No person shall abandon any motor vehicle, machinery,
marine vessels or equipment within the limits of the City of Linwood
or leave any vehicle, machinery, marine vessels or equipment at any
place within the City for such time and under such circumstances so
as to cause the same to appear to have been abandoned.
Whenever it shall appear to the Chief of the
Police Department of the City of Linwood or to any official representative
of the Common Council of the City of Linwood that the presence upon
any lands within the City of Linwood of a motor vehicle not currently
used or licensed or any unused machinery, marine vessels or equipment
is detrimental to the general health, safety and welfare in that it
is unsightly, the owner and/or tenant of such land shall be required
to remove therefrom such motor vehicle, machinery, marine vessels
or equipment or to place the same in a garage or other enclosed structure
within five days after receipt by such owner or tenant of written
notice from the Chief of the Police Department and/or a representative
of the Common Council of the City of Linwood. This notice may be served
personally upon the owner or tenant or may be directed to him by certified
mail.
In the event of the failure of the owner of
properties so notified to remove any motor vehicle, machinery or equipment
within five days from the date of notice as aforesaid, the City Council
may cause the removal of said vehicle, machinery, marine vessels or
equipment, and in such case, the officer in charge of removal shall
certify, in writing, to the City Council the cost thereof, which cost,
if found correct, shall be charged against said land, and the amount
so charged shall forthwith become a lien upon said land and shall
be assessed and levied upon said land and shall bear interest of the
same rate as taxes and shall be collected and enforced by the same
officer and in the same manner as taxes.
In the event of the failure of the owner or
tenant of said land to remove said motor vehicle, machinery, marine
vessels or equipment existing thereon, within the time required after
the service of the notice hereinbefore mentioned, and, in addition
to the remedies hereinbefore provided, said person shall be in violation
of this chapter and, upon conviction thereof by the Judge of the Municipal
Court of the City of Linwood, shall be punished by a fine of not less
than $100 nor more than $1,000 and/or imprisonment in such a place
as is maintained for offenders in the City of Linwood for a period
not to exceed 30 days, or both. Each day during which the violation
continues, subsequent to five days from receipt of notice, shall be
considered a separate offense.
