A. 
It shall be the responsibility of the Director of the Department of Public Works to supervise the provisions of this Part 1.
B. 
It shall be the responsibility of the County Executive to ensure the enforcement of the provisions of this Part 1.
C. 
The Department of Health shall act in an advisory capacity to the Director of the Department of Public Works and the County Executive in the supervision and enforcement of the provisions of this Part 1.
A. 
It shall be the responsibility of the Department of Public Works to:
(1) 
Supervise the execution of all laws, rules and regulations pertaining to solid waste management.
(2) 
Promulgate reasonable standards, regulations, rules and procedures pertaining to solid waste management within the authority of the provisions of this Part 1.
(3) 
Revise, amend and repeal such standards, regulations, rules and procedures as necessary.
(4) 
License all services pertaining to the transfer, treatment and disposal of all solid waste except as specifically excluded herein.
(5) 
Investigate all violations and grievances reported.
(6) 
Initiate action against any licensee for forfeiture or suspension of a license for good cause.
(7) 
Receive and investigate license applications and to approve or deny issuance of licenses to perform services regulated by this Part 1.
B. 
It shall be the responsibility of the County Executive to:
(1) 
Suspend the license of any licensee found to be in violation of the provisions of this Part 1 until said violations cease or have been corrected to the satisfaction of the Director of the Department of Public Works.
(2) 
Issue notices and citations of violations of this Part 1.
(3) 
Direct the County Attorney to institute necessary proceedings to prosecute violations of this Part 1.
A. 
Nothing in this Part 1 shall be construed to supersede the minimum standards in any New York State or federal law or code relative to the performance or operation of any vehicle, equipment or process which shall govern when and where any provision of this Part 1 is found to be inconsistent with said minimum standards.
B. 
This Part 1 seeks, amongst other things, to provide a coordinated county-wide program of solid waste management in cooperation with federal, state, regional and local agencies responsible for the prevention, control or abatement of air, water and ground pollution.
C. 
This Part 1 is not intended to modify or alter the terms and conditions set forth in two municipal cooperation agreements between the County of Monroe and the City of Rochester dated February 25, 1975, and September 3, 1975, respectively.
A. 
An Advisory Council is hereby established and shall consist of 11 persons, all of whom shall be appointed by the President of the Monroe County Legislature. The Council shall be composed of the following membership: one member from each of the following: County Legislature; Department of Public Works; Department of Health; two members nominated by the City Manager of the City of Rochester; three members in the refuse business licensed to operate within Monroe County; and three members from the general public who are not elected officials.
B. 
All members of the Advisory Council shall serve for three-year terms, with the exception of the County Legislator, who shall serve a term of two years.
C. 
The Solid Waste Management Advisory Council members shall receive no remuneration for their services.
D. 
The Advisory Council shall establish such rules and regulations as it deems necessary to govern its proceedings.
E. 
The Advisory Council shall meet at intervals not to exceed six months to review the Monroe County Solid Waste Management Program.
F. 
The Advisory Council shall make recommendations to the Department of Public Works and the County Legislature for the improvement and implementation of the Monroe County Solid Waste Management Program.
G. 
The Advisory Council may review the proceedings of a denial, suspension or revocation hearing referred to it by either the Director, County Executive or the applicant. In the event that the Council undertakes such review, it shall review the particular proceedings and render a decision within 60 days.
H. 
The Advisory Council may hear grievances referred to it either by the Director, County Executive or licensee and may make appropriate recommendations with respect thereto.
