) 
Have and take custody of all the official books, papers and documents of the Borough for which no other repository is provided by law and preserve and keep them safely.
(4) 
Perform all the functions required of municipal clerks concerning general and special elections.
(5) 
Perform functions as are vested in borough clerks by law relating to bingo and raffle licensing.
B. 
The Clerk shall cause the Borough Seal to be affixed to instruments and writings when specifically authorized by law or when necessary to exemplify any document or record in his office or to certify any act or paper which from the records in his office shall appear to be a true copy of any public record or proceeding.
C. 
The Clerk shall ensure the publication of all ordinances in the official newspaper or newspapers as may be required by law and authorized by the Borough Council and shall file in his office the affidavits of publication of the publications.
D. 
The Clerk shall administer regularly licenses pursuant to the ordinance and law, with the assistance of any appropriate enforcing agencies required for the administration.
E. 
Raffle and bingo licensing. The Borough Clerk of the Borough of Wharton is hereby authorized and delegated to approve the granting of raffle and bingo licenses to be held in the Borough of Wharton.

[Sec. 2-1.6 of the Revised General Ordinances]
In accordance with N.J.S.A. 40A:9-135, there shall be a Deputy Clerk of the Borough whose duties shall be prescribed and defined by the Administrator and/or the Mayor and Council.
