All plumbing, heating and central air-conditioning
work shall be performed by or under the direct supervision of a plumber
and/or heating and air-conditioning contractor duly licensed by and/or
qualified to work in the Town of North Hempstead. The plumber and/or
heating and air-conditioning contractor having such supervision of
the work to be done shall be directly and personally responsible for
compliance with this Article, even though he does not personally perform
the work.
No plumbing, heating or air-conditioning work
of any kind shall be performed unless a written application, describing
the proposed work in detail, has been submitted to the Building Inspector
and/or the Village Clerk, unless the required fee has been paid, unless
the provisions of this chapter have otherwise been complied with and
unless a permit therefor shall have been issued by the Building Inspector.
The application shall be in the form prescribed by the Village Board.

A. Residential zones; location. No central air-conditioning
condenser for use in a one-family residential dwelling shall be installed
or situated at an exterior location on the premises unless it shall
be in a rear or side yard. In the Residential A District such condenser
shall be installed at least 15 feet from any such side or rear property
line; in the Residential B District, such condenser shall be installed
at least 13 feet from any such side property line and at least 20
feet from any such rear property line.
B. Prohibited noise levels. No condenser shall be installed
which shall have a noise level in excess of the maximum sound rating
number (SRN) established by the Air Conditioning and Refrigeration
Institute (ARI) for the tonnage of such unit. The maximum size of
any air-conditioning condenser permitted under this chapter for one-family
residential dwelling use shall be five tons; in no event shall any
condenser have a noise level in excess of SRN 20.
C. Residential zones; screening. Every condenser that
shall be installed at an exterior location on a one-family residential
dwelling shall be screened from view by evergreen plantings at least
four feet high, spaced not more than three feet apart on all exposed
sides of the unit. Such planting shall be of Canadian hemlock or such
other similar evergreen variety and form compatible for use for the
purposes of screening. Every application for a permit to install central
air-conditioning shall indicate thereon the form, nature and method
of screening to be used.
D. Other zones; location and screening. In the Commercial
and Apartment Zones, every exterior central air-conditioning condenser
shall be located on the main roof of the building in which the unit
is installed. All such roof-mounted units shall be located as near
as possible to the geometric center of the roof and shall be screened
on all sides from public view by a permanent durable wood or metal
enclosure that totally obscures the unit from public view. Such enclosure
shall be maintained to preserve its purpose and shall not be removed
except for service or replacement of the screen or of the unit. Every
application for a permit to install roof-mounted equipment shall specify
the exact location at which the equipment will be installed and a
detailed specification of the proposed enclosure.
E. Remedy of defects. In the event that any air-conditioning
unit, regardless of location, at any time, produces or reaches a noise
level proscribed by this section, the owner or other person in control
of the premises shall cure such violation within 15 days after written
notice of such violation. Upon the failure by such person to effect
such noise reduction, the Village Board of Trustees may require removal
of the offending unit, together with such other action as it may deem
necessary to enforce compliance, and nothing herein contained shall
be deemed to preclude any other remedy available to the Trustees,
or the imposition of any fine by a court of competent jurisdiction
after due process of law.
F. New structures; ducts. Every one-family residential
structure, the erection of which is commenced after the date of adoption
of this section, shall have erected, installed and constructed within
it air-conditioning ductwork sufficient to provide adequate air-conditioning
from a central system of air-conditioning for the structure. Such
ductwork shall be required notwithstanding that a central air-conditioning
system is not included in the then existing plans for the structure.
G. General standards. In addition to the foregoing, every
condenser shall be installed on a six-inch reinforced concrete slab
or a two-and-one-half-inch reinforced pre-cast slab; no exposed pipes
or electric wires shall be visible on the exterior of any building;
all interior wiring shall be armored cable (BX) or pipe conduit; unit
fan blades shall be enclosed by a safety guard; an approved exterior
switch shall be installed near the unit; every air handler shall be
installed in the attic, hung from rafters using approved metal strips;
air ducts shall be metal of a minimum 26 gauge; a certified statement
from a professional engineer or registered architect shall be submitted
with the application to the effect that the installation meets all
requirements of the New York State Energy Conservation Construction
Code.
Applications for water, sewer and sprinkler
connections shall be made in accordance with the requirements of the
Manhasset-Lakeville Water District and the Belgrave Sewer District,
or their successors, and the required fees shall be paid to said districts.
Copies of said application and the forms filed with said districts
shall also be filed simultaneously with the Village Clerk, together
with any Village-prescribed fee.

All buildings and structures shall provide for
adequate drainage of waters from rain, snow and other precipitation
by providing gutters and leaders or the like, which facility for drainage
shall be connected to dry wells, and no such gutter, leader or other
drainage facility shall be suffered to release water or other spillage
in any manner other than into dry wells.
