A. 
Unless the context specifically indicates otherwise, the meaning of terms used in this chapter shall be as follows:
ASTM
The American Society for Testing and Materials.
AWWA
The American Water Works Association.
BIOCHEMICAL OXYGEN DEMAND (BOD)
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedures in five days at 20° C., expressed in milligrams per liter. The laboratory determinations shall be made in accordance with the latest edition of Standard Methods.
BOARD
The Town Board of the town.
BUILDER
Any person, persons or corporation who undertakes to construct, either under contract or for resale, any habitable building.
BUILDING DRAIN
That part of the lowest piping of a drainage system which receives the discharge of wastewater drainage pipes inside the walls of the building and conveys such discharges to the building sewer; the building drain shall be considered to extend five feet outside the building wall.
BUILDING SEWER
That part of the drainage system which extends from the end of the building drain and conveys its discharges to a public sewer, private sewer, individual sewage disposal system, grinder pump or other approved point of disposal.
CFR
The Code of Federal Regulations as published in the Federal Register.
CHEMICAL OXYGEN DEMAND (COD)
The equivalent quantity of oxygen utilized in the chemical oxidation of organic matter and oxidizable inorganic matter with a strong chemical oxidant under standard laboratory procedure and expressed in milligrams per liter. The laboratory determinations shall be made in accordance with the latest edition of Standard Methods.
CONTRACTOR
Any person, firm or corporation approved by the Director to do work in the town.
COOLING WATER
The water discharge from any condensation, air-conditioning, cooling, refrigeration or other system, but free from odor or oil and containing no polluting substances which would produce BOD or nonfilterable residue each in excess of six milligrams per liter over the concentration of nonfilterable residue in a potable water supply.
DEVELOPER
Any person or corporation who undertakes to construct simultaneously more than one housing unit on a given tract or land subdivision.
DIRECTOR
The responsible officer designated by the Board.
EASEMENT
An acquired legal right for the specific use of land owned by others.
ENGINEER
The professional engineer retained by the town.
EPA
See "USEPA."
GARBAGE
The putrescrible organic solid wastes from the domestic and commercial preparation, cooking and dispensing of food and from the handling, storage and sale of meat, fish, fowl or produce.
INDUSTRIAL USER
Any industrial or commercial establishment with a classification as designated in the Standard Classification Manual, 1972 Edition, as published by the Executive Office of the President, and who uses the town's sewer system.
INDUSTRIAL WASTES
Any liquids, gaseous or solid substance or a combination thereof resulting from any process of industry, manufacturing trade or business or from the development or recovery of any natural resources.
JAMESTOWN
The City of Jamestown.
MANHOLE COVER
Any portion of the sewage works designed to provide access to the sewage works, including grinder installations.
NATURAL OUTLET
Any sewer outlet into a watercourse, river, pond, ditch, aquifer, lake or other body of surface or subsurface water.
NYSDEC
The New York State Department of Environmental Conservation.
OWNER
Any individual, firm, company, association, society, person, group or entity having title to real property.
PERSON
Any individual, firm, company, association, institution, society, governmental agency, corporation, entity or group.
PH
The logarithm (base 10) of the reciprocal of the hydrogen ion concentration expressed in moles per liter as determined by Standard Methods.
POLLUTION
The man-made or man-induced alteration of the chemical, physical, biological and radiological integrity of water.
POTW
Publicly owned pretreatment works defined as follows: the treatment works as defined by 33 U.S.C. § 1292 which is owned by a state or municipality [as defined by 33 U.S.C. § 1362(4)]. This definition includes any sewers that convey wastewater to the POTW treatment plant. For the purposes of this chapter, "POTW" shall also include any sewers which convey wastewater from the town to a POTW and POTW treatment plants owned by others.
PRETREATMENT
The reduction of the amount of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharging or otherwise introducing such pollutants into a POTW. The reduction or alteration can be obtained by physical, chemical or biological processes, process changes or by other means, except as prohibited by 40 CFR 403.6, General Pretreatment Regulations for Existing and New Sources of Pollution.
PUBLIC SEWER
A sewer owned or maintained by the town.
RECEIVING WATERS
Any watercourse, river, pond, ditch aquifer or other body of surface or subsurface water receiving the discharge of sewage.
SANITARY SEWAGE
A combination of water-carried wastes which are similar in origin and strength to those typically produced in households, including wastewater from bathrooms, lavatories, toilets, kitchens and laundries.
SANITARY SEWER
A sewer which carries sewage and to which storm-, surface and ground waters are not intentionally admitted.
SEPTIC TANK WASTE
A combination of the liquid- and water-carried waste from residential, commercial, industrial and institutional septic systems, collected and transported by scavenger tank truck operators.
SEWAGE
A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground-, surface, and storm water as may be present. The preferred term is "wastewater."
SEWAGE TREATMENT PLANT
Any arrangement of devices and structures used for treating sewage.
SEWAGE WORKS
All facilities for collecting, pumping, treating and disposing of sewage.
SEWER
A pipe that carries wastewater or drainage water.
SIGNIFICANT INDUSTRIAL USER
Includes:
(1) 
All industries subject to promulgated categorical pretreatment standards [21 primary industries].
(2) 
Industries having substantial impact, either singly or in combination with other contributory industries, on the operation of treatment works.
(3) 
Manufacturing industries using, on an annual basis, more than 10,000 pounds and/or 1,000 gallons of material containing priority pollutants/substances of concern and discharging a measurable amount of these pollutants to the sewer system from the process using these pollutants.
(4) 
Those industries discharging more than 5% of the flow or load carried by the municipal system receiving the waste.
SLUDGE
The solid or slurry residuals resulting from the treatment of wastewater, including but not limited to filter cake, grit, scum, primary sludge and waste-activated sludge.
SLUG
Any discharge of water or wastewater which in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than 15 minutes more than five times the average twenty-four-hour concentration or flow during normal operation.
STANDARD DIMENSION RATIO (SDR)
The ratio of the outside diameter to the wall thickness of a PVC pipe.
STANDARD METHODS
The examination and analytical procedures set forth in the most recent edition of Standard Methods for the Examination of Water, Sewage and Industrial Wastes, published jointly by the American Public Health Association, the American Water Works Association and the Water Pollution Control Federation.
STATE PLUMBING CODE
The New York State Uniform Fire Prevention and Building Code applicable to plumbing, including all amendments.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sanitary sewage or industrial waste and which are removable by a laboratory filtration device. The laboratory "suspended solids" determinations shall be made in accordance with Standard Methods.
TOWN
The Town of Ellicott.
UNPOLLUTED WATER
Water of quality equal to or better than the water pollution control plan effluent criteria or water that would not cause violation of receiving water quality standards and would not be benefited by discharge to the sanitary sewers and wastewater treatment facilities provided.
USEPA
The United States Environmental Protection Agency or, where appropriate, a designation for the administrator or other duly authorized official of said agency.
USER
Any person that discharges wastewater into the wastewater facilities.
USER UNIT
A single-family dwelling or its equivalent; further clarification may be provided by the Sewer Rent Law of the town enacted under Article 14-F of the General Municipal Law of the state.
WASTEWATER
The spent water of a community or individual. From the standpoint of source, it may be a combination of the liquid- and water-carried wastes from residences, commercial buildings, industrial plants and institutions, together with any groundwater, surface water and stormwater that may be present.
WASTEWATER FACILITIES
The structures, equipment and processes required to collect, convey and treat domestic and industrial wastes and dispose of the effluent.
WATERCOURSE
A natural or artificial channel for the passage of water, either continuously or intermittently.
